The contracting authority reserves the right not later than 6 days before the deadline for submission of bids on its own initiative or on the basis of requests for clarification by the bidders to amend or supplement the tender documentation, and immediately inform all economic operators that have obtained the documentation. In the case of amendments to the tender documentation, the contracting authority shall extend the deadline for submission of bids for at least 6 days. In the case of a change and an amendment to the tender documents published on the ESPP and the extension of the deadline, the contracting authority is obliged to publish the amendment made by ESPP, after which all economic operators that have taken tender documentation by the time of the amendment will receive automatic electronic notification that an amendment to the specific listing has been published.

To prove its personal situation, the economic operator shall submit the following documents:

— Statement by the economic operator that in the last 5 years has not been announced verdict for participation in criminal organization, corruption, fraud or money laundering;

— Confirmation that there is no bankruptcy procedure by the competent authority;

— Confirmation that there is no bankruptcy liquidation procedure by the competent authority;

— Confirmation of paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— Certificate from the Registry of Penalties for Committed Crimes that the company has not been imposed minor penalty…

… ban on participation in public tender procedures, in the award of public procurement contracts and in public-private partnerships;

… for temporary or permanent prohibition of professional activity;

— Confirmation that with a final sentence it has not been imposed a sanction ban on performing profession, activity or duty or a prohibition to perform certain activity;

— Permission to perform work for insurance issued by the Agency for Supervision of Insurance of the Republic of Macedonia.

Економска и финансиска состојба:

To qualify as capable of performing the contract for public procurement in terms of its economic and financial situation, the economic operator must meet the following minimum requirements:

— Total revenue of at least 17 670 000 MKD for the last 3 financial years (Part 1);

— Total revenue of at least 5 330 000 MKD for the last 3 financial years (Part 2);

— Total turnover of at least 4 000 000 MKD for the last 3 financial years (Part 3).

If the economic operator operates in a period less than 3 years, a minimum requirement for determining the economic and financial condition is the economic operator to have achieved the requirement of subsection 2.4.1 for the year for which data exist.

Минимално ниво(а) на стандарди:

The economic operator proves the fulfilment of the minimum requirement stipulated in the item 2.4.1 or 2.4.2 by submitting:

— Balance sheets certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets, in case where publication of the balance sheet is required under the law of the country in which the economic operator is established (Part 1, Part 2 and Part 3);

— Statement of the total turnover (data from the income statement issued by a competent authority, i.e. audited income statement) and, where appropriate, of turnover in the area covered by the contract, and, for the last 3 financial years for which such data are available, depending on the date on which the company was founded or started work and depending on the availability of such information.

2.5. Technical and professional capability:

2.5.1. To qualify as capable of performing the contract for public procurement in terms of its technical or professional capability, the economic operator must meet the following minimum requirements:

— To be registered and to operate as EASA Part-145 Maintenance Organization registered according to Annex II (Part-145) of the EU Regulative No 2042/2003 or alternatively EU Regulative No 1321/2014 and to possess Authorization covering line and base maintenance of aircraft type Air Tractor AT-802A (Lot 1);

— To prove that it has registered access (online account) to the database of the manufacturer of aircraft Air Tractor AT-802A Fire Boss in regards to established and continuous engineering support and direct and unobstructed access to updated database of Technical maintenance manuals, Service Bulletins, Service Letters and Service Informative Letters for that type of aircraft (Lot 1);

— To be in possession of Certificate of validation issued by the Civil Aviation Agency of the Republic of Macedonia by which the Part-145 Maintenance Organization is authorized to maintain aircraft, engines and components of Z3-registered Air Tractor AT-802A Fire Boss (Lot 1);

— To possess warehouse inventory (stock) of (produced/approved by the manufacturer) spare parts for aircraft Air Tractor AT-802A Fire Boss which should ensure a unobstructed, successful and timely execution of the procurement (Lot 1 and Lot 3);

— To prove direct and fast access to the entity that is able to provide technical and professional support, spare parts accompanied by EASA Form 1 or FAA Form 8130 certificate for authorized release to service, as well as tools, consumables and aircraft equipment for…

