Part IV: Technical specifications (specifics of the works): Project Program: Construction of mono-cable gondola lift for transport of persons with roundabout on Skopje-Vodno route and trial putting into use with the issuance of usage permit on Section 2: Institute for Respiratory Diseases in Children-Kozle-Sredno Vodno. 1. Introduction: Subject of the Call for Tenders herein is the construction of mono-cable gondola lift for transport of persons with roundabout on Skopje-Vodno route and trial putting into use with the issuance of usage permit on Section 2: Institute for Respiratory Diseases in Children-Kozle-Sredno Vodno. The basic purpose for the construction of the gondola lift arose from the strategic determination of the Government of the Republic of Macedonia for realization of higher level of overall functional integration of the country, development of the tourism — during the summer and winter period, as well as provisioning conditions for significantly larger infrastructure and economic integration with the neighbouring and other European countries. The construction of the gondola lift should be in accordance with the principles and standards for environmental protection, especially their preventive application and prevention of the negative influences of the production and service processes and technologies of the economic activities on the environment. With regards to the water management infrastructure, maximum consideration of the existing water resources and avoiding points of conflict between the planned points of the gondola lift and the existing water management facilities should be done in the course of the construction of this gondola lift. Also, the gondola lift route passes through the water flows of existing and periodical watercourses — gullies and torrents on Vodno Mountain. In the course of performing the construction works and in the course of functioning of the gondola lift, all necessary technical protective measures should be taken in order to prevent disturbance of the natural regime of the water flows, imbalance of the biodiversity in the watercourses and taking over appropriate measures for preventing the degradation of the water beds. With regards to the road infrastructure, in the course of construction of the gondola lift, the already constructed roads should be taken into consideration, as well as defining of the height of the facility with regards to the existing or planned other facilities and the vegetation. The region of Skopje and the Vodno Mountain is under the influence of the continental Mediterranean climate typified by large seasonal temperature differences, with severely cold and humid winters and hot and dry summers. The region is exposed to north-eastern and north winds, and in the summer period to local winds coming from the direction of Skopska Crna Gora. The air temperatures are identical as in the entire Skopje valley. Fogs appear approximately 50 days in the year and usually in the mornings. The total annual rainfall is approximately 504 mm and mostly occurs in November and May. In the course of construction of the gondola lift all of these weather factors should be taken into consideration, for the purpose of ensuring secure and safe transport of the passengers. 2. Subject (Main Goals): 2.1. General conditions for the tenderer: Subject of the Call for Tenders herein, ordered by the Ministry of Transport and Communications, is as follows: Construction of mono-cable gondola lift for transport of persons with roundabout on Skopje-Vodno route and trial putting into use with the issuance of usage permit on Section 2: Institute for Respiratory Diseases in Children-Kozle-Sredno Vodno. The submitted tenders by you should be of the ‘Turn-key’ type, which presents overall realization of the public procurement, i.e. obligation to: 1. Prepare, transport and install all planned parts of the gondola lift, in accordance with the approved basic project by the service orderer for Section 2, (specified in part 2.2 route description). 2. Trial putting into use with issuance of usage permit for the section. 2.2. Route description: The gondola lift route is described in 4 points as follows: 1. Final upper point Millennium Cross (Vodno Mountain top) on the elevation of H = 1 070 (m); 2. Point in between — Sredno Vodno on the elevation of H = 575 (m); 3. Point in between — Institute for Respiratory Diseases in Children-Kozle on the elevation H = 278 (m); 4. Final lower point — parking lot at St John The Baptist Church, Karpos Municipality on the elevation of H = 256 (m). It starts from the point — parking lot of St John The Baptist Church, Karpos Municipality and ends at the point — Millennium Cross (Vodno Mountain top). It consists of 3 sections as follows: — Section 1: Millennium Cross (Vodno Mountain top) — Sredno Vodno; — Section 2: Sredno Vodno — Institute for Respiratory Diseases in Children-Kozle; and — Section 3: Institute for Respiratory Diseases in Children-Kozle — parking lot of St John The Baptist Church, Karpos Municipality. With 2 points of horizontal refractions as follows: At the point Institute for Respiratory Diseases in Children-Kozle and at the point Sredno Vodno. It is planned each of these sections to be independently operated, synchronized, provide independent work of both sections separately and jointly as well. The operational station of Section 3 will be located at the starting point of this Section i.e. the parking lot of St John The Baptist Church, Karpos Municipality. The operational station for Section 1 is already located and functional on Sredno Vodno. The following points are planned as entry/exit stations for the passengers: — Parking lot of St John The Baptist Church, Karpos Municipality; — Institute for Respiratory Diseases in Children-Kozle; — Sredno Vodno; — Millennium Cross (Vodno Mountain top). 2.3. Explanation: The starting point of Section 2, i.e. the final point of Section 3, i.e. the point — Institute for Respiratory Diseases in Children-Kozle is planned to be the station for entry/exit of passengers with possibility for connection to Section 3. Thus, uninterrupted travelling of the passengers will be enabled from the starting point at the parking lot of St John The Baptist Church, Karpos Municipality all the way to the final point of the entire gondola lift, i.e. the Millennium Cross (Vodno Mountain top) in both directions, with possibility for the passenger to get off the cabin, i.e. get on the cabin on the station in between at the Institute for Respiratory Diseases in Children-Kozle and the station in between on Sredno Vodno. Note: Section 1: Sredno Vodno — Millennium Cross (Vodno Mountain top) is already constructed and functional as of 2011. The section, subject to construction according to the announcement herein i.e. Section 2: Institute for Respiratory Diseases in Children-Kozle-Sredno Vodno should be connected to the already constructed gondola lift and present technical and technological whole from the aspect of safety. a. Facilities of the gondola lift: 2.4. Existing facilities: — Garage hall, on the entry/exit station on Sredno Vodno is already constructed. The capacity of the garage hall is dimensioned and constructed in order to be able to accept the maximum number of cabins foreseen for the entire route. — The facilities (small houses) operating as ticket booths and control premises where the devices for automatic control of the gondola lift operation are placed, are already constructed on the entry/exit station on Sredno Vodno. — Transformer station for supplying the operational stations of Sections 1 and 2 with power is already placed in the vicinity of the entry/exit station in between