The tender, as well as the overall correspondence and documents related to the tender shall be submitted in Macedonian. In expression of the price with letters, foreign economic operator may also use English. Accompanying literature may be in another language. The Contracting Authority reserves the right to request the tenderer in the evaluation phase to provide translation of the printed literature submitted in another language. The carrier of the procurement shall deliver the goods within 15 (fifteen) working days from the day of receipt of the request for delivery of goods. The carrier of the procurement shall deliver the subject of the contract at the following location: Jugohrom Ferroalloys DOOEL — village Jegunovce. The deadline and the place of delivery shall be binding. Any tender including deadline and place of delivery different than the ones specified in this paragraph shall be deemed unacceptable and rejected as such by the Public Procurement Commission. The English version of tender documentation is available for free on the ESJN website (https://enabavki.gov.mk/PublicAccess/Home.aspx#/home), after being registered as an economic operator. In case of discrepancies between the Macedonian and English versions of the tender documentation, the Macedonian one shall be considered valid.

The Ministry of Environment and Physical Planning…

… has set as priority the settlement of one of the biggest hot-spots of Vardar River pollution and this is contamination with six-valent chromium (Cr6+) by the old industrial landfill in Jegunovce.

… is implementing the project ‘Protection of Vardar River from contamination with chromium’. This project is part of the programme for environment reconstruction in Southeastern Europe as segment of the Stability Pact.

The treatment plant conducts treatment of waters contaminated with Cr 6+ in the vicinity of the village Jegunovce, collected by 3 individual systems, resulting from the former operation of HEK Jugohrom:

1. Ground waters polluted by production plants of HEK Jugohrom (as historical pollution);

2. Polluted ground and surface waters in the village Jegunovce; and

3. Polluted ground and leakage waters from the industrial landfill of HEK Jugohrom.

Treatment of wastewaters containing Cr6+ is carried out through technological process consisting of several chemical reactions.

Under the agreement between MEPP and Jugohrom Ferroalloys DOOEL from the village Jegunovce, one of the obligations of the MEPP is to cover the costs for consumed chemicals that are necessary for the technological process for treatment of wastewater containing Cr 6+.

2. Goal

The main goal of this project is to provide continuous operation of the wastewater treatment plant thus ensuring continuous treatment of polluted ground waters, decontamination of contaminated soils in the surrounding of the village Jegunovce and preventing polluted waters from the industrial landfill (both ground and leakage waste waters) to run directly into Vardar River. This will prevent possible pollution of the springs of Rasche which is the main source of water supply for the City of Skopje.

Continuous operation of the treatment plant will be secured only by timely supply of required chemicals for the technological process of contaminated waters treatment.

3. Location

The location of the treatment plant is within the site of Jugohrom Ferroalloys DOOEL — village Jegunovce, where polluted waters are brought by the three systems of different concentration of contamination.

The populated place Jegunovce is located at a distance of 16 km from Tetovo and around 50 km from Skopje.

4. Functions of the system

4.1. Description of the technological process of the treatment plant

The treatment plant performs treatment of waters contaminated with Cr6+from the 3 systems.

The main process of treatment is reduction of the toxic Cr6+ into significantly less toxic Cr3+ which under normal conditions forms unsolvable compounds that are not dangerous for the environment.

The system of treatment of waters contaminated with Cr6+ consists of the following functional components:

Pumping station and equalization well

Chromium reduction

neutralization

Polluted waters from wells, drainage systems and landfill are brought to the equalization tank where diffuse equalization of concentrations of Cr6+in the water is performed. The pump abstracts water from the equalization tank and it is transported to the treatment plant for further treatment.

Contaminated water from the equalization tank is brought to reduction tubes. Depending on pH value, sulfuric acid is dosed so that pH value is maintained below 2,5. By measuring of redox potential, Sodium disulfide is dosed. Through this process, Cr6+ is reduced to Cr 3+.

Neutralization

Decontaminated water runs to the tube for 1

At second degree of neutralization, final neutralization is made with pH value of 8,5 0,3.

