The contracting authority shall exclude from the procedure for awarding a public contract any economic operator:

— Within the last 5 years it was announced effective court decision for participation in a criminal organization, corruption, fraud or money laundering;

— Which was announced a minor penalty ban on participation in public tender procedures, awarding contracts and contracts for public-private partnership;

— Which was announced a minor penalty for temporary or permanent prohibition of professional activity;

— Which is in bankruptcy or liquidation proceedings;

— Who has unpaid taxes, contributions and other public duties, unless the economic operator has been granted deferred payment of taxes, contributions or other taxes in accordance with special regulations and are regularly paid;

— Was pronounced a misdemeanor sanction prohibition to perform a profession, activity or duty, or prohibition to perform certain activity

— Who gives false information or fails to submit the information requested by the contracting authority.

To prove its personal situation, the economic operator shall submit the following documents:

— Statement by the economic operator that in the last 5 years has not been announced verdict for participation in criminal organization, corruption, fraud or money laundering;

— Confirmation that no bankruptcy procedure by the competent authority;

— Confirmation that no bankruptcy liquidation procedure by the competent authority;

— Confirmation of paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established or evidence of delayed payment of taxes, contributions or other taxes in accordance with special regulations and proof that they regularly paid;

— Certificate from the registry of penalties for committed crimes by legal persons that have been imposed minor penalty…

… ban on participation in public tender procedures, the award of public procurement contracts and public-private partnerships;

… for temporary or permanent prohibition of professional activity;

— Confirmation that the final sentence has been imposed sanction ban on performing profession, activity or duty, or prohibition to perform certain activity.

2.2.3 The statement from line 1 of subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4 confirmation that no bankruptcy procedure and liquidation procedure, and certificates from the Register of penalties for criminal acts in lines 5 and 6 of subsection 2.2.2, are issued by competent authorities in the country where the economic operator is registered. In Republic of Macedonia competent body for issuing such certificates is the Central Registry of the Republic of Macedonia.

The certificate for paid taxes and other charges issued by the competent authority in the country of registration of the economic operator. In Republic of Macedonia competent body for issuing such certificate is the Public Revenue Office.

The certificate from paragraph 7 of subsection 2.2.2 is issued by the competent authority in the country of registration of the economic operator. In Republic of Macedonia competent body for issuing such certificate is the Republic of Macedonia.

The documents in item 2.2.2 must not be older than six (6) months from the deadline for submitting the offers backwards.

If the country where the economic operator is registered does not issue the documents referred to in item 2.2.2 or if they do not include all the above mentioned cases, the economic operator may submit a statement verified by a competent authority.

Потребни депозити и гаранции:

Timely and quality execution of the agreement, the contractor guarantees by submitting an unconditional bank guarantee from a bank acceptable to the contracting authority.

The bank guarantee is 5 % of the contract value.

Главни услови за финансирање и аранжмани за плаќање и/или упатување на релевантните одредби што ги уредуваат:

Payment term of 60 (sixty) days from the date of receipt of the invoice in the archives of the purchaser. An integral part of the invoice receipt is signed by the authorized persons of the parties.

Invoice is submitted for each delivery.

Правна форма што треба да ја преземе групата економски оператори на која ќе се додели договорот:

Contracting Authority and Contractor agree any Contracting Party shall not be responsible towards the other for loss, damage or non-performance of the provisions of this Agreement caused by force majeure.

Force Majeure shall mean everything which is regulated by the Law on Obligations.

The Contracting Parties undertake in writing to notify the other party in case of entry of force majeure in effect and will agree new conditions for fulfillment or termination of the Agreement.
