The contracting authority will exclude from the contract award procedure any economic operator:

— That in the last 5 years has had an effective sentence for participation in a criminal organization, corruption, fraud or money laundering;

— That was served with a minor penalty of prohibition for participation in public call procedures, public procurement contract awarding and agreements for public private partnership;

— That was served with a minor penalty of temporary or permanent prohibition of professional capacity;

— That is in bankruptcy or liquidation proceedings;

— that has unpaid taxes and other public charges, unless the economic operator has been granted deferred payment of taxes, contributions or other taxes in accordance with special regulations and pays them regularly;

— That was served with a misdemeanour sanction — ban on performing profession, activity or duty i.e. temporary prohibition on performing specific activity; and

— gives false information or does not submit the data requested by the contracting authority.

2.2.2 In order to prove its personal situation the economic operator submits the following documents:

— Statement by the economic operator that in the past 5 years they have not been issued with an effective sentence for participation in criminal organization, corruption, fraud or money laundering;

— Certificate that there is no ongoing bankruptcy proceedings;

— Certificate that there is no ongoing liquidation proceedings;

— Certificate for paid taxes, contributions or other public taxes from a competent body in the country where the economic operator is registered;

— Certificate issued by the Registry of Penalties for criminal acts of the legal entities proving that they have not been issued with a minor penalty for prohibition of participation in public call procedures, public procurement contract awarding and agreements for public-private partnerships;

— Certificate issued by the Registry of Penalties for criminal acts of the legal entities that they have not been issued with a minor penalty for temporary or permanent prohibition for performance of certain activity;

— Certificate proving that there is no effective misdemeanour sanction — ban on performing profession, activity or duty i.e. temporary prohibition of performing specific activity.

Економска и финансиска состојба:

In order to prove the ability to pursue professional activity, the bidder must meet the following terms:

— To be registered as a legal entity for performance of the activity in relation to the subject of public procurement agreement, and

— To own a valid document issued by the competent authority for performance of works such as the subject of procurement.

2.3.2 In order to prove the fulfilment of the capacity for performance of the professional activity, the economic operator must submit the following documents:

— document for registered activity as a proof that they have been registered as a legal entity for performance of the activity in relation to the public procurement agreement and proof that they are part of a professional association pursuant to the regulations of the country where they are registered;

— valid licence A issued by the Ministry of Transport and Communications pursuant to the Law on Construction (Official Gazette of Republic of Macedonia no. 130/2009, 124/10, 18/11, 36/11, 49/11, 54/11, 59/11, 13/12, 39/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14 and 149/14) or certificate for performance of works issued by the state administration body competent for performance of the works for landscaping pursuant to Article 42 of the Law on Construction for foreign legal entities (Official Gazette of Republic of Macedonia no. 130/2009, 124/10, 18/11, 36/11, 49/11, 54/11, 59/11, 13/12, 39/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14 and 149/14).

Минимално ниво(а) на стандарди:

In order to qualify as eligible for performance of the subject agreement for public procurement from aspect of economic and financial standing, the economic operator should fulfil at least the following minimal criteria:

Minimal annual income of financial assets of the economic operator in the last 3 years (2013, 2012 and 2011, a total for the 3 years) of 6 000 000 EUR (in MKD).

Техничка и професионална способност:

The economic operator shall prove that the minimal criteria of sub-item 2.5.1 are met by submitting:

— Reference List of performed works in the last 5 years by submitting at least 3 certificates issued by the investors for satisfactory performance of the most important works, certificates including values, dates (time) and location of performance of the works and statements whether the works have been performed pursuant to the rules of business and have been properly completed;

— Agreement/Confirmation/Final Situation/Minutes of Technical reception for construction of objects as proof that the economic operator has performed at least 1 (one) object in the building construction in the last 5 (five) years with a value of at least 2 000 000 EUR;

— Statement and list of the professional staff that is employed within the economic operator by stating the professional, educational qualifications, M1/M2 forms (employment forms) and the necessary authorization issued in the behalf of the employees;

— Statement and list of technical equipment that the economic operator has at their disposal for performance of concrete works — subject to this public procurement, and

— Notification for the elements of the agreement that the economic operator intends to give to a sub-contractor.

Минимално ниво(а) на стандарди:

In order to qualify as capable of implementing the public procurement contract in terms of its technical and professional capability, the economic operator shall meet the following minimum requirements:

— It is necessary for the economic operator to have constructed three object of building construction in the last 5 (five) years with a value of at least 2 000 000 EUR;

— The economic operator should have employed professional staff out of which: at least one architect with an authorization for performance A or B, one construction engineer with an authorization for performance A or B, one electro engineer with an authorization A or B and one machine engineer with an authorization for performance A or B, and

— The economic operator must have at their disposal technical equipment for performance of the works subject to this public procurement.

Потребни депозити и гаранции:

1. Guarantee for the bid in the amount of 3 % of the value of the bid no VAT included.

2. Guarantee for qualitative performance of the agreement in the amount of 10 % of the value of the agreement.