on Sredno Vodno. — Entry/exit station on Millennium Cross. b. Basic conditions during the performance of the new installation in the facilities: The following is requested from the tenderer: — The overall equipment to be built in the Section 2 should refer to new and unused equipment in accordance with the prescribed regulations. — The access to the micro-locations is provided by the tenderer. — The construction part of the project should contain only the necessary construction elements for placement, construction and installation of the basic parts for the facility specified in the project task. The basic construction parts are defined as platform for the starting station, i.e. the station in between at the Institute for Respiratory Diseases in Children-Kozle, foundations of the pillars and the pillars themselves. The tenderer is required to give recommendation for construction and placement of auxiliary premises: command premise and ticket booth, or other auxiliary facilities. — Technical solution with regards to the final point of Section 2 and the starting point of Section 1, i.e. on Sredno Vodno where the platform and the turning point for placing the cabins in the garage is already placed, in case when there is no external power supply in the garage where the cabins are kept, and perform such work upon the approval thereof provided by the procuring entity. — To provide technical solution with regards to the final point of Section 2 and the starting point of Section 1, i.e. on the entry/exit station on Sredno Vodno, for access of the passengers getting on/off and perform such work upon approval thereof by the Procuring entity. — Check/analyse and give proposal for appropriate power supply of the second operational station of Section 2. — Place/install operational station for Section 2 on Sredno Vodno, by defining the connection between the 2 operational stations (Section 1 and Section 2), as well as the control and management system of both stations. — The access of the passengers to the station at the Institute for Respiratory Diseases in Children-Kozle should be solved in accordance with the field configuration. — Placement of rails with turning points for placing the cabins in the garage which shall be put into use from Section 2 should be planned in the garage hall. — Protection from erosion. — The cabins should have place for baggage (holders) for bicycles, ski holders or other equipment, as well as audio-radio equipment (for notifying the passengers). The cabins, subject to delivery, should be panoramic, made of high-quality materials, manufactured according to the latest technology and meeting the highest standards for protection when using thereof. The cabins should be suitable to, i.e. meet the technical requirements with the already exiting cabins with regards to the height between the centre of the rope and the floor of the cabin, the distance from the centre of the rope to the gravity point of the cabin, maximum size of the cabin, chains, with system for hooking the rope suitable to the existing 1. — The lighting in the cabins (during night rides) should be planned with solar panels installed in the cabin for charging the accumulators. — Power supply of the pillars. — Lighting placed on the pillars along the route of Section 1 and Section 2 for the purpose of marking them (on the top). — Rope control system with self-test of the regularity, possession of certificate for operating independently from the other security systems, i.e. the gondola lift to operate in case when the power switch system is not functional. — The braking system should contain: i. Service brake and emergency brake; ii. Electromagnetic service brake whose braking power can be continuously adjusted; iii. Hydraulic emergency brake. — Conduct training of 8-10 technicians for handling and maintenance of the gondola lift. c. Basic technical data for Section 2: — Horizontal length — 1 600,51 m; — Vertical difference — 297 m; — Slant length (between EB) — 1 632,96 m; — Average inclination of the rope — 37,96 %; — Transport capacity — 1 200 l/sec; — Rope speed — 6,0 m/s; — Number of cabins — 27; — Rope diameter — 48 mm; — Number of pillars — 10 pieces; — Route width — 5,2 m; — Motor-main drive power in case of uninterrupted operation — 294 kW; — Motor-main drive power in case of going — 392 kW; — Motor-auxiliary drive power — 49 kW. All parts of the gondola lift (Section 1, Section 2 and Section 3) are planned for traffic volume with maximum capacity of 1 200 transported persons per hour (person/hour). Maximum capacity of the cabins should be 8 persons with maximum movement speed of 6 (m/s). The gondola lift is planned to be used 24 a day, 12 months a year. Security criteria for quality of the special additional bridging management system of the gondola lift in case of defects and failure of the basic security systems. The tender should contain the complete display of all functions for turning off which are relevant in terms of safety for the functioning of the gondola lift. This bridging system is of great importance out of the following reasons: — Ensuring high-security level of gondola lift, especially in the earthquake prone regions, i.e. in case of falling of the integral parts of the gondola lift as well as the ones responsible for supervision (tightening device, supervision of the position, etc.). In case of operation under special circumstances, hence operation reserve measures or operation with reduced speed for backward transport (evacuation) as main operation, with possibility for more cases of defect, in order to avoid turning on the operation in case of emergency which requires a lot of time. Basic bridging requirements (transfer from 1 to another security system) of which the following should be met: 1) Supervision of the rope speed with regards to the motor speed; 2) Checking the motor real speed compared to the given speed; 3) Supervision in case of inactivity; 4) Control of leading the rope in the station area; 5) Supervision of the rope position; 6) Geometrical supervision of the ropes in the station circle and supervision of the turn on/off procedure; 7) Supervision of the vehicle distance on the road for entrance in the station; 8) Supervision of the vehicle distance on the critical places in the station; 9) Supervision of the tightening road; 10) Supervision of reducing the tightening pressure (release power); 11) Supervision of the actual release power; 12) Supervision of the tightening power in case of entry/exit; 13) Supervision of the spinning time (change of the spinning time); 14) Supervision of the power supply of the main operation facility; 15) Supervision of the power supply of the main operation facility (permanent power). In the course of performance of this security system, if all of the above mentioned relevant functions are not considered (e.g. checking the tightening power), i.e. the possibility to transfer every function as a particular transfer should function as summary transfer, then the security system will not be valued as realized. The access for landing of the passengers on the entry/exit platforms should be on the same level with the cabins, thus ensuring uninterrupted landing of (walk-in cabin) the cabins should have easy and safe access for disabled and older persons. The cabins should have safe entry in the station even if the rope is disconnected from the holder tower in front of the station. The entry roller of the station can be easily adjusted with the assistance of eccentric device. Each station should be equipped with separator in order to correct the faults to particular extent of the distance between the cabins. The speed of movement of the cabins on the entry/exit stations should be also adjusted for safe and uninterrupted landing of the passengers. It can be achieved with reduction of the speed of movement of the cabins to the level of crawling (with speed synchronization), or with full stopping of the cabin in the entry/exit stations. Connection of the tires of the acceptance system and transit of the cabins in the station should be made in the straight and crooked parts. The maintenance of the system for acceptance and transit of the cabins in the station should be done from the maintenance platform. The visual control of the system for acceptance and transit of the cabins in the station should be done throughout the operation without opening the cover. The transit from 1 to another section should be done with minimum quake for more comfortable travel of the passengers. Secure connection is required under any circumstances of the rope holding mechanism by installing a device in case of emergency on the station exit. Measuring of the connection power in the operational limits of the rope holding mechanism is required. 