The economic operator with 1 or several negative references, the group of economic operators in which participate economic operator with negative reference, as well as the economic operator who is a joint company with the economic operator with a negative reference, shall not have right to participate.

Each domestic and foreign natural or legal person-bidder registered for the business activity connected to the subject to the public procurement contract has a right to submit a bid.

A group of bidders also has a right to submit a bid without having to make any kind of association in a legal form. The contracting authority will not require the members of the group to form a legal association if this association is selected as contractor of the public procurement contract.

The bid submitted by group of economic operators shall include a contract on bid submitted by group of economic operators, by which the members of the group of economic operators engage before the contracting authority to execute the public procurement contract. The Contract must contain the following data:

— The member of the group that will be responsible for the group, i.e. will submit the bid and will represent the group before the contracting authority,

— The member of the group that will submit Participation Guarantee in form of bank guarantee or deposit, in the name of the group of economic operators,

— The member of the group that will sign the public procurement contract in the name of the group of economic operators,

— The member of the group that will issue the invoice and account for the payments,

— Brief description of the responsibilities of each member of the group of economic operators, regarding the execution of the contract.

All members of the group of bidders are individually and in solidarity responsible before the contracting authority for the execution of their duties. The contracting authority will communicate with the representative of the group of bidders.

Nota Bene: At the moment of submission of the bid all members of the group must be registered into the Electronic System for Public Procurements (ESPP).

The economic operator can participate in one bid only in the framework of the same procedure for awarding a public procurement contract. All bids will be rejected if the economic operator:

— participates in more than one independent bid and/or as a member of a group bid, or

— participates as subcontractor in another independent bid and/or as a member of a group bid.

The bidder is allowed to hire subcontractors. Provided that the economic and financial standing, as well as the technical or professional capacity of the bidder are not supported by other subjects as subcontractors, he has no obligation to submit documentation for certification of the subcontractors' capacities. In the contrary case, Articles 151 and 154 of the Law on Public Procurement shall apply, regardless of the fact if other subjects are subcontractors or not.

Persons who participated in the preparation of the tender documentation must not be bidders or members of a group of bidders in the procedure of awarding a contract.

Економска и финансиска состојба:

— Statement that over the last 5 years against the Tenderer/Economic Operator a final verdict for participation in criminal organization, corruption, fraud or money laundry has not been made;

— Confirmation that no bankruptcy procedure has been initiated against it by a competent authority;

— Confirmation that no liquidation procedure has been initiated against it by a competent authority;

— Confirmation on paid taxes, contributions and other public charges from the competent authority in the country of Economic Operator/Tenderer registration;

— Certificate from the Register of Penalty actions for the legal entities that no…

… prohibition to participate in the process of public notice, public procurement contracts award, and public partnership contracts have been made;

… subordinate, temporary or permanent prohibition to do a certain activity has been stated, and

— Certificate that by a final verdict no penalty sanction has been made to it — prohibition of doing the profession, business or duty and/or a temporary prohibition of doing specific activity.

— Bidder is obliged to provide accurate data and to present the information required by the contracting authority.

Техничка и професионална способност:

In order to prove his capability for performing professional activity, the economic operator shall deliver a document for registered activity (DRA form) in order to prove it is registered as a natural person or legal entity to pursue the activity related to the subject-matter of the public procurement contract or a prove that it belongs to a professional association in accordance with the regulations of the country where registered.

While checking the completeness and validity of the documentation for determining the ability of tenderers and the bid evaluation, the Commission may ask for explanation of the tender documentation from the agreed organ, exclusively in a written form, 5 working days after the deadline for submitting offers.

The economic operator shall submit the requested explanation in written form within the deadline envisaged by the contracting authority, which shall not be less than 3 working days from the day when the tenderer has received the request from the contracting authority.

If economic operators submit an offer as a group of economic operators, the technical and professional ability is proved by taking into account the resources of all members of the group. If the group of economic operators participates with technical or professional support by a third subject, the technical and professional support is determined in accordance with the above mentioned.
