2.2 Personal status

2.2.1 The contracting authority shall exclude any economic operator from the procedure for awarding a public procurement contract in the following cases:

— effective verdict has been pronounced in the past 5 years for participation in criminal organization, corruption, fraud or money laundering;

— secondary penalty, ban on participation in open call procedures, on awarding of contracts for public procurement and contracts on public-private partnership has been pronounced;

— secondary penalty, temporary penalty or permanent ban on the performance of particular activity has been pronounced;

— bankruptcy or liquidation procedure has been initiated by a competent authority;

— has unpaid taxes, contributions and other public fees, unless the economic operator is authorized to make deferred payment of taxes, contributions and other public fees, in accordance with the special regulations and if he is regular payer;

— misdemeanour sanction — ban on the performance of the profession, activity or obligation, i.e. temporary ban on the performance of a particular activity has been pronounced with the effective verdict; and

— provides false information or fails to submit the information requested by the contracting authority.

2.2.2 In order to prove its personal status, the economic operator shall submit the following documents:

— statement of the economic operator stating that no effective verdict has been pronounced in the past 5 years for participation in criminal organization, corruption, fraud or money laundering;

— confirmation that no bankruptcy procedure has been initiated by a competent authority;

— confirmation that no liquidation procedure has been initiated by a competent authority;

— confirmation for paid taxes, contributions and other public fees from the authority competent in the country where the economic operator has been registered;

— confirmation from the Registry for penalties for committed criminal acts of the legal entities stating that no secondary penalty,…

… ban on participation in open call procedures, on awarding of contracts for public procurement and contracts on public-private partnership has been pronounced;

… temporary penalty or permanent ban on the performance of particular activity has been pronounced;

— confirmation stating that no misdemeanour sanction — ban on the performance of the profession, activity or obligation, i.e. temporary ban on the performance of a particular activity has been pronounced with the effective verdict.

2.2.3 The statement in indent 1 of sub-item 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4 The confirmations that there are no bankruptcy proceedings and liquidation proceedings, as well as the certificates from the Register of penalties for criminal acts in indents 5 and 6 of sub-item 2.2.2, shall be issued by competent authorities in the country in which the economic operator is registered. In the Republic of Macedonia, the competent authority to issue these certificates is the Central Registry of the Republic of Macedonia.

2.2.5 The receipt for paid taxes, contributions and other charges shall be issued by a competent authority of the country in which the economic operator is registered. In the Republic of Macedonia, the authority to issue such certificates is the Public Revenue Office.

2.2.6 The receipt in indent 7 of sub-item 2.2.2 shall be issued by the competent authority in the country in which the economic operator is established. In the Republic of Macedonia, the competent authority to issue this certificate is the Central Registry of the Republic of Macedonia.

2.2.7 The documents referred to in sub-item 2.2.2 must not be older than 6 (six) months from the deadline for submission of bids.

2.2.8 If the country in which the economic operator is registered does not issue the documents referred to in sub-item 2.2.2 or if they do not cover all the cases mentioned above, the economic operator may submit a statement verified by a competent authority.

Економска и финансиска состојба:

2.4 Economic and financial capability

2.4.1 In order to qualify as capable for performing the contract for public procurement from the aspect of its economic and financial status, the economic operator must meet the following minimum requirements:

— To have a minimum average annual turnover of 5 000 000 MKD within each of the last 3 years, in each year separately;

— To have a positive balance sheet (income statement) in the last 3 years.

2.4.2 If the economic operator carries on its business in a period of less than 3 years, a minimum requirement for establishing the economic and financial capacity shall be that the economic operator has achieved the turnover of sub-item 2.4.1 in the years for which data are available.

2.4.3 The economic operator shall prove the fulfilment of the minimum requirements stipulated in item 2.4.1 or 2.4.2 by submitting the following:

— Balance sheet certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance-sheet is required under the law of the country where the economic operator is registered;

— Statement of overall turnover of the company (data from the income statement issued by the competent authority, i.e. audited balance sheet) and, where appropriate, of turnover in the area covered by the contract for public procurement and the last financial year for which such data are available, depending on the date on which the company was founded or started to work and depending on the availability of such information.