2.5. Construction: Construction of Section 2: It is planned Section 2 to be completely functional upon its completion and put into use independently from Section 3, whose construction is not subject of this public procurement. 2.6. Obligations of the tenderer: In the course of construction of Section 2, the tenderer is obliged to meet the highest standards and criteria arising from the domestic and European Legislation, as well as the latest technical-technological solutions from this area: The legal regulations the tenderer should comply with are as follows: — Directive 2000/9/EC of the European Parliament and the Council dated 20.3.2000 for rope way lines for the transport of persons; — Rulebook on launching rope way facilities intended for the transport of persons on the market (‘Official Gazette of the Republic of Macedonia’ number 59/07, 113/2011); — Law on rope ways and ski lifts for transport of passengers (‘Official Gazette of the Republic of Macedonia’ number 54/2000; 103/08, 23/2011, 53/2011, 163/2013 and 146/2015); — Law on Construction (‘Official Gazette of the Republic of Macedonia’ number 130/2009, 124/2010, 18/2011, 36/2011, 54/2011, 13/2012, 144/2012, 25/2013, 79/2013, 137/2013, 163/2013, 27/2014, 28/2014, 42/2014, 115/2014, 149/2014, 187/2014; 44/2015 and 129/2015. Resolution of the Constitutional Court of the Republic of Macedonia, Admin No 262/2009 dated 2.2.2011, published in the ‘Official Gazette of the Republic of Macedonia’ No 18/2011 and Admin No 212/2010 dated 30.3.2011, published in the ‘Official Gazette of the Republic of Macedonia’ No 49/2011.) — Appropriate national and European standards, technical norms, rulebooks on the particular elements (components and security devices) incorporated in the facility. The tenderer is strictly held responsible for the compliance with these directions, as well as the capability for improvement of the system management. 2.7. Mandatory elements of the tender: The tender should encompass the following activities: Construction of the construction part, as well as installation of the gondola lift with all accompanying facilities for Section 2, including the protection from erosion. Preparation and putting the gondola lift in trial exploitation with simultaneous examination thereof with trial burdening (the trial cargo is obligation of the tenderer). The tenderer is responsible for cleaning the construction site upon the completion of the construction activities. Cutting the rope after the 1 Throughout the guarantee period of 3 years, the economic operator should also perform inspection (of the electric and mechanical part) once in the year. 2.8. Methodology and operational plan: The tenderer should prepare proposal for methodology of performance of the works specified in the tender documentation. It is expected the tenderer, in the course of preparing the proposal, to have particular data and to fully understand the project program and the tender documentation. The proposals should be precise with sufficient details so that the party requesting the service can assess to which extent the tenderer has met the requirements and the level of quality and services being offer during the evaluation of the tender. Schemes, drawings and catalogues should be offered as well. The tenderer should prepare draft operational plan for performance of the works specified in the tender documentation. It is expected the tenderer, in the course of preparing the proposal, to have particular data and to fully understand the project program and the tender documentation. The proposal should contain details related to the preparatory phase, as well as all phases and particular activities for realization of the procurement/service. Schemes and drawings related to the offered technical solution subject of this public procurement can be enclosed to the tender of the tenderer as optional element, as well as catalogues of already constructed gondola lifts by the tenderer. Part V: Technical documentation, plans and technical description: For the purpose of providing assistance in the course of preparation of the tenders, the contracting body will have an insight in the project documentation as follows: 1. Basic project: — Construction phase: Technical number 02/2010 dated February 2010, prepared by ‘KARPOS’ factory — Joint Stock Company for design, manufacture and installation of pre-cast concrete, apartments, industrial facilities, bridges and transmission lines — Skopje; — Mechanical phase: Technical number 02/2010 dated February 2010, prepared by ‘KARPOS’ factory — Joint Stock Company for design, manufacture and installation of pre-cast concrete, apartments, industrial facilities, bridges and transmission lines — Skopje; — Electrical installation phase: Technical No 5-001/10 dated January 2009, from the Company for engineering, manufacture and operation DI DA Engineering DOO export — import Skopje. Method of Payment: 2.1. Payment shall be realised as follows: — Payment shall be through signed and verified interim certificates and/or through signed and verified final certificates by an authorized person of the Contractor and the Supervising Engineer, submitted to the contracting authority, following the actual executed work; and — Payment shall be by bank transfer within 30 days following the receipt of duly signed and verified interim certificates, or a signed and verified final certificate by an authorized person of the Contractor and the Supervising Engineer, submitted to the archive office of the contracting authority, according to the actual executed work. The payment of the undertaken liabilities shall be in accordance with the following dynamics: — In 2016 — 29 790 000,00 MKD, VAT included, at the most; — In 2017 — 119 190 000,00 MKD, VAT included, at the most; — In 2018 — 298 020 000,00 MKD, VAT included, at the most; 2.2. Time frame and Place of Realisation of the Works: The Contractor shall be obliged to execute the foreseen works within 12 (twelve) calendar months. The time frame for realization of works shall commence on the date of provision of access to, and possession of, the site for the Contractor. The Contractor shall be provided with access to, and possession of, the site by the Supervising Entity. The contractor shall be obliged to execute the works on the location in village Sredno Vodno — Institute for Respiratory Diseases — Kozle, Skopje. Each tender that contains time frames and performance locations that differ from the ones set out in this item shall be considered as unacceptable and as such, shall be rejected by the Public Procurement Commission.

