Statement by the economic operator that it has not been announced, in the last 5 years, effective court decision for participation in criminal organization, corruption, fraud or money laundering.

— Certificate that it is not subject to bankruptcy procedure issued by competent authority.

— Certificate that it is not subject to liquidation procedure issued by competent authority.

— Certificate for paid taxes, contributions and other public duties by the competent authority in the country where that economic operator is established.

— Certificate from the Register of penalties for committed criminal acts of legal entities that a minor penalty…

… ban on participation in procedures for public announcements, awarding of public procurement contracts and contracts for public private partnership has not been imposed.

… temporary or permanent ban on performing certain activity has not been imposed.

— Certificate that it has not been announced any sanctions for misdemeanor with an effective court decision, resulting in prohibition for pursuing professional activity or duty, i.e. in a temporary prohibition for performing professional activity.

Document proving a registered business.

— License A for designing structures of first category as per the Construction Law in force (Official Gazette of Republic of Macedonia No 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15 and 217/15). (In case of tenderers bidding as a group of economic operators (Joint Venture), this condition shall apply to each of the companies (members) comprising the group (JV)).

Економска и финансиска состојба:

— Total revenues of 500 000 EUR, aggregate amount in the last 3 years (2013, 2014, and 2015).

The economic operator shall prove that he meets the requirements for Economic and financial status by furnishing the following:

— Copy of balance sheet report and data of 2013, 2014 and 2015 income statements, certified by a competent authority, i.e. audited balance sheets or abstracts of the report on balance sheets, where balance sheet publication is required under the law of the country where the economic operator is registered.

In cases of Foreign Tenderers: If balance sheet report and income statement were not issued for 2013, 2014, and 2015 and verified by a competent authority, the requirement is to furnish copies of auditors' reports of the Foreign Tenderer, which shall be positive and shall be issued by a reputable foreign institution registered to provide audit services. Auditor reports should contain data about the overall economic operation of the Foreign Tenderer (for the last 3 years).

Техничка и професионална способност:

— Minimum 1 (one) contract developed, audited and delivered design for construction or reconstruction or rehabilitation of minimum 5 km of state roads (motorways, expressways, national or regional roads) in the last 3 (three) years, with a minimum value of 8 500 000 MKD.

— Notification on contract items that the economic operator intends to subcontract to third parties.

Key personnel:

— Chief Design Engineer: Bachelor of Civil Engineering — BS CE possessing an Authorization A for developing civil engineering design documents, with at least 10 (ten) years of work experience as a design engineer, and 5 years of work experience as a road design engineer.

— Road Alignment Design Engineer: Bachelor of Civil Engineering — BS CE possessing an authorization A for developing civil engineering design documents, with at least 7 (seven) years of work experience as a design engineer, and 4 years of work experience as a road design engineer.

— Design Engineer of Structures (bridges, underpasses, overpasses, retaining walls and viaducts): Bachelor of Civil Engineering — BS CE possessing an authorization A for developing civil engineering design documents, with at least 7 (seven) years of work experience as a design engineer, and 4 (four) years as a design engineer of structures (bridges, underpasses, overpasses, retaining walls and viaducts).

— Design Engineer of Geotechnics: Bachelor of Engineering possessing an authorization A for developing design documents in geotechnics, with minimum 7 (seven) years of work experience in civil engineering and 4 (four) years as a Design Engineer on projects involving geotechnics.

— Geodetic Engineer possessing an Authorization in Geodesy with minimum 4 (four) years of work experience in civil engineering field.

— Electrical Engineer: Bachelor of Electrical Engineering possessing an authorization A for developing design documents in electrotechnics.

— Environment Protection Expert possessing a Diploma in the field of Environmental Engineering, Ecology, Engineering, technical-technological sciences, or other appropriate diploma in natural sciences related to the environment protection.

General experience: minimum 5 (five) years of work experience in the field of the protection and improvement of the environment and nature.

Specific experience:

(1) Certificate of passed professional exam for obtaining the status of an Expert in Environmental Impact Assessment of projects, issued by the Ministry of Environment and Physical Planning (MOEPP) of RM, and listed on the List of Experts in Environmental Impact Assessment of projects, kept by the MOEPP of RM;

(2) Copy of the List of Experts (only of the section where the expert's name is printed) kept by the MOEPP;

(3) At least one (1) developed and approved Environmental Impact Assessment (EIA) Study or Report for a project in the transport sector (construction, reconstruction or rehabilitation of state roads — motorways, expressways, national or regional roads, or of railways) in the last 5 years, on which the expert worked as an EIA Expert.

— Note: In case a foreign expert is proposed, either a confirmation/certificate from expert's home country shall be submitted, or a statement that this matter in his/her home country is regulated in a different manner. Also, for foreign physical and legal entities, provisions apply of the Construction Law (Official Gazette of RM No 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15 and 217/15) and of the Environment Protection Law (Official Gazette of RM No 53/2005, 81/2005, 24/2007, 159/2008, 83/2009, 48/2010, 124/2010, 51/2011, 123/2012, 93/13, and all its amendments and supplements).

Equipment:

— Adequate technical equipment with hardware and software required for development of the design documents in an electronic form.

— Geodetic instruments and equipment (appropriate equipment for surveying, double frequency GPS unit, 2 (two) total stations, off-road vehicle).

The economic operator shall prove that he meets the requirements of Technical and professional competence by submitting the following:

— Copy of the Contract and a proof that the project was completed and audited, as well as written confirmation by service recipients of the service performed.

— For Chief Design Engineer: copies of the diploma and of authorization A for developing civil engineering design documents issued by competent national authorities, as per the Construction Law in force (Official Gazette of Republic of Macedonia No 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14 and 115/14), M1/M2 employment form or other employment record proof(s) as per the Public Procurement Law in force, and completed short biography forms (provided in tender documents) for the proposed experts.

— For Road Alignment Design Engineer: copies of the diploma and of authorization A for developing design documents in civil engineering issued by competent national authorities, as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15 and 217/15), M1/M2 employment form or other employment record proof(s) as per the Public Procurement Law in force, and completed short biography forms (provided in tender documents) for the proposed experts.
