Personal situation:

The economic operator shall submit the following documents for the purpose of proving its personal standing:

— A Statement by the economic operator that it has not been imposed a legally valid court decision for participation in criminal organization, corruption, fraud or money laundering in the last 5 years;

— Certificate by a competent authority that a…

… bankruptcy procedure has not been initiated;

… liquidation procedure has not been initiated;

— Certificate by a competent authority from the country where that economic operator is registered for paid taxes, contributions and other public duties;

— Certificate by the Register of sentences for committed crimes of legal entities that a secondary sentence…

… prohibition on participation in open call procedures, awarding public procurement contracts and contracts for public private partnership, has not been imposed,

… temporary or permanent prohibition on performing a certain activity, has not been imposed, and

— Certificate that a misdemeanor sanction resulting in prohibition for practising profession, performing activity or duty, i.e. temporary prohibition for performing a particular activity has not been imposed by a legally valid court decision.

Professional registration

For the purpose of proving its ability to perform a professional activity, the economic operator shall submit:

— A Document for registered activity (DRD Form) as a proof that the operator is registered as a natural person or a legal entity to perform an activity related to the public procurement contract or proof of membership in an appropriate professional association in accordance with the regulations of the country where the operator is registered, issued by the competent authority,

— Valid license for performing energy activities — wholesale with oil and oil derivatives issued by the Energy Regulatory Committee of the Republic of Macedonia for domestic economic operators,

— Valid Excise license for the provided (own and/or leased) reservoir capacities for oil derivative subject of public procurement for each part/parts for which their bid is referring — for domestic economic operators,

— Valid License for performing energy activity — storage of oil and oil derivatives, issued by the Energy Regulatory Commission of the Republic of Macedonia — for domestic economic operators,

— For foreign entities economic operators a valid license or other appropriate document for performing of energy activities — wholesale with oil and oil derivatives issued by the competent authorities pursuant to the regulations of the country where the economic operator is registered.

Required documents to prove the economic and financial standing of the economic operator:

— Appropriate bank statements,

— Balance sheets certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets, when the announcement of the balance sheet is prescribed by law in the country wherein the economic operator is registered, and

— Statement regarding the overall turnover of the enterprise (data on the profit and loss account issued by a competent authority, i.e. audited profit and loss account) and, where applicable, from the turnover in the field covered by the public procurement contract, for the last financial year, for which such information is available, depending on the date on which the enterprise has been incorporated or commenced its operation and depending on the availability of such information.

To qualify as capable of performing the public procurement contract, in terms of its economic and financial ability, the economic operator must meet the following minimum requirements:

— Minimum average annual turnover at the amount of 20 000 000 MKD in the last financial year.

Техничка и професионална способност:

Required documents to prove the technical capacity or professional ability of the economic operator:

Economic operator shall prove the fulfilment of the minimum requirements by submitting:

— Copies of car licenses or car rental agreements for tanks, which have been concluded for a period not shorter than the period of validity of the bid, that should contain data from the car licenses of the leased tanks,

— Copies of minimum 3 concluded contracts for delivery of oil derivatives conducted in the past 3 years, with an individual value of each not less than 1 500 000 MKD or if such contracts cannot be provided due to reasons beyond the control of the economic operator, only with its statement regarding the conducted deliveries,

— The economic operator should submit valid evidence indicating that it possesses its own and/or leased excise reservoir facilities for the oil derivative subject of the public procurement, for each separate part/parts for which their bid is referring, i.e. property certificate or deed of title issued by the competent authority in the Republic of Macedonia. In the case of leased excise reservoir facilities, acceptable proof is a lease agreement valid for at least 5 years. For foreign entities economic operators, acceptable proof is appropriate contract for ensured warehouse on the territory of the Republic of Macedonia, concluded with the holder of the valid excise license and valid license for performing energy activity — storage of oil and oil derivatives issued by the Energy Regulatory Commission of the Republic of Macedonia.

— Information about the elements of the contract which the economic operator intends to give to the Subcontractor,

— Document (certificate) to prove the conformity of the quality of the offered fuel, which is issued by the manufacturer, supplier or authorized independent laboratory compiled according to form TNG-1 (‘Official Gazette of the Republic of Macedonia’ No. 88/07).

Минимално ниво(а) на стандарди:

To qualify as capable of performing the public procurement contract, in terms of its technical capacity or professional ability, the economic operator must meet the following minimum requirements:

— To have at least 5 (five) own or leased technically correct tanks for transporting oil and oil derivatives, pursuant to the valid legislation in the Republic of Macedonia,

— Minimum 3 concluded contracts for delivery of oil derivatives conducted in the past 3 years, with an individual value of each not less than 1 500 000 MKD,

— The economic operator should provide their own and/or leased excise reservoir facilities for the oil derivative, subject of the public procurement contract,

— Oil derivative subject of the public procurement contract, must be in accordance with the specifications for the respective fuel listed in the applicable Rules of the quality of liquid fuels in the Republic of Macedonia (Official Gazette No.88 / 2007, 91/2007, 97/2007, 105/2007, 157/2007, 15/2008, 78/2008, 156/2008 and 81/2009) and the standard: MKS EN 590: 2007 cor.mk adopted by the Standardization Institute of the Republic of Macedonia, ‘or equivalent’ under Article 33 paragraph 2 line 1 of the Public Procurement Law.

In order to sign the contract with the selected most favourable economic operator, the successful bidder shall be required to provide a contract performance bank guarantee in the amount of 5 % of the contract value.

The appeals procedure shall be initiated by submitting the appeal, i.e. by submitting the request to the Appeals Commission for annulling the contract award procedure because the contracting authority failed to submit the required documentation pursuant to Article 222 of this Law.

In case of electronic auctions, the appeal regarding the actions or failures to undertake actions related to the tender documentation shall be lodged within 8 days from the of receipt of the formal decision for an individual right in the contract award procedure.

The economic operator failing to lodge an appeal pursuant to the provisions in paragraph (2) of this Article shall not have the right to lodge an appeal for the same legal basis in the latter stage of the procedure.

The appeal shall be lodged within 8 days from the day of:

— publication of the contract notice, regarding the information, actions or failures to undertake actions under the contract notice,

— opening of tenders, regarding the actions or failures to undertake actions related to the tender documentation, i.e. the public opening of tenders,

— receipt of the formal decision for an individual right in the contract award procedure, regarding the establishment of the qualifications from the requests to participate or the evaluation of tenders, as well as the decision, or,

— acknowledging illegal implementation of the contract award procedure, within 1 year after the day of completing the contract award procedure.
