2.1 Presenting Evidence of Ability

2.1.1 In addition to the offer, the Economic Operator is obliged to submit accompanying documentation to prove:

— their personal situation;

— their ability to perform professional activity;

— their economic and financial situation;

— their technical ability;

— the seriousness of the offer;

— the independence of the offer.

2.1.2 Required documentation is submitted in its original form or as a copy verified by the Economic Operator with a signature of the person in charge, with confirmation that it is an accurate translation of the original document.

2.1.3 When considering if the documentation is complete and valid in order to establish the ability of the Economic Operator, as well as when assessing the offer, the Commission is obliged to request from the tenderers to clarify or supplement the documents for establishing their ability within no less than 5 working days following the deadline for submitting the offers.

2.1.4 The Economic Operator submits the required explanation in written form within the timeframe determined by the contracting authority, which should not be less than five days, as of the day the request has been submitted by the tenderer.

2.1.5 No changes in the offer, except corrections of arithmetical errors, should be requested, offered or allowed by the Commission or the Economic Operator.

2.1.6 In case of a group of Economic Operators, all the members of the group individually prove their personal situation and abilities for performing professional activity.

2.2 Personal situation.

2.2.1 The contracting authority is obliged to exclude from participation in a contract awarding procedure those Economic Operators that:

— have been convicted by final judgment for participation in a criminal organization, for corruption, fraud or money-laundering in the past 5 years;

— have been given minor penalty prohibiting them to participate in proceedings concerning public calls for bids, awarding contracts for public procurement, as well as contracts for public private partnership;

— have been given temporary or permanent ban to perform a specific activity;

— are the subject of proceedings for a declaration of bankruptcy or liquidation;

— have failed to fulfil obligations relating to the payment of taxes, social security contributions and other public duties, unless the Economic Operator has been granted the right for delayed payment of taxes, social security contributions or other public duties in compliance with the special regulations and it performs those duties on a regular basis;

— have been issued sanctions — ban to perform their profession, activity or duty, i.e. temporary ban to perform a specific activity and

— submit false information or fail to submit information required by the contracting authority.

2.2.2 To prove their personal situation, Economic Operators submit the following documentation:

— statement by the Economic Operator that they have not been convicted by final judgment for participation in a criminal organization, corruption, fraud or money-laundering in the past 5 years;

— evidence that they are not subjects of proceedings for a declaration of…

… bankruptcy by a competent authority;

… liquidation by a competent authority;

— evidence that taxes, social security contributions and other public duties have been paid issued by a competent authority in the state where the Economic Operator has been registered;

— evidence issued by the Registry for penalties for committed crimes to legal entities that they have not been given minor penalty…

… prohibiting them to participate in proceedings concerning public calls for bids, awarding contracts for public procurement, as well as contracts for public private partnership;

… — permanent or temporary ban to perform their specific activity and

— evidence that they have not been issued a final judgment — ban to perform their profession, activity or duty, i.e. temporary ban to perform a specific activity.

2.2.3 The statement from line 1 item 2.2.2 is prepared in electronic form and signed with an electronic signature by the Economic Operator and it does not have to be verified by the competent authority.

2.2.4 Evidence that they are not subjects of proceedings for a declaration of bankruptcy and liquidation, as well as evidence from the Registry for penalties for committed crimes from line 5 and 6 and item 2.2.2 are issued by the competent authority in the state where the Economic Operator has been registered. In the Republic of Macedonia, the competent authority for issuing this evidence is the Central Registry of the Republic of Macedonia.

2.2.5 The evidence that taxes, revenues and other public duties have been paid is issued by a competent authority in the state where the Economic Operator has been registered. In the Republic of Macedonia, the competent authority for issuing this evidence is the Administration of Public Revenue.

2.2.6 The evidence referred to in line 7 item 2.2.2 is issued by the competent authority in the state where the Economic Operator has been registered. In the Republic of Macedonia the competent authority for issuing this evidence is the Central Registry of the Republic of Macedonia.

2.2.7 The documents referred to in item 2.2.2 should not be older than six months, starting from the last date for submitting the offers.

The Commission will accept documentation for determining the personal situation issued after the date of the public disclosure of the offers, but not later than the day of choosing the best offer.

2.2.8 If the state where the Economic Operator has been registered does not issue the documentation listed in item 2.2.2 or they do not cover all of the above mentioned cases, the Economic Operator may submit a statement verified by a competent authority.

