2.2 Personal condition.

2.2.1 The contracting authority shall exclude any economic operator from the proceedings for awarding a public contract in the following cases:

— it has been rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— it has been sentenced with a minor penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership;

— it has been sentenced with a minor penalty for temporary or permanent prohibition to perform a specific activity;

— it is in bankruptcy or liquidation proceedings;

— it has unpaid taxes and other public charges, unless the economic operator is authorized to make deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and if he is regular payer;

— prohibition sanction to perform professional activity or duty is pronounced to the economic operator, i.e. temporary prohibition for performing professional activity; and

— it provides false information or fails to submit the information requested by the contracting authority.

2.2.2 In order to prove its personal condition, the economic operator shall submit the following documents:

— A declaration by the economic operator that he was not rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— confirmation that there are no bankruptcy proceedings undertaken by the competent authority;

— confirmation that there is no liquidation procedure undertaken by the competent authority;

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— certificate from the Registry of penalties for crimes committed by legal persons that minor penalty…

… — ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership — has not been imposed;

… for temporary or permanent prohibition of a specific activity has not been imposed;

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional activity or duty, i.e. temporary prohibition for performing specific activity.

2.2.3 The statement in indent 1 of subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority;

2.2.4 The confirmations that there are no bankruptcy proceedings and liquidation proceedings, as well as the certificates from the Register of penalties for criminal acts in indents 5 and 6 of subsection 2.2.2, shall be issued by competent authorities in the country in which the economic operator is established. In the Republic of Macedonia, the body responsible for issuing these certificates is the Central Registry of the Republic of Macedonia;

2.2.5 The receipt for paid taxes, contributions and other charges shall be issued by a competent authority of the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue such certificates is the Public Revenue Office;

2.2.6 The receipt in indent 7 of subsection 2.2.2 shall be issued by the competent authority in the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue this certificate is the Central Registry of the Republic of Macedonia;

2.2.7 The documents referred to in sub- item 2.2.2 must not be older than 6 months from the deadline for submission of bids;

2.2.8 If the country in which the economic operator is registered does not issue the documents referred to in sub-item 2.2.2 or if they do not encompass all the cases mentioned above, the economic operator may submit a statement certified by a competent authority;

2.3 Ability to perform professional activity;

2.3.1 In order to demonstrate the ability to perform professional activity, the economic operator should submit a document for registered activity, that it is registered as a natural or legal entity for conducting activities related to the subject of the contract for public procurement, or proof that it belongs to a professional association in accordance with the regulations of the country in which it is registered, i.e. a specific DRD form.

Pursuant to article 148 paragraph 2 of the Law on Public Procurements upon determining the ability of economic operators to perform their professional activity, the contracting body shall also request a proof issued by an authorized body that they fulfil the special conditions for performing of their activities that are prescribed by law, which refer to the subject of the contract, and in this specific case that is: License A for construction.

Економска и финансиска состојба:

— 2.4 Economic and financial condition;

— 2.4.1 In order to qualify as capable of performing the contract for procurement from the aspect of its economic and financial situation, the economic operator must meet the following minimum requirements:

— To have a positive financial result (income statement) in the last 3 years;

— To have a total turnover of at least 100 000 000 MKD in each of the last 3 years.

— 2.4.2 If the economic operator carries on the business in a period of less than 3 years, a minimum requirement for establishing the economic and financial condition of the economic operator shall be that it has achieved the turnover of sub-item 2.4.1 in the years for which data are available.

— 2.4.3 The economic operator shall prove the fulfilment of the minimum requirements stipulated in item 2.4.1 or 2.4.2 by submitting the following:

— Balance sheet certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance-sheet is required under the law of the country where the economic operator is established;

— Extract from the total turnover of the company (data from the income statement issued by an authorized body, i.e. audited income statement), and where applicable, of the turnover in the scope that is covered with the public procurement contract and at least for the last 3 financial years that are available information, depending on the date of establishment of the company or when the company started with the operation, as well as depending on the accessibility of such information;

2.4.4 If the balance sheets and income statements have been subject to commercial audit, the economic operator may submit them as a proof that it meets the minimum requirement for establishing the economic and financial situation without being further verified by the competent authority;

