The Contracting authority will eliminate from the procedure for awarding public procurement contract every economic operator:

— which in the last 5 years was pronounced a valid verdict for participation in criminal organization, corruption, fraud or money laundering;

— which was pronounced a secondary penalty prohibition for participation in procedures for public call, awarding public procurement contracts and public private partnership contracts;

— which was pronounced secondary penalty temporary or permanent prohibition for performing certain activity;

— which is in bankruptcy procedure or procedure or liquidation procedure;

— which has unpaid taxes, contributions or other public dues, unless the economic operator has been allowed deferred payment of the taxes, contributions or the other public dues in accordance with the special regulations and pays them regularly;

— which has been pronounced a misdemeanor sanction-prohibition for practising the profession, activity or duty, that is temporal prohibition for practising certain profession and

— which gives false data or is not submitting the data requested by the Contracting Authority.

— In order to prove the capacity for executing the professional activity, the Economic operator shall submit document for registered business activity as a proof that it is registered as natural or legal entity for practising the activity connected to the subject of the Public Procurement Contract or a proof that it belongs to an appropriate professional association pursuant to the regulations of the country in which it is registered.

— The Economic operator — Bidder should possess a license B for construction of objects of second category pursuant to the Construction Law (Official Gazette of the Republic of Macedonia No. 70/2013- Revised text and No. 79/2013, 137/2013, 163/2013, 27/2014, 28/2014, 42/2014, 115/2014, 149/2014, 187/2014, 44/2015, 129/2015, 217/2015, 226/2015, 30/2016, 31/2014, 39/2016, 71/2016 and 132/2016);

— If the Economic operator, Bidder in this announcement, is a foreign person, it should be registered for exercising respective business activity in the country (it should possess relevant license in the country of origin, equivalent to the license A or B in Republic of Macedonia), i.e. it should have obtained certificate for execution of the stated works from the state administration authority competent for the works in the field of landscaping. If it is selected as most favourable Bidder, before signing the contract for performance of this project, the foreign legal entity should, register a subsidiary, in the competent authority of the Republic of Macedonia, in accordance to the Companies Act. The engineer personnel should be employed in the subsidiary of the foreign legal entity, they should possess authorization for performance, and if they are citizens of another country it is necessary to make validation of their authorizations in the Chamber of Authorized Engineers and Architects of the Republic of Macedonia pursuant to article 42 of the Law on Construction (‘Official Gazette of the Republic of Macedonia’ 70/2013- Revised text and No. 79/2013, 137/2013, 163/2013, 27/2014, 28/2014, 42/2014, 115/2014, 149/2014, 187/2014, 44/2015, 129/2015, 217/2015, 226/2015, 30/2016, 31/2016, 39/2016, 71/2016 and 132/2016);

Економска и финансиска состојба:

— minimum realized income of at least 900 000 000,00 MKD in the last 3 financial years in aggregate (for 2013, for 2014 and for 2015).

Минимално ниво(а) на стандарди: As mentioned in the tender documentation.
Техничка и професионална способност:

— the economic operator- Bidder must have previous experience in performing contracts for execution in accordance with the subject of procurement which means it must have implemented at least 3 (three) contracts for executed Works in value higher than 36 000 000,00 MKD per contract.

— the Bidder shall have at least 150 people employed full-time.

— highly qualified personnel (educational and professional qualifications) who shall be engaged in and responsible for the implementation of the subject of the procurement, and who meet the following criteria:

At least 5 (five) employees holding B.Sc. in engineering (construction) with authorization B for execution engineer;

At least 3 (three) employees holding B.Sc. in engineering (architecture) with authorization B for execution engineer;

At least 1 (one) employee holding B.Sc. in engineering…

… (mechanical) with authorization B for execution engineer;

… (electrical), with authorization B for execution engineer;

At least 1 (one) surveyor,

At least 2 (two) certified welders,

— The Economic Operator- Bidder shall at least have or shall have provided access (by rent, leasing, purchase contract, or by other means) to the following key types of equipment which must be in perfect order and for which it shall provide evidence that they will be available for use within the frames of the specified contract. The Economic operator- Bidder may also specify alternative equipment which might be used at its proposal, along with a proposal explanation (5 (five)/Heavy Goods Vehicles, 7 (seven) trucks for transport with load capacity of more than 20 tons, 7 (seven) Excavation machines- Trench Excavator/Loader, 5 (five)/ Vibratory Rollers, 3 (three)/ Vibrating Tampers 1 (one)/ Paver and 1 (one) Grader)

Bids of Economic operators that don't meet the criteria for technical capability shall be rejected as unacceptable.

Standards for quality systems, environmental standards and health and safety management standards:

— ISO 9001

— ISO 14001

— OHSAS 18001.

Извршување на договорот
Потребни депозити и гаранции:

Bid guarantee.

As part of the Bid the Economic operator obligatory provides a Bid guarantee (guarantee for participation) in amount of 3 % (three) of the total value of the Bid without included VAT.

Good performance bond.

Precondition for signing the contract with the most favourable economic operator is the provision of a good performance bond for good quality and timely contract implementation by the main contractor for good quality and timely contract implementation in amount of 15 % of the contract value with VAT included.

Payment arrangements will be agreed monthly situation, presented by the contractor, verified by the Supervisor no lather then 180 days.
