2.2 Personal condition

2.2.1 The contracting authority shall exclude any economic operator from the proceedings for awarding a public contract in the following cases:

— it has been rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— it has been sentenced with a minor penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership;

— it has been sentenced with a minor penalty for temporary or permanent prohibition to perform a specific activity;

— it is in bankruptcy or liquidation proceedings;

— it has unpaid taxes and other public charges, unless the economic operator is authorized to make deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and if he is regular payer;

— prohibition sanction to perform professional activity or duty is pronounced to the economic operator, i.e. temporary prohibition for performing professional activity; and

— it provides false information or fails to submit the information requested by the contracting authority.

2.2.2 In order to prove its personal condition, the economic operator shall submit the following documents:

— A declaration by the economic operator that he was not rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— confirmation that there are no bankruptcy proceedings undertaken by the competent authority;

— confirmation that there is no liquidation procedure undertaken by the competent authority;

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— certificate from the Registry of penalties for crimes committed by legal persons that minor penalty…

… — ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership — has not been imposed;

… for temporary or permanent prohibition of a specific activity has not been imposed;

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional activity or duty, i.e. temporary prohibition for performing specific activity.

2.2.3 The statement in indent 1 of subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4 The confirmations that there are no bankruptcy proceedings and liquidation proceedings, as well as the certificates from the Register of penalties for criminal acts in indents 5 and 6 of subsection 2.2.2, shall be issued by competent authorities in the country in which the economic operator is established. In the Republic of Macedonia, the body responsible for issuing these certificates is the Central Registry of the Republic of Macedonia.

2.2.5 The receipt for paid taxes, contributions and other charges shall be issued by a competent authority of the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue such certificates is the Public Revenue Office.

2.2.6 The receipt in indent 7 of subsection 2.2.2 shall be issued by the competent authority in the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue this certificate is the Central Registry of the Republic of Macedonia.

2.2.7 The documents referred to in sub- item 2.2.2 must not be older than 6 months from the deadline for submission of bids.

2.2.8 If the country in which the economic operator is registered does not issue the documents referred to in sub-item 2.2.2 or if they do not encompass all the cases mentioned above, the economic operator may submit a statement certified by a competent authority.

2.3 Ability to perform professional activity.

2.3.1 In order to demonstrate the ability to perform professional activity, the economic operator should submit a document for registered activity, that it is registered as a natural or legal entity for conducting activities related to the subject of the contract for public procurement, or proof that it belongs to a professional association in accordance with the regulations of the country in which it is registered.

Pursuant to article 148 paragraph 2 of the Law on Public Procurements upon determining the ability of economic operators to perform their professional activity, the contracting body shall also request a proof issued by an authorized body that they fulfil the special conditions for performing of their activities that are prescribed by law, which refer to the subject of the contract, and in this specific case that is: License A for construction.

Економска и финансиска состојба:

2.4 Economic and financial condition.

2.4.1 In order to qualify as capable of performing the contract for procurement from the aspect of its economic and financial situation, the economic operator must meet the following minimum requirements:

— To 2.4.2 If the economic operator carries on the business in a period of less than three years, a minimum requirement for establishing the economic and financial condition of the economic operator shall be that it has achieved the turnover of sub-item 2.4.1 in the years for which data are available. Have a positive financial result (income statement) in the last 3 years.

Минимално ниво(а) на стандарди:

2.4.3 The economic operator shall prove the fulfilment of the minimum requirements stipulated in item 2.4.1 or 2.4.2 by submitting the following:

— Report on the balance sheet certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance-sheet is required under the law of the country where the economic operator is established.

2.4.4 If the balance sheets and income statements have been subject to commercial audit, the economic operator may submit them as a proof that it meets the minimum requirement for establishing the economic and financial situation without being further verified by the competent authority.

2.4.5 If the balance sheet and income statement have not been subject to commercial audit, the economic operator shall submit them as certified or issued by a competent authority to prove that it meets the minimum requirement for establishing the economic and financial situation. The competent authority in the Republic of Macedonia is the Central Registry of the Republic of Macedonia.

