The service, subject of the procurement, shall include:
— Advices, opinions, analysis, (draft-texts, indication of positive and negative consequences) in reference with the procedure to award a contract for establishment of public private partnership for financing, designing,construction, management, maintenance and development of the distribution natural gas system in region 2 and region 3;
— Advices, opinions, analysis, (draft-texts, indication of positive and negative consequences) in reference with the preparation of the draft-contract for establishment of public private partnership for financing, designing,construction, management, maintenance and development of the distribution natural gas system in region 2 and region 3 of Macedonia.
The procurement does not refer to procurement of legal assistance (attorney related services).

Documents proving the technical or professional capability:
— list of same or similar services (preparation of documentation, that is, participation in projects related to the establishment of public private partnership and concessions) performed in the last 3 years, by submitting a confirmation for successful realisation of the services, including the value, time and location for realisation of services, and statements whether the services were realised in accordance with the rules on business operations and if the same were duly performed, and if such confirmations cannot be secured due to reasons beyond the control of the economic operator, by submission of their statement for performed services.

— The economic operator shall include a person in their team for realisation of the service in subject, who shall meet the following qualifications:
— completed faculty of law,
— active knowledge of English language,
— at least 20 years of working experience, of which at least 10 years in the field of establishment of a model for public private partnership and concessions,
— international experience on projects related to transactions pertaining to public private partnership and concessions, Preparation of draft contracts related to public-private partnerships and concessions for projects that are implemented projects under way Experience in implementing the competitive dialogue procedure,

— experience in terms of negotiating financial constructions for financing of infrastructure projects, of which minimum 1 (one) successfully realised project for financing of infrastructure projects through public private partnership and/or concessions.

In order to prove the educational and professional qualifications, that is, the meeting of the minimum criteria,the person shall submit a resume (CV) with appropriate reference list by indicating the project title he/she participated in, name of the ordering party, and his/her capacity of project participation. The indicated data shall be confirmed with personal signature in the resume. The contracting authority reserves the right to check the accuracy of the stated data.

The contracting authority shall be obliged to make the payment within 30 days as of the receipt of the realised service report, confirmed by the contracting authority with the necessary attachments by the service supplier.
Only the actual working hours shall be paid, and the same shall be confirmed with the realised service report confirmed by the head person of the contracting authority.
The service in subject is envisaged to be realised within 200 working hours, but no more than 300 working hours, within a period of 12 months, at the most.

The tender opening shall be public.
The tender opening shall be performed by the Public Procurement Commission in the Ministry of Transport and Communications, in presence of the authorised representatives of the tenderers.
The public opening of tenders shall be on the date and hour defined as deadline for submission of tenders in the premises of the Ministry of Transport and Communications.
The tenderers' representatives shall provide the Commission with a written authorisation from the tenderer for their participation at the public tender opening.
Authorised representatives of the tenderers can participate in the tender opening procedure by providing their comments, which are included in the minutes of the public tender opening.
Prior to opening the tenders, the Commission shall determine the number of received tenders, verify the authorisations of the authorised representatives, and determine the amendments, replacements or withdrawal of tenders, as well as their timely submission and prescribed correctness for tender submission.
