1 In order to prove the ability to pursue professional activity, the bidder should fulfil the following conditions:
— to be registered as a legal entity for performance of the activity in relation to the subject of public procurement;
— document for registered activity as a proof that they have been registered as a legal entity for performance of the activity in relation to the public procurement agreement and proof that they are part of a professional association pursuant to the regulations of the country where they are registered.

2.4.1 In order to qualify as capable of implementing the public procurement contract in terms of its technical and professional capacity, the economic operator shall meet the following minimum requirements:
a) for part 1 — IT equipment:
requirements:
— the economic operator should have conducted at least 3 deliveries, same as those of the subject of the public procurement contract, in the past 3 years (2014, 2013 and 2012), and
— the economic operator must have at its disposal a minimum of 3 staff members certified by the manufacturer for installation and service of the products subject to delivery by listing the educational and professional qualifications, as well as proof that the listed individuals are hired/contracted by the economic operator (M1/M2 forms/contract commitment and short biography etc.) regardless whether they directly belong to the economic operator.

Evidence:
— reference list of at least 3 deliveries, same as those of the subject of the public procurement contract, conducted in the past 3 years (2014, 2013 and 2012) containing values, dates and customers (contracting authorities or economic operators) and accompanied by at least 3 statements for quality deliveries issued by the customers listed in the reference list for the past 3 years (2014, 2013 and 2012), or if such statements cannot be provided due to reasons beyond the control of the economic operator, only with its statement regarding the conducted deliveries, and

c) for part 3) — analogue telephone sets for landline telephony:
— for this section there are no minimum requirements for providing the technical or professional capacity.
2.4.3 The statements and lists from item 2.5.2 shall be prepared and signed by the economic operator and they don't have to be certified by a competent authority.
2.4.4 The technical and professional capacity of the economic operator may be supported by another entity regardless of the legal relations between the economic operator and the entity, except in the part regarding the reference list, the previously concluded contracts and licenses. If the economic operator is trying to prove its technical and professional capacity by invoking support by another entity, it shall prove the support by presenting valid evidence that the entity shall make available to the economic operator relevant technical and professional resources. The entity providing technical support shall not be subject to a final judgment of conviction for participation in a criminal organization, corruption, fraud or money laundering.

If the economic operator is trying to prove its technical and professional capacity by invoking support by another entity, it shall submit:
— evidence (statement of the entity that provides the support or the contract between the entity that provides the support and the economic operator) and
— statement of the entity that provides the support, stating that no effective verdict has been pronounced for participation in criminal organization, corruption, fraud or money laundering.
2.4.5 If economic operators submit bids as a group of economic operators, their technical and professional capacity is proved by taking into consideration the resources of all members of the group. If the group of economic operators participates with technical or professional support by a third entity or third entities, their technical and professional capacity shall be ascertained on the basis of the above stated.
