2.2 Personal status

2.2.1 The contracting authority shall exclude any economic operator from the proceedings for awarding a public contract in the following cases:

— it has been rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— it has been sentenced with a minor penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership;

— it has been sentenced with a minor penalty for temporary or permanent prohibition to perform a specific activity;

— it is in bankruptcy or liquidation proceedings;

— it has unpaid taxes and other public charges, unless the economic operator is authorized to make deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and if he is regular payer;

— prohibition sanction to perform professional activity or duty is pronounced to the economic operator, i.e. temporary prohibition for performing professional activity; and

— it provides false information or fails to submit the information requested by the contracting authority.

2.2.2 In order to prove its personal status, the economic operator shall submit the following documents:

— A declaration by the economic operator that he was not rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— confirmation that there are no bankruptcy proceedings undertaken by the competent authority;

— confirmation that there is no liquidation procedure undertaken by the competent authority;

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— certificate from the Registry of penalties for crimes committed by legal persons that minor penalty…

… — ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership — has not been imposed;

… for temporary or permanent prohibition of a specific activity has not been imposed;

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional activity or duty, i.e. temporary prohibition for performing specific activity.

2.2.3 The statement in indent 1 of subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4 The confirmations that there are no bankruptcy proceedings and liquidation proceedings, as well as the certificates from the Register of penalties for criminal acts in indents 5 and 6 of subsection 2.2.2, shall be issued by competent authorities in the country in which the economic operator is established. In the Republic of Macedonia, the body responsible for issuing these certificates is the Central Registry of the Republic of Macedonia.

2.2.5 The receipt for paid taxes, contributions and other charges shall be issued by a competent authority of the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue such certificates is the Public Revenue Office.

2.2.6 The receipt in indent 7 of subsection 2.2.2 shall be issued by the competent authority in the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue this certificate is the Central Registry of the Republic of Macedonia.

2.2.7 The documents referred to in sub- item 2.2.2 must not be older than 6 (six) months from the deadline for submission of bids.

2.2.8 If the country in which the economic operator is registered does not issue the documents referred to in sub-item 2.2.2 or if they do not encompass all the cases mentioned above, the economic operator may submit a statement certified by a competent authority.

Техничка и професионална способност:

2.3 Capability to perform professional activity

2.3.1 In order to demonstrate the capability to perform professional activity, the economic operator should submit a document for registered professional activity, as a proof for registration as a physical person or legal entity for performance of the activity related to the subject of the contract on public procurement or a proof of belonging to a related professional association in accordance with the regulations of the country of registration.

2.4 Technical or professional capability

2.4.1 In order to qualify as capable for performing the contract for public procurement from the aspect of its technical and professional capability, the economic operator must meet the following minimum requirements:

— To have experience form previous relevant completed services that are successfully completed in the past 3 years;

— to have an engaged technical personnel for executing of the subject of the procurement,

— the garage should be equipped with a malfunction diagnostics device for the front and rear part of the vehicle, software for computerized diagnostics of malfunctions;

— to dispose with minimum 4 lifting devices in the garage and to dispose with a body shop and a painting chamber;

— to dispose with the necessary stock of spare parts in order to be able to execute the services that are subject to procurement in a maximum time period of 72 hour from the time of acceptance of the vehicle in the service centre (for the part for which it offers the bid).

Минимално ниво(а) на стандарди:

2.4.2 The economic operator shall prove the fulfilment of the minimum requirements stipulated in sub-item 2.5.1 by submitting:

— a list of main services performed by bidders or candidates, executed in the past 3 years, together with values, dates, buyers (contracting bodies or economic operators), by providing confirmations for on-time execution of deliveries that are going to be issued by the recipients, or, if such confirmations cannot be provided because of reasons that are out of control of the operator, its statement on the performed services;

— statement on the engaged personnel and technical bodies no matter if they directly belong to the economic operator for execution of the subject of the procurement;

— Written statement with description of the whole equipment and other advantages of economic operators with which he disposes of, for the auto-mechanical department, auto-electrical department, as well as a statement that it is in a possession of a body shop with a painting service;

— Statement that he disposes off with the required spare parts on stock so that it will be able to perform the services that area subject to this procurement within the maximum timeframe of 72 hours after the receipt of the vehicle in its service centre (for the part for which it submits the offer);

2.5.3.The above stated documents shall be prepared and signed by the economic operator and they should not be recorded by the authorized body, except the documents stated in indent 2,4 and 6 in subsection 2.5.2 that should be submitted in a copy that is recorded by the economic operator, with a stamp and signature of the responsible person, and a remark ‘true to the original’, as well as the document stated in indent 7 of sub-item 2.5.2 that shall be submitted as a copy that is recorded by the economic operator.

2.5.4. The technical and professional capacity of economic operators may be supported by another entity, regardless of the legal relations between the economic operator and the entity, except for the reference list, previously signed contracts and licenses. If the economic operator proves its technical and professional capability referring to the support of another entity, that entity is required to demonstrate that support with valid evidence that the entity will indeed make available the technical and professional resources to the economic operator. The entity that provides technical and professional support is not allowed to be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.5.5 If the economic operators submit a bid as a group of economic operators, their technical and professional capacity shall be proved by taking into account the resources of all members of the group. If the group of economic operators participates with technical and professional support of a third entity or third parties, the technical and professional capacity shall be determined according to the above mentioned.
