In order to verify the personal state, the economic operator has to submit the following documents:

— a statement that no effective court decision has been passed against the economic operator in the course of the last 5 years for participating in a criminal organization, corruption, fraud and money-laundering;

— a certificate, issued by a competent authority, that no…

… bankruptcy proceeding are underway;

… liquidation procedure is underway;

— a certificate of paid taxes, contributions and other public charges, issued by the competent authority of the country where the economic operator is registered;

— a certificate from the Registry of penalties for committed crimes of legal persons that no secondary penalty…

… prohibition to participate in public call procedures, awarding public procurement contracts and public private partnership contracts has been passed against the economic operator;

… of temporary or permanent prohibition to perform individual activity has been passed against the economic operator;

— a certificate that no misdemeanor sanction has been passed against the economic operator- prohibition to perform profession, activity or other duty or temporary prohibition to perform certain activity;

In order to verify their capability to perform professional activity, the economic operator must submit a document for registered activity, as evidence that they are registered as natural or legal persons that perform the activity related to the subject of the public procurement contract or evidence that they belong to a certain professional association in accordance with the regulations of the country where the economic operator is registered.

Evidence issued by a competent authority for meeting the special requirements for performing the envisaged duties in accordance with the law related to the subject of the public procurement contract.

The economic operator along with the offer must submit a valid ‘A’ construction work license issued by a competent authority.

The following means of payment is intended — wire transfer within 60 days of the delivered invoice.

The invoicing shall be carried out aside from the reconstruction field work and shall take up the following course:

— not exceeding 35 % in the first 12 months of reconstruction,

— not exceeding 65 % in the second 12 months of reconstruction, and if necessary the rest of the invoicing shall be done in the third 12 months of reconstruction.

This means of payment is compulsory. Each offer then contains different means of payment then the one determined in this section, shall be considered unviable, and as such shall be rejected by rejected by the public procurement committee.

Every bidder with a legal interesting in obtaining a public procurement contract that has suffered or might suffer damage from a potential breach of the provisions of this law, may request legal remedy against the decisions, actions and inactions by the contacting authority in the procedure for awarding a public procurement contract, in accordance with the conditions and procedure envisaged in the Public Procurement Law. The right to an appeal in a procedure that ends with an electronic auction in terms of determining the capacity of the bidders and the full evaluation of the initial offers is carried out within 8 days once a decision is reached for selecting the most favourable bidder or annulling the procedure.
