Statement by the economic operator that it has not been announced, in the last 5 years, effective court decision for participation in criminal organization, corruption, fraud or money laundering;

— Certificate that it is not subject to bankruptcy procedure issued by competent authority;

— Certificate that it is not subject to liquidation procedure issued by competent authority;

— Certificate for paid taxes, contributions and other public duties by the competent authority in the country where that economic operator is established;

— Certificate from the Register of penalties for committed criminal acts of legal entities that a minor penalty…

… ban on participation in procedures for public announcements, awarding of public procurement contracts and contracts for public private partnership has not been imposed;

… temporary or permanent ban on performing certain activity has not been imposed;

— Certificate that it has not been announced any sanctions for misdemeanor with an effective court decision, resulting in prohibition for pursuing professional activity or duty, i.e. in a temporary prohibition for performing professional activity;

— Document proving a registered business;

— License A for performing engineering design reviews according to Article 23 of the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14 and 44/15). (In case of tenderers bidding as a group of economic operators (Joint Venture), this condition shall apply to each of the companies (members) comprising the group (JV)).

Техничка и професионална способност:

— Completed review of minimum 2 designs (Detailed Designs) for construction or rehabilitation of motorway sections;

— Notification about the contract elements which the economic operator intends to subcontract to third parties;

Equipment:

The bidder should either possess or should have secured an access to the equipment — laboratories listed below, which must be fully equipped, and must demonstrate that, based on the known commitments, they shall be available during the realization of the proposed contract. For the equipment which is not in his ownership, the bidder shall submit valid evidence as per the article 154 of the Public Procurement Law that this equipment and capacities are at his availability throughout the duration of the Contract.

— Laboratory for Geotechnics;

— Laboratory for Concrete;

— Laboratory for Asphalt;

— Laboratory for Geodesy;

— Laboratory for Hydrotechnics;

Personnel:

A) Field: road alignment, engineering design, roadbed, asphalts, tunnels, equipment, and signalization:

Minimum 3 persons with high vocational education in the field of civil engineering and in the following areas:

— Minimum 1 person in the area of road alignment, engineering design, equipment, and signalization possessing License A for performing engineering design reviews in civil engineering, who has participated in at least 2 reviews of technical documentation for construction, reconstruction, or rehabilitation of state roads in the last 5 years;

— Minimum 1 person in the area of roadbeds and asphalts possessing License A for performing engineering design reviews in civil engineering, who has participated in at least 2 reviews of technical documentation for construction, reconstruction, or rehabilitation of state roads in the last 5 years;

— Minimum 1 person in the area of tunnels possessing License A for performing engineering design reviews in civil engineering, who has participated in at least 2 reviews of technical documentation for construction, reconstruction, or rehabilitation of state roads in the last 5 years.

B) Field: Geotechnics:

Minimum 3 persons with high vocational education in the field of civil engineering or geology and in the following areas:

— Minimum 1 person in the area of foundation engineering possessing License A for performing reviews of engineering designs in geotechnics, who has participated in at least 2 reviews of technical documentation concerning geomechanics or geotechnics prepared for state road designs in the last 5 years;

— Minimum 1 person in the area of engineering geology and rock mechanics possessing License A for performing reviews of engineering designs in geotechnics, who has participated in at least 2 reviews of technical documentation concerning geomechanics or geotechnics prepared for state road designs in the last 5 years;

— Minimum 1 person in the area of soil mechanics possessing License A for performing reviews of engineering designs, who has participated in at least 2 reviews of technical documentation concerning geomechanics or geotechnics prepared for state road designs in the last 5 years.

C) Field: Concrete works and structures:

— Minimum 1 person in the area of concrete and reinforced concrete technology possessing License A for performing engineering design reviews in civil engineering, who has participated in at least 2 reviews of technical documentation concerning structures (bridges, overpasses, underpasses, retaining walls, galleries) on state roads in the last 5 years;

— Minimum 1 person in the area of reinforced concrete…

… structures and prestressed concrete possessing License A for performing engineering design reviews in civil engineering, who has participated in at least 2 reviews of technical documentation concerning structures (bridges, overpasses, underpasses, retaining walls, galleries) on state roads in the last 5 years;

… bridges possessing License A for performing engineering design reviews in civil engineering, who has participated in at least 2 reviews of technical documentation concerning structures (bridges, overpasses, underpasses, retaining walls, galleries) on state roads in the last 5 years.