The statement referred to indent 1, sub-item 2.5.1 is prepared in an electronic form and signed with an electronic signature by the economic operator, and the same should not be verified by a competent authority.
The confirmation referred to indent 2, sub-item 2.5.1, that there is no open bankruptcy procedure, and the confirmation referred to indent 3 of sub-item 2.5.1, that there is no open liquidation procedure, as well as the confirmations of the Registry of Penalties for Committed Criminal Acts referred to in indents 5 and 6 of sub-item 2.5.1, are issued by competent authorities in the country where the economic operator is registered. The Central Registry of the Republic of Macedonia is the competent authority for issuing such confirmations in the Republic of Macedonia.

The confirmation referred to in indent 4, sub-item 2.5.1. for paid taxes, contributions and other public dues is issued by a competent authority in the country of registration of the economic operator. The Public Revenues Office is the competent authority in the Republic of Macedonia for issuing of this confirmation.

The confirmation referred to in indent 7, sub-item 2.5.1. is issued by the competent authority of the country where the economic operator is registered. The Central Registry of RM is the competent authority for issuing of this confirmation in the Republic of Macedonia.

The documents referred to in sub-item 2.5.1 must not be older than 6 (six) months counted backwards from the final deadline for submission of the tenders.
The documents proving the personal standing are submitted in original or a copy verified by the economic operator.
If the contracting authority has any doubts regarding the documents proving the personal standing of the economic operator, it can request information directly from the competent bodies that have issued the documents proving the personal standing.
If the country where the economic operator is registered does not issue the documents referred to in sub-item 2.5.1 or if the documents do not include all cases stipulated above, the economic operator shall be obliged to submit a Statement, verified with a competent authority, declaring that: there are no open bankruptcy procedures against it; there are no open liquidation procedures, that the economic operator has paid all taxes, contributions and other public dues to the state; that no 2