2.4.6 Economic and financial capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and the subject, except in the case of data from the income statement. If the economic operator proves its economic and financial capability referring to the support of another entity, it is required to demonstrate that support with valid evidence that the entity will make available the financing to the economic operator. The entity that provides financial support must not be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.4.7 If economic operators submit a bid as a group of economic operators, the economic and financial situation is proved by taking into account the resources of all group members. If the group of economic operators started with financial support from a third entity, the economic and financial situation is determined according to the above mentioned.

Техничка и професионална способност:

2.5 Technical or professional capability.

— to have completed at least 1 project of this or similar kind within the last 3 years.

The economic operator should have:

— at least 1 graduated civil engineer, regularly employed or external party engaged by a contract of service with a minimum of 5 years experience in the profession, who participated in the supervision of at least 1 (one) dam, with category A supervision authorization in the field of construction;

— at least 3 (graduated civil engineers regular employees or external persons engaged under a contract of which at least one has authorization A for supervision in the field of construction.

— at least 1 graduated civil engineer, regularly employed or external party engaged by a contract of service with a minimum of 5 years experience in the profession with A category authorization in the field of geotechnical engineering;

— at least 1 graduated engineer in geodesy, regularly employee or external party engaged by a contract of service with a minimum of 5 years experience in the profession with authorization of A category in the field of geodesy;

— at least 1 graduate mechanical engineer, regularly employed or external party engaged by a contract of service with a minimum of 5 years experience in the profession with authorization of A category in the field of mechanics;

— at least 1 graduate electrical engineer, regularly employed or external party engaged by a contract of service with a minimum of 5 years experience in the profession, with authorization of A category in the field of electrical engineering;

— at least 1 expert for assessment of the impact of the projects on the environment, regularly employed or external party engaged by a contract of service with a minimum of 5 years experience in the profession, with the authorization for supervision of A category in the field of environment;

— an accredited laboratory for testing of the construction materials (owned or hired by contract).

Минимално ниво(а) на стандарди:

2.5.2 The economic operator shall prove the fulfilment of the minimum requirements in subsection 2.5.1 by submitting the following:

A list of the main services of the tenderers or candidates in the last three years, with the values, dates, buyers (contracting authorities or economic operators) by providing certificates for services issued by the recipients or, if such certificates cannot be obtained because of the reasons beyond the control of the economic operator, only by its statement for completed services, as well as a copy of the contract for completed services.

— Statement with a list of proposed professional staff who will participate in the implementation of services with their educational qualifications and professional engagements (CV), with a list of projects in which they participated in the recent years, which are listed separately for each engineer in point 2.5.1, with:

— delivering evidence that it has employees or hired external persons for the proposed professional staff (M1 / M2 form, certified by the appropriate state institution that mediates in employment or contract for hiring an external person);

— appropriate supervisory powers required for the proposed key personnel, i.e. a copy of the A category of authorization for the supervision engineers, and a copy of the authorization for the supervision in the filed of the environment;

— description of the laboratory for testing of the construction materials with proof of ownership or evidence that it has such a laboratory, or that it has an agreement to use the services of the relevant accredited laboratory and a copy of the accreditation.

2.5.3 The documents referred to in point 2.5.2 shall be prepared and signed by the economic operator and it is not necessary to be certified by a competent authority, except the authorizations and certificates that are submitted as copies.

2.5.4. The technical and professional capacity of economic operators may be supported by another entity, regardless of the legal relations between the economic operator and the entity, except for the reference list, previously signed contracts and licenses. If the economic operator proves it's technical and professional capability referring to the support of another entity, that entity is required to demonstrate that support with valid evidence that the entity will indeed make available the technical and professional resources to the economic operator. The entity that provides technical and professional support is not allowed to be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.5.5 If the economic operators submit a bid as a group of economic operators, their technical and professional capacity shall be proved by taking into account the resources of all members of the group. If the group of economic operators participates with technical and professional support of a third entity or third parties, the technical and professional capacity shall be determined according to the above mentioned.

2.6 Quality Systems Standards.

— Certificate ISO 9001.

2.7 Environmental Management Standards.

— Certificate ISO 14001.
