2.2.1 The contracting authority will exclude from the contract award procedure any economic operator:

— That in the last 5 years has had an effective sentence for participation in a criminal organization, corruption, fraud or money laundering;

— That was served with a minor penalty of prohibition for participation in public call procedures, public procurement contract awarding and agreements for public private partnership;

— That was served with a minor penalty of temporary or permanent prohibition of professional capacity;

— That is in bankruptcy or liquidation proceedings;

— that has unpaid taxes and other public charges, unless the economic operator has been granted deferred payment of taxes, contributions or other taxes in accordance with special regulations and pays them regularly;

— That was served with a misdemeanour sanction — ban on performing profession, activity or duty i.e. temporary prohibition on performing specific activity; and

— gives false information or does not submit the data requested by the contracting authority.

2.2.2 In order to prove its personal situation the economic operator submits the following documents:

— Statement by the economic operator that in the past 5 years they have not been issued with an effective sentence for participation in criminal organization, corruption, fraud or money laundering;

— Certificate that there is no ongoing bankruptcy proceedings;

— Certificate that there is no ongoing liquidation proceedings;

— Certificate for paid taxes, contributions or other public taxes from a competent body in the country where the economic operator is registered;

— Certificate issued by the Registry of Penalties for criminal acts of the legal entities…

… proving that they have not been issued with a minor penalty for prohibition of participation in public call procedures, public procurement contract awarding and agreements for public-private partnerships;

… that they have not been issued with a minor penalty for temporary or permanent prohibition for performance of certain activity;

— Certificate proving that there is no effective misdemeanour sanction — ban on performing profession, activity or duty i.e. temporary prohibition of performing specific activity.

2.2.3 The statement stipulated in indent 1 point 2.2.2 is prepared and executed by the economic operator and should not be notified by a competent body.

2.2.4 The certificates that there are no open proceedings for bankruptcy or liquidation, as well as the certificates issued by the Registry for penalties for criminal acts stipulated in indents 5 and 6 point 2.2.2 are issued by competent bodies in the country where the economic operator is registered. In Republic of Macedonia the competent body for issuance of these certificates is the Central Registry of Republic of Macedonia.

2.2.5 The certificate for paid taxes, contributions and other taxes is issued by a competent body where the economic operator is registered. In Republic of Macedonia the competent body for issuance of this certificate is the Public Revenue Office.

2.2.6 The certificate stipulated in indent 7 of point 2.2.2 is issued by the competent body in the country where the economic operator is registered. In Republic of Macedonia the competent body for issuance of this certificate is the Central Registry of Republic of Macedonia.

2.2.7 The documents stipulated in point 2.2.2 must not be older than 6 (six) months calculated backwards from the deadline for submission of bids.

2.2.8 If the country in which the economic operator is registered does not issue the documents stipulated in item 2.2.2 or if they do not cover all above-mentioned cases, the economic operator may submit a statement certified by a competent authority.

2.4 Economic and financial standing

2.4.1 In order to qualify as eligible for performance of the subject agreement for public procurement from aspect of economic and financial standing, the economic operator should fulfil at least the following minimal criteria:

— The economic operator should have positive financial standing for the last 3 years (2014, 2013, and 2012).

2.4.2 If the economic operator performs the activity for a period smaller than 3 years, a minimal condition for determination of the economic and financial standing is for the economic operator to have fulfilled the term stipulated in sub-item 2.4.1 in the years for which there is a valid data.

2.4.3 The economic operator will prove the fulfilment of the minimal condition stipulated in sub-item 2.4.1 by submitting the following document:

— excerpt of the overall profit of the company (Profit and loss account issued by a competent body i.e. revised Profit and Loss Account), and where appropriate, of the profit in the area that is covered with the Public Procurement Agreement for the last 3 financial years for which there is disposable information depending on the date when the company was established or started working and depending on the availability of the information or

— balance sheet certified by competent body i.e. revised balance sheet or excerpt of the balance sheet in cases when the publication of the balance sheet is stipulated by the law in the country where the economic operator is registered.

2.4.4 If the Balance Sheets and Profit and Loss Account were subject to commercial audit, the economic operator may submit these as evidence that they fulfil the minimum criteria for assessment of the economic and financial standing without additional certification by competent body.

2.4.5 If the Balance Sheets and Profit and Loss Accounts were not subject to commercial audit, the economic operator shall submit them after being certified i.e. issued by a competent body in order to prove that they fulfil the minimum condition for assessment of the economic and financial standing.

Competent body in the Republic of Macedonia is the Central Registry of Republic of Macedonia.

2.4.6 The economic and financial capacity of the economic operator can be supported by another subject, no matter the legal relations between the economic operator and the latter, except when referring to the data contained in the Profit and Loss Account. If the economic operator proves their economic and financial standing referring to the support of another subject, they are obliged to prove the support with valid evidence that this subject will put on their disposal the appropriate financial assets. There must not be valid judgment for participation in criminal organization, corruption, fraud or money laundering.

2.4.7 If economic operators submit a bid as a group of economic operators, the economic and financial standing is proved by taking into consideration the resources of all members of the group. If the group of economic operators has financial support from a third subject, the economic and financial standing is determined pursuant to the above-mentioned.

2.4.3 The economic operator will prove the fulfilment of the minimal condition stipulated in sub-item 2.4.1 by submitting the following document:

2.5.1 In order to qualify as capable of implementing the public procurement contract in terms of its technical and professional capability, the economic operator shall meet the following minimum requirements:

— It is necessary for the economic operator to have performed at least 3 services of this kind in the past 3 years (2014, 2013 and 2012);

— The economic operator should be a member of IATA Group (for the ongoing year);

— The economic operator should be connected to at least 1 global reservation system for air-plane tickets for the ongoing year;

— The economic operator should have at least 3 persons who will perform the subject of procurement out of each at least:

1. One person that will own a certificate/license for work with a global world reservation system for sale of air-plane tickets in the regular international traffic issued by authorized school centre or school centre of the air travel companies members of IATA.

2.5.2 In order to prove the technical or professional capacity of the terms stipulated in items 2.5.1 the economic operator should submit:

— Reference List of main services of the bidders or candidates performed in the past 3 years (2014, 2013 and 2012) with values, dates, buyers (contracting bodies and economic operators) by providing at least 3 certificates/agreements for services which are issued by the receivers or if these certificates/agreements cannot be provided due to reasons beyond the control of the economic operator, only with their statement for performed services;

— Certificate to serve as evidence that it is member of IATA Group (for the current year);

— Valid document that proves that the economic operator is connected to at least one global reservation system for air plane tickets for the ongoing year;

— Statement prepared by the economic operator that at disposal they have at least 3 persons at their disposal by submitting M1/M2 sheets (employment documents) and copy of a certificate/license of the person owning a certificate/license to work with global world reservation system for sale of air plane tickets in the regular international traffic issued by authorized school centre or school centre of the air travel companies members of IATA.
