The Contracting Authority shall exclude from the procedure any economic operator:

— Who in the past 5 years was issued an effective verdict for participation in a crime organization, corruption, fraud or money laundering;

— Who has been issued a secondary penalty for…

… ban on participating in open call procedures, awarding public procurement contracts and contracts on public-private partnership;

… temporary or permanent ban on performing particular activity;

— Who is in bankruptcy procedure or liquidation procedure;

— Who has unpaid taxes, benefits and other public duties, issued in accordance with special regulations and are not paid regularly;

— Who has been issued a misdemeanour sanction — ban on the performance of the profession, activity or duty, i.e. temporary ban on the performance of a particular activity;

— Who provides false data or fails to submit data requested by the Contracting Authority.

To prove its personal status, the economic operator should submit the following documents:

— Statement of the economic operator that no effective verdict has been issued against the economic operator within the past 5 years for participation in a crime organization, corruption, fraud or money laundering;

— Confirmation stating that no bankruptcy procedure has been initiated by a competent body;

— Confirmation stating that no liquidation procedure has been initiated by a competent body;

— Certificate of paid taxes, benefits and other public duties issued by a competent body in the country where the economic operator is registered;

— Confirmation from the Register of Penalties for Committed Criminal Offences of Legal Entities proving that no secondary penalty —…

… ban on participating in open call procedures, awarding public procurement contracts and contracts on public-private partnership has been pronounced;

… temporary or permanent ban on performing particular activity has been pronounced;

— Confirmation stating that no misdemeanour sanction — ban on the performance of the profession, activity or duty, i.e. temporary ban on the performance of a particular activity has been pronounced with an effective verdict.

Each economic operator shall deliver a document for registered activity in order to prove it is registered as a natural person or legal entity to pursue the activity related to the subject matter of the public procurement contract or a proof that it belongs to a professional association in accordance with the regulations of the country where it is registered.

Each economic operator shall deliver License A for performing I category constructions in accordance with the Law on Construction of RM.

Each economic operator shall deliver certificate for ISO 9001:2008.

Економска и финансиска состојба:

— Report on the balance sheet verified by the competent body, i.e. audited balance sheet, or extracts from the balance sheet report, in cases when the publishing of the balance sheet is regulated by law in the country where the economic operator is registered;

— Extract from the overall turnover of the enterprise (data from the income statement, issued by the competent body, i.e. audited income statement) for the last 3 (three) years;

— Foreign legal entity should submit an audit report that should be positive and issued by a renowned institution, registered for conducing audits which should contain data on the overall economic operation of the foreign bidder in the last 3 years and it has to be submitted translated into Macedonian.

Минимално ниво(а) на стандарди: Average revenues of minimum 60 000 000,00 MKD in the last 3 (three) years.
Техничка и професионална способност:

— List of works performed in the last 5 years with enclosing confirmations for satisfactory performance of the works, certificates that include the value, time and location of performing the works and statements whether the works were performed in accordance with the rules of business operations and whether they were properly completed.

Equipment:

— The economic operator needs to prove that it has at its disposal the equipment for performing the specific works that are subject of the contract, and to prove that it has the equipment in ownership or through a Rent Contract, Lease Contract, Procurement Contract or in another manner secured the required equipment in full working condition and the economic operator needs to prove that based on known engagement it would be available during the entire period of implementation of the relevant contract.

— Statement from the economic operator that it has at its disposal the equipment for performing the specific works that are subject of the contract and that it would be included for the entire period of validity of the public procurement contract.

— Notification on the elements of the contract that the economic operator intends to cede to subcontractors.

Минимално ниво(а) на стандарди:

— The economic operator should have implemented minimum 3 (three) contracts for the same and similar works in the last 5 (five) years.

— Minimum value of 1 (one) signed and implemented contract for performed same or similar works in the last 5 (five) years should be 10 000 000,00 MKD.

Equipment:

The economic operator should specify and prove that it has in its ownership or through a Rent contract, Leasing Contract, Contract for procurement or in another manner obtained the following minimum key equipment in full operational condition:

a) Machines for excavation of earth with total capacity of not less than 5 000 m

b) Minimum 3 (three) graders with engine power not less than 150 HP;

c) Minimum 3 (three) bulldozers;

d) Compression tools, minimum 1 (one) roller each — with pad-foot and smooth drum;

e) Water tank;

f) Minimum 10 (ten) tipper trucks with minimum 12 m

Извршување на договорот
Потребни депозити и гаранции:

Tender bid warranty — 3,00 %;

Warranty for high-quality enforcement of the Contract — 15,00 %.

Правна форма што треба да ја преземе групата економски оператори на која ќе се додели договорот:

Contracting authority will not require from the group of economic operators to associate in a specific legal form for the purpose of executing the contract.
