2.2 Personal condition.

2.2.1 The Contracting organ will exclude from the procedure for awarding the public procurement agreement every economic operator:

— To whom during the last 5 years was sentenced effective sentence for participation in criminal organization, corruption, fraud or money laundering;

— To whom was sentenced ancillary sentence ban for participation in procedures for public calls, awarding of public procurement contracts and private public partnership contracts;

— To whom was sentenced ancillary sentence temporary or permanent ban for practising certain activity;

— That is under bankruptcy procedure or liquidation;

— That has uncovered taxes, contributions or other public expenses, except if to the economic operator was approved delayed payment of the taxes, contributions or other public expenses pursuant the special ordinances and the same pays regularly;

— To whom was sentenced crime sanction — ban for practising profession, activity or duty, that is, temporary ban for practising certain activity and

— Who presents false data or does not submit data requested by the Contracting organ.

2.2.2. For vindication of the personal condition, the economic operator submits the following documents:

— Statement of the economic operator that during the last 5 years he was not sentenced effective sentence for participation in criminal organization, corruption, fraud or money laundering;

— Confirmation that there is no open bankruptcy procedure from the responsible organ;

— Confirmation that there is no open liquidation procedure from the responsible organ;

— Confirmation for paid taxes, contributions and other public expenses from responsible organ from the country where the economic operator is registered;

— Confirmation from the Register of sentences for criminal actions of legal persons, that he is not sentenced ancillary sentence…

… ban for participation in procedures for public calls, awarding contracts for public procurement and PPP Contracts;

… temporary or permanent ban for executing certain activity;

— Confirmation that with effective sentence he is not sentenced crime sanction — ban for practising profession, activity or duty, that is, temporary ban for practising certain activity.

2.2.3 The statement from line 1 sub-point 2.2.2 is prepared and signed by the economic operator and it is not obligatory to be certified from responsible organ.

2.2.4 The confirmations for not being opened bankruptcy procedure and liquidation procedure, as well as, the confirmations from the register of sentences for criminal acts from lines 5 and 6 of sub-point 2.2.2 are issued by the responsible organs in the country where the economic operator is registered. In the Republic of Macedonia, responsible organ for issuing these confirmations is the Central Register of the Republic of Macedonia.

2.2.5. The confirmation on paid taxes, contributions and other expenses is issued by the responsible organ in the country where the economic operator is registered. In the Republic of Macedonia, responsible organ for issuing of this confirmation is the Public Revenues Office.

2.2.6 The confirmation from line 7 of the sub-point 2.2.2 is issued by the responsible organ in the country where the economic operator is registered. In the Republic of Macedonia, responsible organ for issuing of this confirmation is the Central Register of the Republic of Macedonia.

2.2.7 The documents from sub-point 2.2.2 are not allowed to be older than 6(six) moths counted from the deadline for submission of the applications for participation backwards.

2.2.8 If the country in which is registered the economic operator does not issue the stated documents in the sub-point 2.2.2 or if they do not cover all of the previously stated cases, the economic operator can submit statement certified by the responsible organ.

2.3 Capability for practising professional activity

2.3.1 In order to confirm the capability for practising professional activity, the economic operator should submit document for registered activity as evidence that is registered as physical or legal person for practising the activity connected with the subject of the public procurement agreement or evidence that belongs to suitable professional association pursuant the regulations of the country where he is registered. In case of group of economic operators, all of the members of the group separately vindicate the capability for practising professional activity.

2.4.2 The economic operator evidences the fulfilment of the minimum conditions from sub-point 2.4.1 with submission of:

— Attachment licenses for preparation of geological documentation, execution and supervision of geological surveys for at least 3 persons original or copies certified by the economic,

— Attachment licenses for development of mining projects for surface and underground mining, processing of minerals and other mining projects in the field of mining for at least 3 persons original or copies certified by the economic and

— The economic operator must submit at least three (3) certificates for services for preparation of projects in the field of geology and mining of the recipients of those services, if such certificates can not be provided due to reasons beyond the control of the economic operator only submit a statement for services in the required areas.

2.4.1 In order to qualify as capable for executing the subject public procurement agreement, from aspect of its technical or professional capability, the economic operator should fulfil the following minimum condition:

— Employ or dispose of at least three (3) persons who…

… hold a license to prepare geological documentation, execution and supervision of geological surveys,

… have license for manufacture of mining projects for surface and underground mining, processing of mineral ores and other mining projects in the field of mining and

— The economic operator should have at least three (3) certificates for services for preparation of projects in the field of geology and mining of the recipients of those services, if such certificates can not be provided due to reasons beyond the control of the economic operator, only his statement of services rendered in the required areas.

The contracting authority shall perform the payment within 60 days, starting to expire from the first day after the date of receipt of the invoice to the archive of the contracting authority. The invoice must be accompanied by a report on the performed service signed and verified by full name by an authorized representative of the contractor and signed by an authorized person of the contracting authority that the service is performed according to the requirements and conditions in the technical specifications in the tender documentation.

Notice: In the invoice to state: the subject of the contract, number and date.

5.1 Opening of Bids.

5.1.2 Only authorized representatives may participate in the procedure of public opening of Bids by giving remarks in the Minutes of the Opening of Bids.