… aircraft Air Tractor AT-802A Fire Boss for the need of successful and timely execution of the subject of procurement and follow-on warranty and AOG (Aircraft on Ground) obligations (Lot 1);

… turboprop-engine PT6A-67AG for the need of successful and timely execution of the subject of procurement and follow-on warranty and AOG (Aircraft on Ground) obligations (Lot 1);

… floats Wipline 10000 for the need of successful and timely execution of the subject of procurement and follow-on warranty and AOG (Aircraft on Ground) obligations (Lot 1);

— To possess ability to provide AOG (Aircraft on Ground) service with a rapid response team that on request of the client may within 24 hours to deploy on required location in order to provide assessment and repair and return in flying condition grounded aircraft Air Tractor AT-802A Fire Boss as soon as possible, normally taking into account the nature of the problem and/or damage which caused grounding of the aircraft and to appointed a special contact person that would handle any warranty and/or AOG needs on a 24/7 basis for a period of 12 months in order to ensure continuous operation and assistance (Lot 1);

— To employ or engage under contract highly qualified and experienced pilots of aircraft Air Tractor AT-802A Fire Boss with valid pilot licenses and medical certificates and significant experience in conducting long distance flights as well as in conducting test flights. Each pilot must have a minimum of 300 (three hundred) hours of flight time on aircraft Air Tractor AT-802A Fire Boss, to have performed at minimum ten (10) landings on at least four (4) different international airports and to have carried out at least two (2) long distance flights with aircraft Air Tractor AT-802A Fire Boss in a controlled international airspace over the past 3 years (Lot 1);

— Any employed or engaged under a contract pilot of the economic operator must have authorization from the Civil Aviation Agency of the Republic of Macedonia for conducting long distance flights in a controlled international airspace as well as for performing test flights in Z3-registered aircraft Air Tractor AT-802A Fire Boss (Lot 1);

— To possess or have a valid contract for at least 18 months from the date of submission of the tender with an Approved Training Organization (ATO) registered in accordance with the EU Regulation No 1178/2011 and which possess Approval and program for theoretical and practical pilot training and pilot proficiency check-on aircraft Air Tractor AT-802A Fire Boss (Lot 2);

— To possess or have agreement for lease or use by which it has regulated access to at least one (1) 2-seat aircraft Air Tractor AT-802 Fire Boss equipped with double commands (Lot 2);

— To employ or engage under contract at least one (1)…

… flight instructor (Class Rating Instructor — CRI) for Air Tractor AT-802A Fire Boss with a valid pilot license and medical certificate (Lot 2);

… JAR-FCL Part 1 flight examiner (Class Rating Examiner — CRE) for Air Tractor AT-802A Fire Boss with a valid pilot license and medical certificate (Lot 2).

Минимално ниво(а) на стандарди:

2.5.2. The economic operator proves the fulfilment of minimum conditions stipulated in article 2.5.1 by submitting:

— Certificate for EASA Part 145 maintenance organization registered in accordance with Annex II (Part-145) of EU Regulation No 2042/2003 or alternatively EU Regulation No 1321/2014 with Approval covering line and base maintenance of aircraft type Air Tractor AT-802A (Lot 1);

— A document proving that the Part-145 organization for technical maintenance has registered access (online account) to a database of the manufacturer of aircraft Air Tractor AT-802a Fire Boss in regards to established and continuous engineering support and direct and unobstructed access to updated database of Technical maintenance manuals, Service Bulletins, Service Letters and Service Informative Letters for that type of aircraft. Accepted as a proof will be document that is not older than 60 days and by which the manufacturer of the aircraft Air Tractor AT-802A Fire Boss confirms that the economic operator has registered and unobstructed access (online account) to its database. Alternatively, the economic operator may submit its own statement that it has registered and unobstructed access (online account) to the database of the manufacturer of aircraft Air Tractor AT-802A Fire Boss. In any case, the economic operator shall submit a picture (screen-shot) of the computer interface which shows the economic operator access to the database of the manufacturer realized no more than 60 days before the deadline for submission of tenders (Lot 1);