D) Hydrotechnics:

Minimum 2 persons with high vocational education in the field of civil engineering and in the following areas:

— Minimum 1 person in the area of river regulation, hydrology and hydraulics possessing License A for performing engineering design reviews in civil engineering, who has participated in at least 2 reviews of technical documentation concerning river regulation, hydrology, hydraulics, or hydrotechnical structures in the last 5 years;

— Minimum 1 person in the area of hydrotechnical structures possessing License A for performing engineering design reviews in civil engineering, who has participated in at least 2 reviews of technical documentation concerning river regulation, hydrology, hydraulics, or hydrotechnical structures in the last 5 years.

E) Environment:

Minimum 1 person with high vocational education in the field of civil engineering or environmental engineering possessing License A for performing engineering design reviews in civil engineering, and Certificate for passed expert exam for gaining the status of an Expert in Environmental Impact Assessment.

F) Geodesy:

2 persons with high vocational education in the field of geodesy possessing License A for performing reviews of engineering designs for geodesy, who have participated in reviews of at least 2 designs for state roads.

The economic operator shall prove that he meets the requirements for Technical and professional competence by furnishing the following:

— Testimonies about completed reviews issued by the clients and copies of issued review reports to be furnished as evidence of the performed review on minimum 2 engineering designs (Detailed Design) for construction or rehabilitation of motorway sections;

— Notification about the contract elements which the economic operator intends to subcontract to third parties.

— For Laboratory for Geotechnics — furnish a Statement about possessing a laboratory that is fully operational;

— For Laboratory for Concrete — furnish a Statement about possessing a laboratory that is fully operational;

— For Laboratory for Asphalt — furnish a Statement about possessing a laboratory that is fully operational;

— For Laboratory for Geodesy — furnish a Statement about possessing a laboratory that is fully operational;

— For Laboratory for Hydrotechnics — furnish a Statement about possessing a laboratory that is fully operational.

A) Field: Road alignment, engineering design, roadbed, asphalt, tunnels, equipment, signalization:

For the minimum 3 persons with high vocational education in civil engineering, the following documents should be furnished:

— Copies of Diplomas for completed education in civil engineering;

— Copies of M1/M2 employment forms or respective evidence of engagement according to Article 154 of the Public Procurement Law;

— Copies of Licenses issued by competent national authorities as per the Article 24 of the Construction Law (Official Gazette of RM no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14 and 44/15);

— Copies of issued review reports in which development the experts had participated, which must include minimum 2 reviews of technical documentation for construction, reconstruction or rehabilitation of state roads in the last 5 years.

For minimum 3 persons with high vocational education in civil engineering or geology, the following documents should be furnished:

— Copies of Diplomas for completed education in civil engineering or geology;

— Copies of issued review reports in which development the experts had participated, which must include minimum 2 reviews of technical documentation concerning geomechanics or geotechnics for state road designs in the last 5 years.

For minimum 3 persons with high vocational education in civil engineering, the following documents should be furnished:

— Copies of issued review reports in which development the experts had participated, which must include minimum 2 reviews of technical documentation concerning structures (bridges, overpasses, underpasses, galleries, retaining walls) for state road designs in the last 5 years.

For minimum 2 persons with high vocational education in civil engineering, the following documents should be furnished:

— Copies of issued review reports in which development the experts had participated, which must include minimum 2 reviews of technical documentation concerning river regulation, hydrology, hydraulics, or hydrotechnical structures in the last 5 years.

For minimum one person with high vocational education in civil engineering or environmental engineering, the following documents should be furnished:

— Copies of Diplomas for completed education in civil engineering or environmental engineering;

— Copy of Certificate for passed expert exam for gaining the status of an Expert in Environmental Impact Assessment according to the Law on Environment (Official Gazette of RM no. 53/05, 81/05, 24/07, 159/08, 83/09, 48/10, 124/10, 51/11, 123/12, 93/13, 187/13 and 42/14).

For 2 persons with high vocational education in geodesy, the following documents should be furnished:

— Copies of Diplomas for completed education in geodesy;

— Copies of issued review reports in which development the experts had participated, which must include minimum 2 state road designs.
