2.2 Personal status

2.2.1 The contracting authority shall exclude any economic operator from the proceedings for awarding a public contract in the following cases:

— it has been rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— it has been sentenced with a minor penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership;

— it has been sentenced with a minor penalty for temporary or permanent prohibition to perform a specific activity;

— it is in bankruptcy or liquidation proceedings;

— it has unpaid taxes and other public charges, unless the economic operator is authorized to make deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and if he is regular payer;

— prohibition sanction to perform professional activity or duty is pronounced to the economic operator, i.e. temporary prohibition for performing professional activity; and

— it provides false information or fails to submit the information requested by the contracting authority.

2.2.2 In order to prove its personal condition, the economic operator shall submit the following documents:

— a declaration by the economic operator that he was not rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— confirmation that there are no bankruptcy proceedings undertaken by the competent authority;

— confirmation that there is no liquidation procedure undertaken by the competent authority;

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— certificate from the Registry of penalties for crimes committed by legal persons that minor penalty…

… — ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership — has not been imposed;

… for temporary or permanent prohibition of a specific activity has not been imposed;

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional.

2.3 Capability to perform professional activity

2.3.1 In order to demonstrate the capability to perform professional activity, the economic operator should submit a document for registered professional activity, as a proof for registration as a physical person or legal entity for performance of the activity related to the subject of the contract on public procurement or a proof of belonging to a related professional association in accordance with the regulations of the country of registration.

Pursuant to article 148 paragraph 2 of the Law on Public Procurements, upon determining the capability for performing professional activity of the economic operators, the contracting authority shall also request a proof issued by an authorized body for fulfilment of the special conditions for performing the activity which are prescribed by law and which refer to the subject of the contract, namely Constructor License A.

Економска и финансиска состојба:

2.4 Economic and financial status

2.4.1 In order to qualify as capable of performing the contract for procurement from the aspect of its economic and financial situation, the economic operator must meet the following minimum requirements:

— To have a minimum average total income of 120 000 000 MKD in each of the last 3 years.

— To have a positive financial result (income statement) in the last 3 years.

2.4.2 If the economic operator has performed the professional activity for a period of less than three years, a minimum requirement for establishing the economic and financial condition of the economic operator shall be that it has achieved the turnover of sub-item 2.4.1 in the years for which such data are available.

Минимално ниво(а) на стандарди:

2.4.3 The economic operator shall prove the fulfilment of the minimum requirements stipulated in item 2.4.1 or 2.4.2 by submitting the following:

— Balance sheet certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance-sheet is required under the law of the country where the economic operator is established.

— Extract on the total turnover of the company (data from the balance sheet issued by an authorized body, i.e. reviewed balance sheet) and if adequate, on the turnover in the scope that is covered by the contract on public procurements, for the last 3 financial years at the most, for which such information are available, depending on the accessibility of such information.

Техничка и професионална способност:

2.5 Technical or professional capability

2.5.1 In order to qualify as capable for performing the subject contract on public procurement in terms of its technical and professional capability, the economic operator must meet the following minimum conditions:

a) General experience:

(i). Time period of minimum 5 (five) years as constructor in construction activities;

b) Special constructing experience:

(i). required number of similar completed contracts: to have successful experience in participation on at least 2 (two) projects for first category of construction, such as big dams of similar nature and complexity, reconstruction or rehabilitation of motorways, roads or regional roads, tunnels, etc. of similar nature and complexity like the proposed contract, during the last 5 (five) years, with maximum value of 30 000 000 MKD each;

(ii). Each of the above mentioned projects in item b (i) should be with special construction experience through which the bidder should present the minimum experience in the following key activities: 50.000 m3 digging of ground, 5 000 m³ concrete activities, minimum 30 000 m³ graveling of ground materials.

c) Staff: The key staff for performance of the constructing activities should fulfil the following minimum requirements: (by specified objects)

(i) Head of operations: shall have at least 10 years of experience in construction activities and at least 7 years of experience in similar activities and to be in possession of a construction license A category in the field of construction engineering;

(ii) Assistant for ground operations: to have at least 7 years of experience in the field of construction and geo-technical activities and at least 5 years of experience in similar activities, and to have an A category permission for construction in the field of geo-technics and construction;

(iii) Assistant for concrete operations: should have at least 7 years of experience in construction activities and at least 5 years of experience in similar activities and to possess construction permission in the field of geodesy.