— Certificate of validation issued by the Civil Aviation Agency of the Republic of Macedonia under which the Part-145 maintenance organization of the economic operator is approved for maintenance of aircraft, engines and components of Z3-registered aircraft Air Tractor AT-802A Fire Boss (Lot 1);

— Statement that owns warehouse inventory (stock) of (produced/approved by the manufacturer) spare parts for aircraft Air Tractor AT-802A Fire Boss that will support unobstructed, successful and timely execution of the subject of the procurement. In addition, a material list of spare parts needed for execution of the procurement showing the currently available/reserved quantities at the date of tender submission (Lot 1 and Lot 3);

— Agreement by which the Part-145 Organization for technical maintenance will prove a direct and quick access to the manufacturer of…

… aircraft Air Tractor AT-802A Fire Boss or another appropriately registered entity in terms of providing technical and professional support, spare parts accompanied by EASA Form 1 or FAA Form 8130 certificate for authorized release to service, as well as tools, consumables and aircraft equipment for that type of aircraft. The contract should be valid for at least 18 months after the deadline for submission of the bids (Lot 1);

… the engine PT6-67AG or another appropriately registered entity in terms of providing technical and professional support, spare parts accompanied by EASA Form 1 or FAA Form 8130 certificate for authorized release to service, as well as tools, consumables and aircraft equipment for that type of aircraft. The contract should be valid for at least 18 months after the deadline for submission of the bids (Lot 1);

… the floats Wipline 10000 or another appropriately registered entity in terms of providing technical and professional support, spare parts accompanied by EASA Form 1 or FAA Form 8130 certificate for authorized release to service, as well as tools, consumables and aircraft equipment for that type of aircraft. The contract should be valid for at least 18 months after the deadline for submission of the bids (Lot 1);

— Statement that it has capability to provide AOG (Aircraft on Ground) service with a rapid response team that on client request within 24 hours deploy to required location so to provide assessment and repair and return to a flying condition grounded aircraft Air Tractor AT-802A Fire Boss as soon as possible, normally taking into account the nature of the problem and/or damage which caused the grounding of the aircraft and that it would appoint a special contact person that would handle any warranty and/or AOG needs of the contracting authority on a 24/7 basis for a period of 12 months in order to ensure continuous operation and assistance (Lot 1);

— Employment contracts or statement for hired highly qualified and experienced pilots of aircraft Air Tractor AT-802A Fire Boss supplemented with a valid pilot licenses, medical certificates and pilot log-books showing records of realized total flight time and flight time implemented over the past 3 years on aircraft type Air Tractor AT-802A Fire Boss (Lot 1);

— For each employed or engaged under a contract pilot separately valid authorization issued by the Agency for Civil Aviation of the Republic of Macedonia by which he is granted to conduct long distance flights in a controlled international airspace and to perform test flights in Z3-registered aircraft Air Tractor AT-802A Fire Boss (Lot 1);

— Certificate of Approved Training Organization (ATO) registered in accordance with the EU Regulation No 1178/2011 and which owns and Approval and a program for theoretical and practical pilot training and pilot proficiency check on aircraft Air Tractor AT-802A Fire Boss or a valid contract between the economic operator and the ATO that meets the mentioned criteria and which contract is valid for a minimum of 18 months after the deadline for bid submission (Lot 2);

— Ownership document or a valid agreement for lease or use by the economic operator by which it proves that owns or has unobstructed regulated access to at least one (1) 2-seat aircraft Air Tractor AT-802 Fire Boss equipped with dual controls. Agreement for lease or use must be in power for at least 18 months after the deadline for bid submission. Additionally, for each aircraft the economic operator must submit Registration Certificate and Airworthiness Certificate (Lot 2);

— Employment contract or statement for hiring minimum 2 experts: a minimum of one (1) flight instructor and at least one (1) JAR-FCL Part 1 flight examiner coupled with pilots' licenses for Air Tractor AT-802A Fire Boss and medical certificates of mentioned personnel (Lot 2).

A condition for signing the contract with the winning bidder is to provide a guarantee for quality performance amounting to 5 % of the contract value.