2.4.4 If the balance sheet and income statement have been subject to commercial audit, the economic operator may submit them as a proof that it meets the minimum requirement for establishing the economic and financial situation without being further verified by the competent authority.

2.4.5 If the balance sheet and income statement have not been subject to commercial audit, the economic operator shall submit them as certified or issued by a competent authority to prove that it meets the minimum requirement for establishing the economic and financial capacity. The competent authority in the Republic of Macedonia is the Central Registry of the Republic of Macedonia.

2.4.6 Economic and financial capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and the subject, except in the case of data from the balance sheet. If the economic operator proves its economic and financial capability referring to the support of another entity, it is required to demonstrate that support with valid evidence that the entity will make available the financing to the economic operator. The entity that provides financial support must not be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.4.7 If economic operators submit a bid as a group of economic operators, the economic and financial capability is proved by taking into account the resources of all group members. If the group of economic operators started with financial support from a third entity, the economic and financial capability is determined according to the abovementioned.

Техничка и професионална способност:

2.3 Ability to perform professional activity

2.3.1 In order to prove the capacity to perform a professional activity, the economic operator needs to submit a document for registered professional activity as a proof for registration as a physical person or legal entity for performance of the activity related to the subject of the contract on public procurement or a proof of belonging to a related professional association in accordance with the regulations of the country of registration.

2.5 Technical or professional capability

2.5.1 In order to qualify as capable for performing the contract for public procurement from the aspect of its technical and professional capability, the economic operator must meet the following minimum criteria:

— to have experience form previous relevant and completed services that have been successfully realized in the past 3 years;

— to be authorized for servicing minimum 1 brand of vehicle that is owned by the contracting authority;

— to have engaged technical personnel for executing the subject of the procurement, i.e. minimum 6 employees in the garage and body shop;

— the garage should be equipped with a malfunction diagnostics device for the front and rear part of the vehicle, software for computerized diagnostics of malfunctions;

— to have at disposal minimum 5 lifting devices, of which 4 in the garage and 1 in the body shop, to have at disposal a painting chamber and two preparation zones, parking space for vehicles, secured space with 24 hours guard-service or video surveillance with an alarm.

— to have its own infrastructure with working space.

Минимално ниво(а) на стандарди:

2.5.2 The economic operator shall prove the fulfilment of the minimum requirements stipulated in sub-item 2.5.1 by submitting:

— a list of main services performed by bidders or candidates, executed in the past 3 years, together with values, dates, buyers (contracting bodies or economic operators), by providing confirmations for on-time execution of deliveries that are going to be issued by the recipients, or, if such confirmations can not be provided because of reasons not controlled by the operator, its statement on the performed services;

— written authorization for servicing minimum 1 vehicle make that is owned by the contracting authority, issued by the manufacturer of the vehicle or its general representative;

— statement on the engaged technical personnel and technical bodies, regardless of whether they directly belong to the economic operator for execution of the subject of the procurement;

— educational or professional qualifications of the economic operator or its professional staff, and especially the persons that are responsible for extending a specific service, by submitting copies of M1/M2 forms as proof for employed persons; and

— proof/statement with description of the total equipment and operating space conditions, as well as other advantages of the economic operator that are available for extending garage, body shop and paint finish services;

— proof (ownership right list) on the infrastructure, seat of the economic operator — the central location.

2.5.3.All the above stated documents shall be prepared and signed by the economic operator and they do not need to be verified by a competent authority, except the documents stated in indent 2,4 and 6 in sub-item 2.5.2 that should be submitted as a copy that verified by the economic operator, with a stamp and signature of the responsible person, and marked ‘true to the original’.

2.5.4. The technical and professional capacity of economic operators may be supported by another entity, regardless of the legal relations between the economic operator and the entity, except for the reference list, previously signed contracts and licenses. If the economic operator proves its technical and professional capability referring to the support of another entity, that entity is required to demonstrate said support with valid evidence that the entity will indeed make available the technical and professional resources to the economic operator. The entity that provides technical and professional support is not allowed to be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.5.5 If the economic operators submit a bid as a group of economic operators, their technical and professional capacity shall be proved by taking into account the resources of all members of the group. If the group of economic operators participates with technical and professional support of a third entity or third parties, the technical and professional capacity shall be determined according to the abovementioned.