The Contracting Authority shall exclude from the procedure for awarding a public procurement contract, any economic operator that:
— Within the last 5 (five) years has had a legally effective judgment pronounced against it for participation in a criminal organization, corruption, fraud or money laundering;
— Is subject to a bankruptcy procedure or a liquidation procedure;
— Has unpaid taxes, contributions or other public dues;
— Has been pronounced with a 2

3. Quality System Standards:
For the purposes of qualifying as capable to perform the subject public procurement contract in terms of the quality system standards, the economic operator shall meet the relevant European or International Standards:
— ISO 9001 (Quality Management System) or equivalent;
— ISO 3834 (Quality requirements for the fusion welding of metallic materials) or equivalent.
4. Environmental Management Standards:
For the purposes of qualifying as capable to perform the subject public procurement contract in terms of the environmental management system standards, the economic operator shall meet the relevant European or International Standards: ISO 14001 (Environmental Management System) or equivalent.

As part of the tender, the respective economic operator shall obligatory provide tender guarantee amounting 3 % of the total value of the respective tender, VAT excluded.
Tender guarantees shall be in the form of a bank guarantee.
The tender guarantee should also be submitted in its original form in the procedures which are being implemented electronically. Copies shall not be accepted.
The bank guarantee shall be issued by a bank acceptable for the contracting authority, by using the Tender Guarantee Form, provided in Part II.5 of the tender documentation.
The contracting authority may invoke the tender guarantee, if the economic operator:
— Withdraws its tender prior the expiry of its validity;
— Fails to accept the correction of arithmetic errors by the commission;
— Fails to sign the public procurement contract pursuant to the requirements of the tender documentation and the submitted tender; or
— Fails to provide the guarantee for quality contract realisation.
The tender guarantee validity shall be at least 14 days as of the date of expiry of tender validity.
Each tender which shall fail to contain a tender guarantee or shall contain a tender guarantee which is not in-line with the requirements referred to in the tender documentation shall be rejected by the contracting authority as unacceptable.
In exceptional cases, the contracting authority may request the tenderers for continuation of the tender guarantee validity period.
The tender guarantee of the unsuccessful economic operators shall be returned within 7 days as of the date of the conclusion of the contract with the most advantageous economic operator.
The tender guarantee of the economic operator, whose tender was selected as the most advantageous 1, shall be returned to it after it signs the public procurement contract and submits a performance guarantee.
The tender guarantee shall be submitted to the archive of the Ministry of Transport and Communication by the date and hour set out as deadline for submission of tenders.

The requirement for signing the contract with the most advantageous economic operator is the provision of a performance guarantee for the contract in amount of 10 % of the public procurement contract value.

At the public opening of tenders, authorised representatives of economic operators must present an authorisation signed by the authorised person of the economic operator. All authorised representatives of the economic operators present at the public opening of tenders should sign an attendance list.

The tender opening shall be electronic, via the ESPP, and shall be public.
The public opening of tenders shall take place on 8.2.2016, at 10:00 in the Ministry of Transport and Communications.
All submitted tenders shall be opened in-line with the Law on Public Procurement, as follows: 1 at a time, by reading the name of each economic operator, followed by establishing whether the tenders have been submitted pursuant to item 6.9 of the tender documentation and whether all tenders have been signed electronically, followed by a reading of tenders respecting the same order of opening. The tenderers which shall fail to meet the requirements referred to in the tender documentation shall be excluded from the further procedure, that is, they shall not be invited to the electronic auction. Subject of the Call for Tenders herein is the construction of mono-cable gondola lift for transport of persons with roundabout on Skopje-Vodno route and trial putting into use with the issuance of usage permit on Section 2: Institute for Respiratory Diseases in Children-Kozle-Sredno Vodno.

The basic purpose for the construction of the gondola lift arose from the strategic determination of the Government of the Republic of Macedonia for realization of higher level of overall functional integration of the country, development of the tourism — during the summer and winter period, as well as provisioning conditions for significantly larger infrastructure and economic integration with the neighbouring and other European countries.

The construction of the gondola lift should be in accordance with the principles and standards for environmental protection, especially their preventive application and prevention of the negative influences of the production and service processes and technologies of the economic activities on the environment.

With regards to the water management infrastructure, maximum consideration of the existing water resources and avoiding points of conflict between the planned points of the gondola lift and the existing water management facilities should be done in the course of the construction of this gondola lift. Also, the gondola lift route passes through the water flows of existing and periodical watercourses — gullies and torrents on Vodno Mountain. In the course of performing the construction works and in the course of functioning of the gondola lift, all necessary technical protective measures should be taken in order to prevent disturbance of the natural regime of the water flows, imbalance of the biodiversity in the watercourses and taking over appropriate measures for preventing the degradation of the water beds.

With regards to the road infrastructure, in the course of construction of the gondola lift, the already constructed roads should be taken into consideration, as well as defining of the height of the facility with regards to the existing or planned other facilities and the vegetation.

The region of Skopje and the Vodno Mountain is under the influence of the continental Mediterranean climate typified by large seasonal temperature differences, with severely cold and humid winters and hot and dry summers. The region is exposed to north-eastern and north winds, and in the summer period to local winds coming from the direction of Skopska Crna Gora. The air temperatures are identical as in the entire Skopje valley. Fogs appear approximately 50 days in the year and usually in the mornings. The total annual rainfall is approximately 504 mm and mostly occurs in November and May. In the course of construction of the gondola lift all of these weather factors should be taken into consideration, for the purpose of ensuring secure and safe transport of the passengers.

