The subject of the public procurement contract of works shall be the Construction of main pipeline Section Block Station 5 — Negotino with GMRS Shtip and GMRS Negotino.
The subject of the contract is inseparable. In the bid, the bidder should include all constituents. Otherwise the bid shall be considered unacceptable. The subject of the auction shall be the total price including all fees and discounts and import duties with VAT excluded.
Detailed description of the public procurement contract and the required quantities is given in the technical specifications and bill of quantities that are an integral part of the tender documentation.

In the procedure for awarding a public procurement contract cannot participate natural or legal persons who are subject or to which restrictive measures are applied, introduced by legally binding resolutions of the Security Council of the United Nations on the basis of Chapter VII of the UN Charter, the legal acts of the European Union, introduced by the US government, from the member states of the European Union including the United Kingdom of Great Britain and Northern Ireland, the Swiss State Secretariat for Economic Affairs and the Ministry of Finance of Japan, as well as other relevant governmental or regulatory authorities, institutions or agencies in charge of implementing economic or financial sanctions, pursuant to the Law on Debt of the Republic of Macedonia with Deutsche Bank and Erste Bank under the Loan Contract for financing the project ‘Gasification of the Republic of Macedonia — Phase 1 — Section Shtip — Negotino — Bitola and section Skopje — Tetovo — Gostivar’ (‘Official Gazette’ No 193/2015).

The contracting authority shall exclude from the proceedings for awarding a public procurement contract any economic operator:

— To which in the previous 5 (five) years has been imposed a legally valid court decision for participation in criminal organization, corruption, fraud or money laundering;

— Which is under a bankruptcy or liquidation procedure;

— Which has unpaid taxes and other public charges, unless the economic operator is authorized deferred payment of taxes, contributions and other public duties in accordance with relevant regulations which payment is regularly made;

— To which is imposed a secondary sentence prohibition on participation in open call procedures, awarding public procurement contracts and contracts for public-private partnership;

— To which is imposed a secondary sentence temporary or permanent prohibition on performing a certain activity;

— To which is being pronounced a misdemeanour sanction resulting in prohibition for practising profession, performing activity or duty, i.e. temporary prohibition for performing a particular activity; or

— Which provides false information or fails to submit the information required by the contracting authority.

To qualify as capable of executing the subject public procurement contract in terms of its economic and financial situation, the economic operator should meet the following minimum requirement:

— The economic operator must have achieved a minimum turnover of 32 000 000,00 EUR (thirty-two million) in the last 3 years cumulatively (2014, 2013 and 2012).

Извршување на договорот
Потребни депозити и гаранции:

— Bid Guarantee in the amount of 3 %;

— Quality Performance guarantee in the amount of 15 %, after signing of the contract.

No legal form shall be required from the group of economic operators if selected as winner.

Други посебни услови:

The economic operator should provide a document for registered business activity. Foreign economic operators should follow the relevant provisions of the Law on Public Procurement in order to meet this condition.

The Bidder should possess a license (A) for performing constructions of I category issued by the competent authority in the country under the Law on Construction (‘Official Gazette’ No 130/2009, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14 and 115/14, 149/14, 187/14, 44/15 and 129/15) or if the bidder is a foreign legal entity, it is obliged to observe the provisions of Article 42 of the Law on Construction, i.e. in the Republic of Macedonia, a foreign entity could perform operations of design, review, execution and supervision prescribed by this law, if it obtains a certificate for conducting the activities mentioned above by the state administration responsible for affairs related to spatial arrangement. To obtain the certificate, the legal entity of the state that is a member of the European Union must submit a request and evidence confirming that the it is registered for the relevant activity in the country in which is established and that a permit or license to perform relevant work for the type of building has been issued, which requires a certificate and a legal entity of a non-member of the European Union must submit a list of operations. If the state does not issue a permit or license, the foreign legal entity from a member state of the European Union is obliged to enclose proof by the competent authority in that State that under its regulations for carrying out such work permit or license could not be issued and evidence confirming that the entity is registered for the relevant activity in the country in which it is established, and the legal entity from a non-EU member, must submit a list of operations. Based on the evidence, the state administration responsible for affairs related to spatial arrangement will issue a certificate which works in accordance with this law, so that the foreign legal entity may perform in the country. A foreign natural person authorized by another state may conduct the design, review, execution and supervision of the construction in the Republic of Macedonia, if the authorization is confirmed by the Chamber of authorized architects and engineers.

Foreign natural person may perform the works in the previous paragraph as legal person registered in the EN Standard form 02 — Contract notice 7/17.