(iv) Surveyor: should have at least 7 years of experience in geodesy activities and at least 5 years of experience in similar activities and to possess construction permission in the field of geodesy.

d) Equipment:

The bidder should possess or should provide access to (by means of rent, leasing, procurement contract, etc.) the key equipment that is stated below, in full operation condition, and it should prove that on the base of the known engagements, the equipment shall be at disposal in the time of realization of the proposed contract. Also, the bidder should state its remaining equipment (transport vehicles, rollers, mixers etc.) that could be used for realization of the contract.

The bidder should possess or provide access to the following key equipment:

(v) Minimum 3 machines for digging and loading of ground with a basket capacity of not less than 2 m³;

(vi) Concrete base with realistic production capacity of not less than 20 m³/hour,

(vii) Vibro-rollers for compression of ground in accordance with the technical conditions.

Минимално ниво(а) на стандарди:

2.5.2. The economic operator proves the fulfilment of the minimum requirements set forth in item 2.5.1 by submitting the following:

— List of realized procurements of the same or similar kind in the last 5 years with description of the key activities (quantity of diggings of ground, quantity of concrete activities and quantity of gravelling ground materials) by submitting confirmation for satisfactory construction of the key works, including value, time, location of construction works, as well as statements if the works have been completed in accordance with the business operation and completion in accordance with the regulations. Copies of the contracts with the design measurements and calculation of works should be submitted as attached to the confirmations.

— Educational and professional qualifications of the economic operator, especially the persons in charge of the specific works (the required key personnel) by submitting adequate permissions for construction that are required for the proposed key personnel.

— Statement on the engaged technical personnel and technical bodies that shall participate in the realization of the works, no matter whether they belong to the economic operator, together with their education qualifications and professional engagements (CV), list of projects on which they have participated in the past 20 years.

— M1/M2 forms, registered with the respective body that mediates upon employment of the proposed personnel or contracts for engagement of external persons (for the key personnel).

— Statement on the technical equipment, description of the technical equipping and readiness of the economic operator with the key equipment, together with a proof for ownership, rent or leasing and a proof (statement, contract, agreement, consent) that such equipment and capacity are available to the economic operator during the duration of the contract.

— information on the elements of the contract that the economic operator intends to assign to sub-contractors.

2.5.3. The documents stated in item 2.5.2 shall be prepared and signed by the economic operator and does not have to be registered with the authorized body, except line 4 that could be submitted as a copy registered with its own stamp, that shall prove that the documents are true and original.

The technical and professional capacity of economic operators may be supported by another entity, regardless of the legal relations between the economic operator and the entity, except in the part of the reference list, previously concluded contracts and licenses. If the economic operator proves it's technical and professional capability referring to the support of another entity, it has to demonstrate the support with valid evidence that the entity will make available to the economic operator the technical and professional resources. The entity that provides technical and professional support should not be prosecuted by a verdict for participation in a criminal organization, corruption, fraud or money laundering.

If economic operators submit a bid as a group of economic operators, the technical and professional capacity shall be proved by taking into account the resources of all members of the group. If the group of economic operators participates with technical and professional support of a third entity or third parties, the technical and professional capacity shall be determined according to the above mentioned.

2.6 Standards for quality systems

2.6.1 In order to qualify as capable for performing the contract for public procurement in terms of standards for quality systems, the economic operator shall meet the following standards:

— Certificate ISO 9001

2.6.2 The economic operator shall prove the fulfilment of the standards set forth in sub-item 2.6.1 by submitting:

— Valid certificate ISO 9001

Standards for Environmental Management

2.7.1 In order to qualify as capable for performing the fulfilment of the contract for public procurement in terms of standards for environmental management, the economic operator shall meet the following standards:

— Certificate ISO 14001

2.7.2 The economic operator shall prove the fulfilment of the standards of subsection 2.7.1 by submitting:

— Valid certificate ISO 14001.