2.1. General conditions for the tenderer:

The submitted tenders by you should be of the ‘Turn-key’ type, which presents overall realization of the public procurement, i.e. obligation to:
1. Prepare, transport and install all planned parts of the gondola lift, in accordance with the approved basic project by the service orderer for Section 2, (specified in part 2.2 route description).
2. Trial putting into use with issuance of usage permit for the section.
2.2. Route description:
The gondola lift route is described in 4 points as follows:
1. Final upper point Millennium Cross (Vodno Mountain top) on the elevation of H = 1 070 (m);
2. Point in between — Sredno Vodno on the elevation of H = 575 (m);
3. Point in between — Institute for Respiratory Diseases in Children-Kozle on the elevation H = 278 (m);
4. Final lower point — parking lot at St John The Baptist Church, Karpos Municipality on the elevation of H = 256 (m).
It starts from the point — parking lot of St John The Baptist Church, Karpos Municipality and ends at the point — Millennium Cross (Vodno Mountain top).
It consists of 3 sections as follows:
— Section 1: Millennium Cross (Vodno Mountain top) — Sredno Vodno;
— Section 2: Sredno Vodno — Institute for Respiratory Diseases in Children-Kozle; and
— Section 3: Institute for Respiratory Diseases in Children-Kozle — parking lot of St John The Baptist Church, Karpos Municipality.
With 2 points of horizontal refractions as follows: At the point Institute for Respiratory Diseases in Children-Kozle and at the point Sredno Vodno.
It is planned each of these sections to be independently operated, synchronized, provide independent work of both sections separately and jointly as well. The operational station of Section 3 will be located at the starting point of this Section i.e. the parking lot of St John The Baptist Church, Karpos Municipality. The operational station for Section 1 is already located and functional on Sredno Vodno.

The following points are planned as entry/exit stations for the passengers:

2.3. Explanation:
The starting point of Section 2, i.e. the final point of Section 3, i.e. the point — Institute for Respiratory Diseases in Children-Kozle is planned to be the station for entry/exit of passengers with possibility for connection to Section 3.
Thus, uninterrupted travelling of the passengers will be enabled from the starting point at the parking lot of St John The Baptist Church, Karpos Municipality all the way to the final point of the entire gondola lift, i.e. the Millennium Cross (Vodno Mountain top) in both directions, with possibility for the passenger to get off the cabin, i.e. get on the cabin on the station in between at the Institute for Respiratory Diseases in Children-Kozle and the station in between on Sredno Vodno.

Note: Section 1: Sredno Vodno — Millennium Cross (Vodno Mountain top) is already constructed and functional as of 2011. The section, subject to construction according to the announcement herein i.e. Section 2: Institute for Respiratory Diseases in Children-Kozle-Sredno Vodno should be connected to the already constructed gondola lift and present technical and technological whole from the aspect of safety.

2.4. Existing facilities:
— Garage hall, on the entry/exit station on Sredno Vodno is already constructed. The capacity of the garage hall is dimensioned and constructed in order to be able to accept the maximum number of cabins foreseen for the entire route.
— The facilities (small houses) operating as ticket booths and control premises where the devices for automatic control of the gondola lift operation are placed, are already constructed on the entry/exit station on Sredno Vodno.
— Transformer station for supplying the operational stations of Sections 1 and 2 with power is already placed in the vicinity of the entry/exit station in between on Sredno Vodno.
— Entry/exit station on Millennium Cross.
b. Basic conditions during the performance of the new installation in the facilities:
The following is requested from the tenderer:
— The overall equipment to be built in the Section 2 should refer to new and unused equipment in accordance with the prescribed regulations.
— The access to the micro-locations is provided by the tenderer.
— The construction part of the project should contain only the necessary construction elements for placement, construction and installation of the basic parts for the facility specified in the project task. The basic construction parts are defined as platform for the starting station, i.e. the station in between at the Institute for Respiratory Diseases in Children-Kozle, foundations of the pillars and the pillars themselves. The tenderer is required to give recommendation for construction and placement of auxiliary premises: command premise and ticket booth, or other auxiliary facilities.

— The cabins should have place for baggage (holders) for bicycles, ski holders or other equipment, as well as audio-radio equipment (for notifying the passengers). The cabins, subject to delivery, should be panoramic, made of high-quality materials, manufactured according to the latest technology and meeting the highest standards for protection when using thereof. The cabins should be suitable to, i.e. meet the technical requirements with the already exiting cabins with regards to the height between the centre of the rope and the floor of the cabin, the distance from the centre of the rope to the gravity point of the cabin, maximum size of the cabin, chains, with system for hooking the rope suitable to the existing 1.

— The lighting in the cabins (during night rides) should be planned with solar panels installed in the cabin for charging the accumulators.

