2.3. Ability to perform professional activity:

2.3. The economic operator should be registered as a physical or legal entity for conducting activities related to the subject of the contract for public procurement, or to belongs to a professional association in accordance with the regulations of the country in which it is registered.

In order to demonstrate the ability to perform professional activity, the economic operator should submit a document for registered activity, proving that it is registered as a physical or legal entity for conducting activities related to the subject of the contract for public procurement or proof that it belongs to a professional association in accordance with the regulations of the country in which it is registered.

2.2. Personal condition:

2.2.1 The contracting authority shall exclude any economic operator from the proceedings for awarding a public contract in the following cases:

— it has been rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— it has been sentenced with a minor penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership;

— it has been sentenced with a minor penalty for temporary or permanent prohibition to perform a specific activity;

— it is in bankruptcy or liquidation proceedings;

— it has unpaid taxes and other public charges, unless the economic operator is authorized to make deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and if he is regular payer;

— prohibition sanction to perform professional activity or duty is pronounced to the economic operator, i.e. temporary prohibition for performing professional activity; and

— it provides false information or fails to submit the information requested by the contracting authority.

2.2.2. In order to prove its personal condition, the economic operator shall submit the following documents:

— A declaration by the economic operator that he was not rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— confirmation that there are no bankruptcy proceedings undertaken by the competent authority;

— confirmation that there is no liquidation procedure undertaken by the competent authority;

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— certificate from the Registry of penalties for crimes committed by legal persons that minor penalty…

… — ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership — has not been imposed;

… for temporary or permanent prohibition of a specific activity has not been imposed;

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional activity or duty, i.e. temporary prohibition for performing specific activity.

2.2.3. The statement in indent 1 of subsection 2.2.2) shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4. The confirmations that there are no bankruptcy proceedings and liquidation proceedings, as well as the certificates from the Register of Penalties for Criminal Acts in indents 5 and 6 of subsection 2.2.2) shall be issued by competent authorities in the country in which the economic operator is established. In the Republic of Macedonia, the body responsible for issuing these certificates is the Central Registry of the Republic of Macedonia.

2.2.5. The receipt for paid taxes, contributions and other charges shall be issued by a competent authority of the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue such certificates is the Public Revenue Office.

2.2.6. The receipt in indent 7 of subsection 2.2.2) shall be issued by the competent authority in the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue this certificate is the Central Registry of the Republic of Macedonia.

2.2.7. The documents referred to in subitem 2.2.2) must not be older than 6 months from the deadline for submission of bids.

The Commission will accept documents for determining the personal status issued after the date of public opening of bids, but no later than the date of the decision for selecting the best offer.

2.2.8. If the country in which the economic operator is registered does not issue the documents referred to in subitem 2.2.2) or if they do not encompass all the cases mentioned above, the economic operator may submit a statement certified by a competent authority.

Техничка и професионална способност:

Technical or professional capability:

2.5.1. In order to qualify as capable for performing the subjected contract for procurement in terms of its technical or professional capability, the economic operator must meet the following minimum conditions:

For Part 1:

— Study for development of the hunting tourism in the Republic of Macedonia with an action plan for a period of 10 years,

— To have a vocational-professional staff in the field of forestry with at least 3 forestry engineers — Department of Forestry.

For Part 2:

— Preparation of project documentation for establishment of the Forestry Information System,

— To have a vocational-professional staff in the field of forestry and at least 5 forestry engineers — Department of Forestry.

2.5.2. The economic operator proves the fulfilment of the minimum requirements set forth in item 2.5.1) by submitting the following:

— Proof on their education and professional qualifications of the economic operator or its trained team and especially the persons in charge of extending the specific service, according to Article 153 Paragraph (2) Line (2) of the Law on Public Procurements and CVs of the requested staff;

— For Part 1 — vocational-professional staff in the field of forestry with at least 3 forestry engineers — Department of Forestry that have previously participated in preparation of studies in the stated field, and for Part 2 — vocational-professional staff in the field of forestry with at least 5 forestry engineers — Department of Forestry, who previously participated in preparation of projects in the stated field;

— Report on the elements of the contract that are going to be assigned to a sub-contractor by the economic operator.

2.5.3. The documents stated in Item 2.5.2) shall be prepared and signed by the economic operator and they should not be recorded by the authorized body.

2.5.4. The technical and professional capacity of economic operators may be supported by another entity, regardless of the legal relations between the economic operator and the entity, except for the reference list and the previously signed contracts. If the economic operator proves it's technical and professional capability referring to the support of another entity, that entity is required to demonstrate that support with valid evidence that the entity will indeed make available the technical and professional resources to the economic operator. The entity that provides technical and professional support is not allowed to be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.5.5. If the economic operators submit a bid as a group of economic operators, their technical and professional capacity shall be proved by taking into account the resources of all members of the group. If the group of economic operators participates with technical and professional support of a third entity or third parties, the technical and professional capacity shall be determined according to the above mentioned.
