2.2 Personal condition.

2.2.1 The Contracting organ will exclude from the procedure for awarding the public procurement agreement every economic operator:

— To whom during the last 5 years was sentenced effective sentence for participation in criminal organization, corruption, fraud or money laundering;

— To whom was sentenced ancillary sentence ban for participation in procedures for public calls, awarding of public procurement contracts and private public partnership contracts;

— To whom was sentenced ancillary sentence temporary or permanent ban for practicing certain activity;

— That is under bankruptcy procedure or liquidation;

— That has uncovered taxes, contributions or other public expenses, except if to the economic operator was approved delayed payment of the taxes, contributions or other public expenses pursuant the special ordinances and the same pays regularly;

— To whom was sentenced crime sanction — ban for practicing profession, activity or duty, that is, temporary ban for practicing certain activity and

— Who presents false data or does not submit data requested by the Contracting organ.

2.2.2. For vindication of the personal condition, the economic operator submits the following documents:

— Statement of the economic operator that during the last 5 years he was not sentenced effective sentence for participation in criminal organization, corruption, fraud or money laundering;

— Confirmation that there is no open bankruptcy procedure from the responsible organ;

— Confirmation that there is no open liquidation procedure from the responsible organ;

— Confirmation for paid taxes, contributions and other public expenses from responsible organ from the country where the economic operator is registered;

— Confirmation from the Register of sentences for criminal actions of legal persons, that he is not sentenced ancillary sentence…

… ban for participation in procedures for public calls, awarding contracts for public procurement and PPP Contracts;

… temporary or permanent ban for executing certain activity;

— Confirmation that with effective sentence he is not sentenced crime sanction — ban for practicing profession, activity or duty, that is, temporary ban for practicing certain activity.

2.2.3 The statement from line 1 sub-point 2.2.2 is prepared and signed by the economic operator and it is not obligatory to be certified from responsible organ.

2.2.4 The confirmations for not being opened bankruptcy procedure and liquidation procedure, as well as, the confirmations from the register of sentences for criminal acts from lines 5 and 6 of sub-point 2.2.2 are issued by the responsible organs in the country where the economic operator is registered. In the Republic of Macedonia, responsible organ for issuing these confirmations is the Central Register of the Republic of Macedonia.

2.2.5. The confirmation on paid taxes, contributions and other expenses is issued by the responsible organ in the country where the economic operator is registered. In the Republic of Macedonia, responsible organ for issuing of this confirmation is the Public Revenues Office.

2.2.6 The confirmation from line 7 of the sub-point 2.2.2 is issued by the responsible organ in the country where the economic operator is registered. In the Republic of Macedonia, responsible organ for issuing of this confirmation is the Central Register of the Republic of Macedonia.

2.2.7 The documents from sub-point 2.2.2 are not allowed to be older than 6 moths counted from the deadline for submission of the applications for participation backwards.

2.2.8 If the country in which is registered the economic operator does not issue the stated documents in the sub-point 2.2.2 or if they do not cover all of the previously stated cases, the economic operator can submit statement certified by the responsible organ.

2.3 Capability for practicing professional activity.

2.3.1 In order to confirm the capability for practicing professional activity, the economic operator should submit document for registered activity as evidence that is registered as physical or legal person for practicing the activity connected with the subject of the public procurement agreement or evidence that belongs to suitable professional association pursuant the regulations of the country where he is registered.

2.3.2 In case of group of economic operators, all of the members of the group separately vindicate the capability for practising professional activity.

Техничка и професионална способност:

2.4.2 The economic operator evidences the fulfilment of the minimum conditions from sub-point 2.4.1 with submission of:

1. Professional qualifications of the candidate or his expert personnel and especially the persons that are responsible for giving the concrete service such as:

a) ITIL certificate for at least 3 regular employees or persons engaged by the economic operator;

b) Technical certificates for offered server equipment for at least 2 full-time employees or persons engaged by the economic operator;

c) Technical certification service offered storage for at least 2 full-time employees or persons engaged by the economic operator;

d) Certificates for administering the database for at least 2 full-time employees or persons engaged by the candidate who within the past 5 years have worked on at least 2 projects. For individuals to list the projects on which they worked and their scope;

e) M1 / M2 form or contract commitment and CV for at least 2 engaged persons by the candidate with at least 5 years experience in managing IT projects. For employees to list the projects managed by each of them, the scope of them as used project methodology;

f) Certificates of expertise for at least 1 engaged person GIS expert for ESRI ArcSDE Administration or Geo-database Design Concepts.

2. Statement from the company that engaged staff will be constantly available for work on the project during the period of its implementation;

3. References or statement with a list of at least 3 deliveries of equipment and services in the last 3 years, including amounts, dates and procurers who has delivered equipment and services of a similar type and size as subject of procurement in the amount equal to or greater than 50 000 EUR for each of them;

4. A statement that the candidate will provide technical support, 5 x 10 for support for management with databases and 5 x 10 support for the offered equipment, contact centre for technical support, and the ability to report and monitor and resolve problems by the application number (ticketing system) where 5 x 10 means every day, 10 hours a day from 8:30 to 18:30 during the warranty period.

2.4.3 If economic operators submit Bid as Consortium, the technical and professional capability is evidenced by taking into consideration the resources of all of the members of the group, but 1 of the economic operators that will compose the Consortium it is necessary to fulfil 60 % of the technical and professional capability.

2.4.4 For Part 2, 3 and 4: In order to qualify as capable for execution of the stated public procurement agreement from aspect of its technical or professional capability, the economic operator does not need to fulfil the necessary conditions.

2.4.1 In order to qualify as capable for executing the subject public procurement agreement, from aspect of its technical or professional capability, the economic operator should fulfil the following minimum condition:

For part 1: In order to qualify as capable for executing the subject public procurement agreement, from aspect of its technical or professional capability, the economic operator should fulfil the following minimum condition: 1. Professional qualifications of the candidate or his expert personnel and especially of the persons that are responsible for giving the concrete service such as:

a) At least 3 engaged persons possessing ITIL certification;

b) At least 2 engaged technical persons with certificate for the offered server equipment;

c) At least 2 engaged technical persons with certificate for the offered equipment for data storage;

d) At least 2 engaged persons with certificates to administer the database that within the past 5 years have worked on at least 2 projects of similar scope. For individuals to list the projects on which they worked and their scope;

e) At least 2 engaged persons with at least 5 years experience in managing IT projects. For employees to list the projects managed, the volume of them as used project methodology;

f) The bidder should have at least 1 engaged person GIS expert with a certificate of ESRI System Design Strategies and ArcSDE Administration because of the migration of the existing system;

2. The engaged personnel shall be constantly at disposal for the work on the project at the period of its implementation.

3.The Economic operator should have at least 3 deliveries of equipment and services in the last 3 years, with the sums, dates and procurers to whom was delivered the equipment and services of a similar type and size as the object of purchase in the amount equal to or greater than 50 000 EUR each of them;

4. The applicant shall provide technical support, 5 x 10 for support of the management with databases and 5 x 10 for the offered equipment contact centre for technical support, and the ability to report and monitor and resolve problems upon application number (ticketing system) where 5 x 10 means every working day, 10 hours a day from 8:30 to 18:30 during the warranty period.

The contracting authority will perform the payment within 60 days, starting from the first day after the date of receipt of the invoice to the archive of the contracting authority. With the invoice shall be attached receipt of delivered goods signed and verified by full name by an authorized representative of the contractor and signed by an authorized person of the contracting authority.

Note: In the invoice must be stated the object of the agreement number and date.