2.4.5 If the balance sheet and income statement have not been subject to commercial audit, the economic operator shall submit them as certified or issued by a competent authority to prove that it meets the minimum requirement for establishing the economic and financial situation. The competent authority in the Republic of Macedonia is the Central Registry of the Republic of Macedonia;

2.4.6 Economic and financial capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and the subject, except in the case of data from the income statement. If the economic operator proves its economic and financial capability referring to the support of another entity, it is required to demonstrate that support with valid evidence that the entity will make available the financing to the economic operator. The entity that provides financial support must not be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering;

2.4.7 If economic operators submit a bid as a group of economic operators, the economic and financial situation is proved by taking into account the resources of all group members. If the group of economic operators started with financial support from a third entity, the economic and financial situation is determined according to the above mentioned;

Техничка и професионална способност:

— 2.5 Technical or professional capability;

— 2.5.1 In order to qualify as capable for performing the subjected contract for procurement in terms of its technical or professional capability, the economic operator must meet the following minimum conditions:

— to have completed at least 1 project of this or similar kind within the last 5 years. Pipelines of similar size and material, drains, canals, etc. are considered as similar completed projects.

— to have a minimum of equipment, such as the following:

— at least 2 excavators with a capacity of at least 2.5 m

— at least 2 bulldozers with a capacity of at least 3.0 m

— at least 2 vehicles — trucks with a carrying capacity of not less than 20 tonnes;

— tampers for ground material;

— appropriate equipment for the assembly of steel tubes (crane, fuses for fixing of the pipes, welding equipment, machine protection after the performed welding and others.);

— equipment for control of the welding of the pipes;

— equipment for installation of PE pipes (apparatus for frontal welding of pipes or proper mounting);

— equipment for construction of concrete works (concrete mixers, formwork, reinforcing chair, etc.);

— The economic operator should have:

— Minimum 1 civil engineer with an authorization — A Performance, appointed as the head of the construction site;

— Minimum 2 certified welders.

Минимално ниво(а) на стандарди:

— 2.5.2 The economic operator shall prove the fulfilment of the minimum requirements in subsection 2.5.1 by submitting the following:

— List of works performed in the last 5 years, attaching a certificate of satisfactory execution of the most important works including confirmations, value, time and location of the construction works and references that the works were carried out in accordance with the rules of business as well as that the works are duly completed;

— Statement on the technical equipment that is available to the economic operator to perform specific works;

— Statement on the engaged technical staff and technical bodies regardless of whether they belong directly to the economic operator or are engaged on the base of a contract;

— Report on the elements of the contract which the economic operator intends to subcontract to third parties;

2.5.3 The documents referred to in point 2.5.2 shall be prepared and signed by the economic operator and they must be certified by a competent authority;

2.5.4. The technical and professional capacity of economic operators may be supported by another entity, regardless of the legal relations between the economic operator and the entity, except for the reference list, previously signed contracts and licenses. If the economic operator proves it's technical and professional capability referring to the support of another entity, that entity is required to demonstrate that support with valid evidence that the entity will indeed make available the technical and professional resources to the economic operator. The entity that provides technical and professional support is not allowed to be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering;

2.5.5 If the economic operators submit a bid as a group of economic operators, their technical and professional capacity shall be proved by taking into account the resources of all members of the group. If the group of economic operators participates with technical and professional support of a third entity or third parties, the technical and professional capacity shall be determined according to the above mentioned;

2.6 Quality Systems Standards;

2.6.1 In order to qualify as capable of performing the contract for public procurement in terms of standards for quality systems, the economic operator must meet the following standards:

— to posses the ISO standard quality system certificate or adequate proof of quality issued by the competent independent institutions;

2.6.2 The economic operator shall prove the fulfilment of the standards of subsection 2.6.1 by submitting:

— A valid certificate for the quality system ISO 9001/2008;

2.7 Environmental Management Standards;

2.7.1 In order to qualify as capable of performing the contract for public procurement in terms of standards for environmental management, the economic operator must meet the following standards:

— to posses the ISO standard for environmental management.

2.7.2 The economic operator proves the fulfilment of the standards of subsection 2.7.1 by submitting:

— a valid certificate ISO 14001/2004.