All parts of the gondola lift (Section 1, Section 2 and Section 3) are planned for traffic volume with maximum capacity of 1 200 transported persons per hour (person/hour). Maximum capacity of the cabins should be 8 persons with maximum movement speed of 6 (m/s). The gondola lift is planned to be used 24 a day, 12 months a year.

Security criteria for quality of the special additional bridging management system of the gondola lift in case of defects and failure of the basic security systems.
The tender should contain the complete display of all functions for turning off which are relevant in terms of safety for the functioning of the gondola lift. This bridging system is of great importance out of the following reasons:
— Ensuring high-security level of gondola lift, especially in the earthquake prone regions, i.e. in case of falling of the integral parts of the gondola lift as well as the ones responsible for supervision (tightening device, supervision of the position, etc.). In case of operation under special circumstances, hence operation reserve measures or operation with reduced speed for backward transport (evacuation) as main operation, with possibility for more cases of defect, in order to avoid turning on the operation in case of emergency which requires a lot of time.

In the course of performance of this security system, if all of the above mentioned relevant functions are not considered (e.g. checking the tightening power), i.e. the possibility to transfer every function as a particular transfer should function as summary transfer, then the security system will not be valued as realized.

The access for landing of the passengers on the entry/exit platforms should be on the same level with the cabins, thus ensuring uninterrupted landing of (walk-in cabin) the cabins should have easy and safe access for disabled and older persons.
The cabins should have safe entry in the station even if the rope is disconnected from the holder tower in front of the station. The entry roller of the station can be easily adjusted with the assistance of eccentric device. Each station should be equipped with separator in order to correct the faults to particular extent of the distance between the cabins.

The speed of movement of the cabins on the entry/exit stations should be also adjusted for safe and uninterrupted landing of the passengers. It can be achieved with reduction of the speed of movement of the cabins to the level of crawling (with speed synchronization), or with full stopping of the cabin in the entry/exit stations. Connection of the tires of the acceptance system and transit of the cabins in the station should be made in the straight and crooked parts. The maintenance of the system for acceptance and transit of the cabins in the station should be done from the maintenance platform. The visual control of the system for acceptance and transit of the cabins in the station should be done throughout the operation without opening the cover.

The transit from 1 to another section should be done with minimum quake for more comfortable travel of the passengers. Secure connection is required under any circumstances of the rope holding mechanism by installing a device in case of emergency on the station exit. Measuring of the connection power in the operational limits of the rope holding mechanism is required.

2.5. Construction:
Construction of Section 2: It is planned Section 2 to be completely functional upon its completion and put into use independently from Section 3, whose construction is not subject of this public procurement.
2.6. Obligations of the tenderer:
In the course of construction of Section 2, the tenderer is obliged to meet the highest standards and criteria arising from the domestic and European Legislation, as well as the latest technical-technological solutions from this area:
The legal regulations the tenderer should comply with are as follows:
— Directive 2000/9/EC of the European Parliament and the Council dated 20.3.2000 for rope way lines for the transport of persons;
— Rulebook on launching rope way facilities intended for the transport of persons on the market (‘Official Gazette of the Republic of Macedonia’ number 59/07, 113/2011);
— Law on rope ways and ski lifts for transport of passengers (‘Official Gazette of the Republic of Macedonia’ number 54/2000; 103/08, 23/2011, 53/2011, 163/2013 and 146/2015);
— Law on Construction (‘Official Gazette of the Republic of Macedonia’ number 130/2009, 124/2010, 18/2011, 36/2011, 54/2011, 13/2012, 144/2012, 25/2013, 79/2013, 137/2013, 163/2013, 27/2014, 28/2014, 42/2014, 115/2014, 149/2014, 187/2014; 44/2015 and 129/2015. — Appropriate national and European standards, technical norms, rulebooks on the particular elements (components and security devices) incorporated in the facility.
The tenderer is strictly held responsible for the compliance with these directions, as well as the capability for improvement of the system management.
2.7. Mandatory elements of the tender:
The tender should encompass the following activities:
Construction of the construction part, as well as installation of the gondola lift with all accompanying facilities for Section 2, including the protection from erosion.
Preparation and putting the gondola lift in trial exploitation with simultaneous examination thereof with trial burdening (the trial cargo is obligation of the tenderer).
The tenderer is responsible for cleaning the construction site upon the completion of the construction activities.

Throughout the guarantee period of 3 years, the economic operator should also perform inspection (of the electric and mechanical part) once in the year.
2.8. Methodology and operational plan:
The tenderer should prepare proposal for methodology of performance of the works specified in the tender documentation. It is expected the tenderer, in the course of preparing the proposal, to have particular data and to fully understand the project program and the tender documentation. The proposals should be precise with sufficient details so that the party requesting the service can assess to which extent the tenderer has met the requirements and the level of quality and services being offer during the evaluation of the tender. Schemes, drawings and catalogues should be offered as well.

The tenderer should prepare draft operational plan for performance of the works specified in the tender documentation. It is expected the tenderer, in the course of preparing the proposal, to have particular data and to fully understand the project program and the tender documentation. The proposal should contain details related to the preparatory phase, as well as all phases and particular activities for realization of the procurement/service.

