The service requesting party shall exclude from the public procurement contract proceedings any legal entity:

— Which has been issued a sentence for participation in criminal organization, corruption, fraud or money laundering in the past 5 years;

— Which has been given an supplementary sentence — ban from participation in public procurement proceedings participation, being selected in public procurement contracts and contracts for public — private partnership;

— Which has been given an infringement sanction — temporary or permanent ban from conducting a business

— Which is undergoing bankruptcy or closure procedures

— Which has unpaid taxes, contributions and other public debt, unless the legal entity has been allowed instalment payment of taxes, contributions or other public duties pursuant to the special regulations and makes regular payments of the dues;

— Which has been given an infringement sanction ban from conducting a profession, business or duty, i.e., a temporary ban from conducting a specific business; and

— Which gives out false information or does not deliver the information requested by the service requesting party.

To prove the ability to perform the professional obligation, the legal entity needs to submit a document for registered business as evidence that they have been registered as an individual or a company for performing the business which is the subject of the public procurement contract or evidence that they are member of a suitable professional association pursuant to the regulations of the country where they have been registered.

Економска и финансиска состојба:

In order to qualify as able to fulfil the public procurement contract at hand in terms of its economic and financial liquidity, the legal entity needs to provide evidence that they fulfil the following minimal criteria:

— Positive financial balance for each of the past 3 years.

Техничка и професионална способност:

In order to qualify as able to fulfil the public procurement contract at hand in terms of its technical and professional competency, the legal entity needs to fulfil the following minimal criteria:

Technical competency:

— An excavator;

— A platform vehicle up to 12 meters;

— An asphalt and concrete cutter;

— An earth and aggregate ramming vibrator;

— A power generator of minimum 3 kVA;

— A minimum of 2 transport vehicles (minimum load capacity of 1 ton);

— An instrument for measuring grounding.

Professional competency:

— Type B License for construction work;

— Certificate for completed training in safety and health at work;

— At least 1 Electrical engineer, B. Sc.;

— At least 5 employees with electrical engineering education degree;

— The tenderer need possess at least 3 certificates for successfully completed contracts that are the same or similar in type to the contract at hand in the past year.

2.5.2 The legal entity shall verify that it fulfils the minimal requirements under item 2.5.1 by submitting:

— the pertinent documents proving the ownership, i.e., the availability of the machinery — licenses, invoices, inventory lists, etc. (if the requested documents are not in Macedonian, the legal entity is obliged to provide an official translation verified by a notary public);

— the pertinent document verifying the Type B contractor license;

— the pertinent documents to verify the possession of attended training in the area of Health and Safety at Work issued by a relevant body;

— M1 and M2 forms;

— Confirmations for successfully completed contracts that are the same or similar in type, issued by the entities for whom they were realized with net worth and realization dates in the previous year.
