— Statement by the economic operator than it has not been sentenced, in the last 5 years, with effective Court decision for participation in criminal organization, corruption, fraud or money laundering;
— Certificate that it is not subject to bankruptcy procedure issued by competent authority;
— Certificate that it is not subject to liquidation procedure issued by competent authority;
— Certificate for paid taxes, contributions and other public duties by the competent authority in the country where that economic operator is established;
— Certificate from the Legal Entities Penal Registry that it is not being imposed a side sanction —…
… prohibition to participate in public competitions, contract award procedures and PPP award procedures;
… temporary or permanent prohibition to perform certain professional activity;
— Certificate that it is not being sanctioned for misdemeanour with an effective Court decision, resulting in prohibition for pursuing professional activity or duty, i.e. temporary prohibition for performing professional activity.
Економска и финансиска состојба:
— To have realized income not less than the estimated value of the procurement in at least 1 of the last 3 years. If the economic operator performs the activity in a period less than 3 years, the minimum requirement for determination of the economic and the financial ability is for the economic operator to have realized the condition from paragraph 1 in the years for which there are data.

The economic operator proves that it meets the minimum requirement by delivering:
— An excerpt from the entire turnover of the enterprise (data from the profit and loss statement issued by a competent authority, that is, revised profit and loss statement) and where necessary, from the turnover in the field that covers the agreement on public procurement, maximum for the last 3 financial years for which such information is available depending on the date when the enterprise was founded or started to operate and depending on the availability of such information.

… subject to a commercial audit, the economic operator can deliver them as evidence that it meets the minimum requirement for determination of the economic and the financial ability without being additionally certified by a competent authority.
… not subject to a commercial audit, the economic operator delivers them certified, that is, issued by a competent authority as evidence that it meets the minimum requirement for determination of the economic and the financial condition. Competent authority in the Republic of Macedonia is the Central Register of the Republic of Macedonia.
The economic and the financial ability of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and this entity, except when it is matter about the data from the profit and loss statement. If the economic operator proves its economic and financial condition referring to the support by another entity that is obliged to prove the support with a valid evidence that this entity will make available to the economic operator the appropriate funds. An effective verdict for participation in a criminal organization, corruption, fraud or money laundering must not be adjudged against the entity that provides the financial support.

If economic operators submit a bid as a group of economic operators, the economic and the financial ability is proven by taking into consideration the resources of all group members. If the group of economic operators performs with a financial support by a third entity, the economic and financial condition is determined in accordance with what is indicated above.

List of successfully realized agreements related to the subject matter of procurement in the last 3 years, with values of the agreements, dates of conclusion, buyers (contracting authorities or economic operators), by providing (3) certificates for performed deliveries issued by the recipients or if such certificates cannot be provided for reasons beyond the control of the economic operator, only with his statement for performed deliveries.