2. Method of Payment:
2.1. Payment shall be realised as follows:
— Payment shall be through signed and verified interim certificates and/or through signed and verified final certificates by an authorized person of the Contractor and the Supervising Engineer, submitted to the contracting authority, following the actual executed work; and

— Payment shall be by bank transfer within 30 days following the receipt of duly signed and verified interim certificates, or a signed and verified final certificate by an authorized person of the Contractor and the Supervising Engineer, submitted to the archive office of the contracting authority, according to the actual executed work.

The payment of the undertaken liabilities shall be in accordance with the following dynamics:
— In 2016 — 29 790 000,00 MKD, VAT included, at the most;
— In 2017 — 119 190 000,00 MKD, VAT included, at the most;
— In 2018 — 298 020 000,00 MKD, VAT included, at the most;
2.2. Time frame and Place of Realisation of the Works:
The Contractor shall be obliged to execute the foreseen works within 12 (twelve) calendar months. The time frame for realization of works shall commence on the date of provision of access to, and possession of, the site for the Contractor. The Contractor shall be provided with access to, and possession of, the site by the Supervising Entity.

The contractor shall be obliged to execute the works on the location in village Sredno Vodno — Institute for Respiratory Diseases — Kozle, Skopje.
Each tender that contains time frames and performance locations that differ from the ones set out in this item shall be considered as unacceptable and as such, shall be rejected by the Public Procurement Commission.

1. Any economic operator that has a legal interest to win the public procurement contract and that suffered or could have suffered damages related to potential breach of the provisions of the Law on Public Procurement, may seek legal protection against the decisions, actions or failure to undertake actions by the contracting authority in the contract award procedure, in accordance with the Law on Public Procurement. The right to an appeal in a procedure ending with an electronic auction shall be realised after the adoption of the decision for selection of the most advantageous tenderer or cancellation of a procedure.

2. The appeal shall be submitted within 8 days starting from the day of:
— Publication of the contract award notice with reference to the data, actions or failure to undertake actions related to the notice;
— Opening of the tenders in reference to the data, actions or failure to undertake actions related to the tender documentation, that is, the tender opening procedure;
— Expiry of the time frame for adoption of a decision for selection or cancellation of the procedure pursuant to Article 162 Paragraph 2 of the Public Procurement Law regarding the failure to make a decision for selection or cancellation of the procedure in the relevant time frame;

— Receiving of the decision for selection of the most advantageous tender or the decision for cancellation of the procedure; or
— Findings about irregularities in the management of the contract award procedure, within 1 year at the latest starting from the day of the termination of the implemented procedure.
3. The time frame to lodge an appeal regarding the determining of the tenderers' capability and the overall evaluation of the initial tenders shall be counted from the date of receipt of the decision deciding on the individual right from the contract award procedure following the electronic auction completion.

4. The economic operator that failed to lodge an appeal with respect to the provisions stipulated in sub-item 2, shall not have a right to an appeal in a later stage of the procedure for the same legal basis.
5. The appeal should contain the following elements:
— Data on the submitter of the appeal (name, surname, name of the economic operator, address of residence and registered address);
— Data on the representative or the proxy;
— Name and registered address of the contracting authority;
— Number and date of the contract award procedure and data on the contract notice;
— Number and date of the decision for selection of the most advantageous tender, cancellation of the procedure or other decisions of the contracting authority;
— Data on the actions or failure to undertake actions by the contracting authority;
— Description of the factual situation;
— Description and explanation of the irregularities;
— Proposed evidence;
— Appeal and/or claim for compensation of procedure costs; and
— Signature and seal of an authorised person.
6. The submitter of the appeal shall be obliged to submit a proof of payment of the fee for procedure implementation.
7. The submitter of the appeal whose registered address is not on the territory of the Republic of Macedonia shall be obliged to determine a proxy to receive writs.
8. The appeal shall be lodged with the State Appeals Commission. The appeal shall be submitted in person or by registered mail to both the contracting authority and the State Appeals Commission. The day when the appeal is sent by registered mail shall be deemed as the day when the appeal was submitted. In case the appeal is submitted in person, the contracting authority shall be obliged to issue a confirmation of the time of the receipt to the submitter.

9. In the procedure before the State Appeals Commission, the appellant shall, in addition to the administrative fee, be liable to pay a fee for implementing the procedure depending on the amount of the tender, as follows:
— Up to 20 000 EUR in MKD counter-value, a fee of 100 EUR in MKD counter-value;
— From 20 000 to 100 000 EUR in MKD counter-value, a fee of 200 EUR in MKD counter-value;
— From 100 000 to 200 000 EUR in MKD counter-value, a fee of 300 EUR in MKD counter-value; or
— Over 200 000 EUR in MKD counter-value, a fee of 400 EUR in MKD counter-value.
10. In case when there is no tender, the amount of the fee for procedure implementation shall be calculated on the basis of the estimated value of the Public Procurement Contract, and the State Appeals Commission shall inform the appellant about the amount of the fee and the deadline in which the appellant needs to submit proof for payment of the fee.

11. The procedure implementation fee shall be revenue of the Budget of the Republic of Macedonia.