Upon the control of pH, water is discharged in the sewerage network.

4.2. Required chemicals

Required costs for chemicals depend on the treatment of water/concentration of contamination. To estimate the costs for chemicals, the Final Report on ‘Protection of land, surface and ground waters against pollution with chromium in the surrounding of Jegunovce’ was used, ‘GIUGLARIS039 — Recovery — EAR-SK; EU FWC LOT 6 Environment’, prepared by the expert Mr Miroslav Chernak engaged by the European Reconstruction Agency, as well as the experience of ЕКОМАК from the operation of the treatment plant in the past.

Together with the tender, the economic operator shall submit accompanying documentation proving the following: personal status, capability for professional activity performance.

The Contracting Authority shall exclude from the procedure for public procurement contract awarding every economic operator:

— against which sentence for participation in criminal organization, corruption, fraud or money laundry has been passed by means of effective court decision for the last 5 year;

— against which secondary penalty prohibition to participate in public calls, contracts for public procurement and contracts for public private partnership awarding has been passed;

— against which secondary penalty of temporary or permanent prohibition to perform certain activity has been passed;

— which is subject to bankruptcy or liquidation procedure;

— who has unpaid taxes, contributions and other public charges, except where economic operator has been approved delayed payment of taxes, contributions and other public charges in accordance with specific regulations and these are paid on regular basis;

— against whom misdemeanour sanction — prohibition to perform profession, activity or duty or temporary prohibition to perform activity has been passed, and who has given false data or failed to deliver the data requested by the Contracting Authority.

To prove their personal status, economic operators shall submit the following documents:

— statement by the economic operator that no sentence for participation in criminal organization, corruption, fraud or money laundry has been passed against it by means of effective court decision for the last 5 years;

— certificate that no bankruptcy procedure has been initiated against it by the competent authority;

— certificate that no liquidation procedure has been initiated against it by the competent authority;

— certificate for paid paid taxes, contributions and other public charges by the competent authority of the country in which the economic operator has been registered;

— certificate from the Registry of penalties for perpetrated crimes for legal persons that no secondary penalty…

… prohibition to participate in public calls, contracts for public procurement and contracts for public private partnership awarding has been passed;

… f temporary or permanent prohibition to perform certain activity has been passed;

— certificate that misdemeanour sanction — prohibition to perform profession, activity or duty or temporary prohibition for performance of specific activity — has not been passed against it by means of effective court decision.

— The statement by the economic operator that no sentence for participation in criminal organization, corruption, fraud or money laundry has been passed against it by means of effective court decision for the last five years, shall be prepared and signed by the economic operator itself and it does not have to be certified by competent authority.

— Certificates that no bankruptcy procedure or liquidation procedure has been initiated, as well as certificates from the registry of penalties for perpetrated crimes, shall be issued by the competent authorities in the country where the economic operator is registered.

— Certificate for for paid paid taxes, contributions and other public charges shall be issued by the competent authority of the country in which the economic operator has been registered.

— Certificate that misdemeanour sanction — prohibition to perform profession, activity or duty or temporary prohibition for performance of specific activity — has not been passed against it by means of effective court decision, shall be issued by the competent authority of the country in which the economic operator has been registered.

— The above mentioned documents shall not be older than 6 (six) months counted from the deadline for tenders submission backwards.

If the country in which the economic operator has been registered does not issue the above mentioned documents or they do not include all above listed cases, the economic operator may submit a statement certified by the competent authority.

Capability to perform professional activity

To prove their capability for performance of professional activity, the economic operators shall submit document for registered activity as evidence that they have been registered as natural or legal person for the performance of the activity related to the subject of the contract for public procurement or evidence that they belong to appropriate professional association in accordance with the regulations of the country of registration.

To evidence specific conditions for performing the activity related to the subject of the public procurement, economic operators shall submit:

— Permit to perform activity of trade in chemicals, and

— Permit to perform activity of trade in precursors.

