The contracting authority shall exclude from the procedure for awarding a public contract any economic operator:

— Within the last 5 years to a final verdict for participation in criminal organization, corruption, fraud or money laundering;

— Has imposed a penalty on participation in public tender procedures, the award of public procurement contracts and public-private partnership;

— Has imposed a temporary or permanent prohibition of professional activity;

— Which is in bankruptcy or liquidation proceedings;

— Failed to pay taxes and other public charges, unless the economic operator has been granted deferred payment of taxes, contributions and other public duties in accordance with special regulations and pays them regularly;

— It has a misdemeanour sanction prohibition of professional activity or duty or prohibition to perform certain activity;

— Provides false information or fails to provide information requested by the contracting authority.

To prove its personal standing, the operator shall submit the following documents:

— A declaration by the economic operator that in the last 5 years he was rendered a verdict for participation in criminal organization, corruption, fraud or money laundering;

— Confirmation that no bankruptcy proceedings by a competent authority;

— Confirmation that no liquidation procedure by the competent authority;

— Confirmation of paid taxes and other public charges from the competent authority of the country where the economic operator is established or evidence of delayed payment of taxes, contributions and other public duties in accordance with special regulations and evidence that pays them regularly;

— Certificate from the Registry of penalties for crimes committed by legal entities that were not imposed a…

… penalty on participation in public tender procedures, the award of public procurement contracts and public-private partnerships;

… temporary or permanent prohibition of professional activity;

— A certificate stating that there has not been imposed sanction ban on performing profession, activity or duty, or prohibition to perform certain activity.

The statement from Line 1 of Subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

Confirm that no bankruptcy proceedings and liquidation proceedings, the certificate from the Registry of Penalties for Criminal Acts in Lines 5 and 6 of Subsection 2.2.2 shall be issued by the competent authorities in the country where it is registered. In the Republic of Macedonia competent body for issuing such certificates is the Central Registry of the Republic of Macedonia.

The confirmation of paid taxes and other public charges issued by the competent authority in the country is registered. In Macedonia, the body responsible for issuing this certificate is the Public Revenue Office.

The receipt of Item 7 of Subsection 2.2.2 issued by the competent authority in the country is registered. In Macedonia, the body responsible for issuing this certificate is the Republic of Macedonia.

The documents in Item 2.2.2 must not be older than six (6) months from the deadline for submission of bids.

If the country where the economic operator is registered does not issue the documents referred to in Subsection 2.2.2 or they do not cover all the above cases, the economic operator may submit a statement verified by a competent authority.

Потребни депозити и гаранции:

The economic operator to ensure quality goods, timely delivery and the quantity that delivers.

The quality of crude oil is guaranteed by certification of quality and Declaration of Conformity for each shipment separately.

Quantity of crude oil is guaranteed by the Declaration of Weight established through measuring instruments approved by the Bureau of Metrology.

Economic operator guarantees once delivery within 48 hours upon receipt of order in writing for oil and rapid delivery of gas stations.

In case of delay in execution and/or inappropriate delivered the accepted technical specifications by the economic operator, a contracting authority is entitled to damages and contractual penalty — penalties.

The contracting authority is entitled due to the damage of their choice to request:

— Free removal thereof,

— Proportional reduction in price,

— Terminating the contract and compensation for damages.