2.3 Ability to perform professional activity.

2.3.1 In order to prove the ability to perform professional activities, the Economic Operator should submit documentation for its registered activity as proof that it has been registered as a physical or legal entity for performing the activity related to the subject of the agreement for public procurement or proof that it is part of a relevant professional association in compliance with the regulations of the state where it has been registered.

2.3.2 When establishing the ability of the Economic Operator to perform professional activity, the contracting authority requires evidence issued by the competent authority that the specific requirements for performing the activity are met in compliance with the regulations related to the subject of the procurement.

Економска и финансиска состојба:

2.4.1 In order to be eligible for performing the subject of the contract for public procurement in terms of its economic and financial situation, the economic operator should meet the following minimum requirements:

— have a minimum turnover of at least 100 000 000,00 MKD on average, per month, in the past 3 years (2012, 2013, 2014).

2.4.2 In case the economic operator has performed its activity for less than 3 years, the minimum requirement for establishing its economic and financial situation is for the economic operator to have achieved the turnover from item 2.4.1 in the years for which there is written record.

2.4.3 In order to prove that they meet the minimum requirements from item 2.4.1 or 2.4.2, the economic operators submit the following:

— relevant bank statement; or

— a balance sheet verified by a competent authority, i.e. a revised balance sheet or extracts from the balance sheet in cases when the publication of the balance sheet is prescribed by law in the state where the economic operator has been registered; or

— a balance sheet of the total turnover of the company (data from the balance sheet issued by a competent authority, i.e. a revised income statement) and where appropriate, of the turnover in the area which is covered by the contract for public procurement for the past three financial years for which there is such available data, depending on the date when the company was established or started work and depending on the availability of such data.

— relevant bank statement; or

2.5 Technical or professional ability (optional).

2.5.1 To be eligible for performing the subject of the contract for public procurement in terms of its technical or professional ability, the economic operator should meet the following minimum requirements:

— be in possession of License A for construction;

— to have at least 20 employees in the field/the subject of the procurement;

— to have 2 Architects with License A or License B;

— to have 2 Civil Engineers with License A or License B;

— to have 1 Electrical Engineer with License A or License B;

— to have 1 Mechanical Engineer with License A or License B;

— to have a minimum of 5 contracts for construction and craft works;

— to have completed at least 3 works of above 14 000 000,00 MKD in the past 3 years;

— to have machines — at least 3, at least 1 bulldozer, at least 2 pickhammers, at least 3 trucks, 2 compressors, at least 1 roller, at least 5 power aggregates;

— to have Insurance policy for the employees and damage caused by a third party.

2.5.2 The economic operator proves that it meets the minimum requirements from point 2.5.1 by submitting : ( unnecessary to delete. Details may be appropriately provided):

— a list of the major deliveries to bidders or candidates performed in the past 3 years including values, dates, buyers (contracting authorities or economic operators), certificates for deliveries issued by users or, if such certificates cannot be obtained for reasons that do not depend on the economic operator, a statement issued by the economic operator for deliveries that have been executed;

— A copy of License A for construction bearing verification that it is true to the original;

— a list of all employees issued by the Employment Agency of the Republic of Macedonia;

— Copy of the License for an Architect — 2;

— Copy of the License for a Civil Engineer — 2;

— Copy of the License for an Electrical Engineer — 2;

— Copy of the License for a Mechanical Engineer — 2;

— Copies of the contracts;

— Copy of the road books for at least 3 machines, at least 1 bulldozer, at least 2 pickhammers, at least 3 trucks, at least 2 compressors, at least 1 roller, at least 5 power aggregates.

A condition for signing the contract with the winning bidder is providing a guarantee by the most favourable bidder for performance of the contract in the amount of 5 %.

Every bidder with a legal interest in obtaining a public procurement contract that has suffered or might suffer damage from a potential breach of the provisions of this Law, may request legal remedy against the decisions, actions and inactions by the contacting authority in the procedure for awarding a public procurement contract, in accordance with the conditions and procedure envisaged in the Public Procurement Law. The right to an appeal in a procedure that ends with an electronic auction in terms of determining the capacity of the bidders and the full evaluation of the initial offers is carried out within 8 days once a decision is reached for selecting the most favourable bidder or annulling the procedure.
