In the excise warehouse/ reservoirs on the territory of the Republic of Macedonia, determined with a written order of the Directorate of Compulsory Reserves of Oil and Oil Derivatives as the contracting authority.

Способност за вршење на стручната дејност:

1) For proving personal status, economic operator should provide the following documents:

— Statement by the economic operator that in the previous 5 years, an effective court decision for participation in criminal organization, corruption, fraud or money laundering, has not been announced,

— a Certificate that it is not subject to bankruptcy procedure issued by a competent authority,

— a Certificate that it is not subject to liquidation procedure issued by a competent authority,

— a Certificate for paid taxes, contributions and other public duties by the competent authority in the country where that economic operator is established,

— a Certificate from the Register of penalties for criminal acts committed by legal entities that a secondary penalty…

… ban on participation in procedures for public announcement, the award of public supply contracts and public-private partnership, has not been imposed,

… temporary or permanent prohibition of certain activities has not been imposed and,

— A Certificate that a sanction for misdemeanor with an effective court decision, resulting in prohibition for pursuing professional activity or duty, i.e. temporary prohibition for performing professional activity, it is not being announced.

Professional registration:

For the purpose of proving its ability to perform a professional activity, the economic operator shall submit:

— A Document for registered activity as a evidence that the operator is registered as a natural person or a legal entity to perform an activity related to the public procurement contract or evidence of membership in an appropriate professional association in accordance with the regulations of the country where the operator is registered, issued by the competent authority,

— Valid Excise license for the provided (own and/or leased) reservoir capacities for oil derivative subject of public procurement for each part / parts their bid refers to issued by the Customs Authorities of the Republic of Macedonia— for domestic economic operators,

— Valid license for performing energy activities — wholesale with oil and oil derivatives issued by the Energy Regulatory Committee of the Republic of Macedonia for domestic economic operators,

— Valid License for performing energy activity- storage of oil and oil derivatives — for Euro super BS 95, issued by the Energy Regulatory Commission of the Republic of Macedonia — for domestic economic operators,

— For foreign entities economic operators a valid license or other appropriate document for performing of energy activities — wholesale with oil and oil derivatives issued by the competent authorities pursuant to the regulations of the country where the economic operator is registered.

Економска и финансиска состојба:

Necessary documents for economic and financial ability of the economic operator:

The economic operator shall prove the fulfilment of the minimum requirements by submitting 1 or more of the following documents:

— Appropriate bank statements;

— Report on the balance sheet certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance sheet is required under the law of the country in which the economic operator is established, for the last financial year;

— Statement of overall turnover (data from the income statement issued by a competent authority, i.e. audited income statement) and, where appropriate, of turnover in the area covered by the contract and for the last financial year that such information is available, depending on the date on which the undertaking was set up or started work and depending on the availability of such information.

Минимално ниво(а) на стандарди:

To qualify as capable of performing the public procurement contract, in terms of its economic and financial ability, the economic operator must meet the following minimum requirements:

— Minimum annual turnover at the amount of 20 000 000 MKD in the last financial year.

Техничка и професионална способност:

Required documents to prove the technical capacity or professional ability of the economic operator:

— Copies of car licenses or car rental agreements for cisterns for oil derivatives, which have been concluded for a period not shorter than the period of validity of the bid, that should contain data from the car licenses of the leased cisterns for oil derivatives,

— Copies of minimum 3 concluded contracts for delivery of oil derivatives conducted in the past three years, with an individual value of each not less than 1 500 000 MKD or if such contracts cannot be provided due to reasons beyond the control of the economic operator, only with their statement regarding the conducted deliveries,

— The economic operator should submit valid evidence indicating that it possesses its own and/or leased excise reservoir facilities for the oil derivative subject of the public procurement, for each separate part/parts their bid refers to, i.e. property certificate or deed of title issued by the competent authority in the Republic of Macedonia.

In the case of leased excise reservoir facilities, acceptable evidence is a lease agreement valid for at least 5 years.

For foreign entities economic operators, acceptable evidence is appropriate contract for ensured warehouse on the territory of the Republic of Macedonia, concluded with the holder of the valid excise license and valid license for performing energy activity- storage of oil and oil derivatives issued by the Energy Regulatory Commission of the Republic of Macedonia.

To qualify as capable of performing the public procurement contract, in terms of its technical capacity or professional ability, the economic operator must meet the following minimum requirements:

— To have at least 5 (five) owned or leased cisterns for transportation of oil and oil derivatives, in good technical condition, pursuant to the valid legislation in the Republic of Macedonia,

— Minimum 3 concluded contracts for delivery of oil derivatives conducted in the past three years, with an individual value of each not less than 1 500 000 MKD,

— The economic operator should provide their own and/or leased excise reservoir facilities for the oil derivative, subject of the public procurement contract, for each part/parts their bid refers to.

Извршување на договорот
Потребни депозити и гаранции:

1. Statement about the steadiness of the bid.

2. Performance guarantee (5 % of the total contract value).

In order to sign the contract with the selected most favourable economic operator, the successful bidder shall be required to provide a contract performance bank guarantee in the amount of 5 % of the contract value.

A group of economic operators shall have the right to submit a bid without an obligation to form any legally appropriate association. The contracting authority shall not require the group of bidders to be associated in an appropriate legal form if the group is selected as the carrier of the procurement.
