In order to demonstrate their status, the economic operator should submit the following documents:

— declaration by the economic operator that in the last five years he was not pronounced a verdict for participation in a criminal organization, corruption, fraud or money laundering.

— Confirmation that it is not a subject to bankruptcy procedure by a competent authority.

— Confirmation that it is not a subject to bankruptcy procedure for winding by the competent authority.

— Confirmation of paid taxes, contributions and other public duties by the competent authority of the country in which the economic operator is registered.

— Certificate from the Registry of penalties for crimes committed by legal entities that it has not been imposed a minor…

— Confirmation that it has not imposed a sanction by verdict — prohibition on performing a profession, activity or duty, i.e. temporary prohibition for performing professional activity In order to prove the ability for performing professional activity, the economic operator should submit the following documents:

— Document for registered activity, as an evidence that it is registered as a legal entity for performing the activity related to the subject of the Public procurement contract, or evidence that it belongs to an appropriate professional association in compliance with the regulations of the country it is register.

No documents are required to prove the economic situation of the economic operator.

Техничка и професионална способност:

Required documents for proving the technical and professional capability of the economic operator:

— The economic operator should possess a document/certificate which proves that each of the goods is approved for sale by the Ministry of health of RM;

— The economic operators have to submit security documents, i.e. (MSDS) — documents concerning dangerous chemical substances, and which contain data and information which many times exceed those given in the products' declarations;

— Mandatory submission of a catalogue with sharply delineated pages for the of fered catalogue issue.

Minimum criteria for determining the technical and professional ability of the economic operator:

— Decree issued by the Ministry of Health for distribution of goods offered;

— MSDS (Material Safety Data Sheet) for each offered item;

— Mandatory submission a catalogue with sharply delineated pages for the of fered catalogue issue.

Warranty for quality performance of the contract in the amount of 10 % of the Contract value.

The appeals procedure shall be initiated by filing a complaint or a request for cancellation of the award of a public contract for failure documentation to the State Commission in accordance with Article 222. Appeal will be filed within 8 days of:

— The announcement of the award of a public contract in terms of information, actions or failure to take action by the announcement,

— Opening of the bids in respect to actions or failures to undertake actions related to the tender documentation, i.e. the bid opening,