The required permits are in accordance with the Law on Chemicals and Law on Precursors.

According to Article 65 of the Law on Chemicals (Official Gazette of the Republic of Macedonia no. 145/10 and 53/11), legal persons performing trade in chemicals shall fulfil the conditions prescribed by this Law and detailed conditions prescribed in regulations adopted under this Law. The permit to perform activity of trade in chemicals is issued for a period of 5 years.

Drugs Agency shall keep records of the legal persons that have been issued permit to perform trade in chemicals.

According to Article 8 of the Law on Precursors (Official Gazette of the Republic of Macedonia no. 37/04, 40/07, 53/11), the operator may perform trade in precursors only upon obtaining permit to perform trade in precursors from the Ministry of Health.

The permit is issued upon written application by the legal person to perform trade in precursors, for accurately determined precursors, for a period of 5 years. According to Article 21 of this Law, the Ministry of Health shall keep registry of legal persons performing production and/or trade in precursors which shall especially include the quantity of precursor and name of operator.

Техничка и професионална способност:

Economic operator shall prove the compliance with the minimum requirements by submitting:

— Permit for import of the chemicals and precursors that are subject of the procurement, and statement of the end user issued by the Ministry of Health/Drugs Agency.

The required permits are in accordance with Article 69 of the Law on Chemicals and Article 14 of the Law on Precursors.

— Statement by the economic operator on end user confirming the use of chemicals and precursors for their own purposes or further sale.

— Safety data sheets for chemicals issued by chemicals producers.

— Labeling and categorization of precursors issued by precursors producers.

The requirement for safety data sheets for chemicals shall be in accordance with Article 37 of the Law on Chemicals.

Labeling and categorization of precursors shall be in accordance with Article 3 of the Law on Precursors which stipulates that precursors, under the ratified multilateral agreements and international norms and standards are distributed to three categories. Sulphuric acid belongs to third category of precursors.

— Report on chemical safety by the economic operator.

The condition is in accordance with Article 46 of the Law on Chemicals which stipulates that the Report on chemical safety is a document for evaluation of the safety of the chemical, including also the measures for reduction and control of the substance related risk. The manner in which the evaluation is carried out and the content of the report are regulated by the Rulebook on the manner of performance of the evaluation of the chemical safety and content of the report on chemical safety (Official Gazette of the Republic of Macedonia no. 82/11).

Technical and professional capability of the economic operator may be supported by another entity regardless of the legal relations between the economic operator and that entity, except in the segment of the reference list of prior concluded contracts and licenses. In case the economic operator proves their technical and professional capability referring to the support of another entity, they shall prove the support by valid evidence that the entity will make available to economic operator the appropriate technical and professional resources. The entity providing technical or professional support shall not be subject of effective sentence for participation in criminal organization, corruption, fraud or money laundry.

In case of economic operators submitting tender as group of economic operators, technical and professional capability shall be proved by taking into account the resources of all members of the group. If the group of economic operators acts by technical or professional support by third entity or third entities, technical and professional capability shall be confirmed in accordance with the above specified.

Минимално ниво(а) на стандарди:

To qualify as capable to perform the subject contract for public procurement in terms of their technical or professional capability, the economic operators shall meet the following requirements at minimum:

1. Tenderer shall possess permit for import of the chemicals and precursors that are subject of the procurement, and statement of the end user issued by the Ministry of Health/Drugs Agency.

2. Tenderer shall possess Safety data sheet and labeling and categorization of precursors.

3. Tenderer shall have report on chemical safety.

Потребни депозити и гаранции:

As part of the tender, the economic operator shall provide guarantee of the tender (guarantee for participation) at an amount of at least 3 % of the total value of the tender without VAT included.

More information on the requested bank guarantee is available in the tender documentation.

The signing of the contract with the selected most favourable tenderer shall be conditioned by the provision of guarantee by the selected most favourable tenderer for high quality execution of the contract to the level of 15 % of the contract value.
