A subject of the public procurement contract is the supply of the consultancy services in the area of legislation on the Energy community, harmonization with the legislation of the EU, national legal regulations and by-laws (including the preparation of the national legislation on projects for implementation of the initiative for regional energy market), harmonization with the EU Directives to which the Republic of Macedonia is committed in pursuance with the Agreement with the Energy Community ratified by the Assembly of the Republic of Macedonia (Official Gazette of the Republic of Macedonia No 59/06). Furthermore, the provision of these services is of essential importance for the energy sector in the country and the status of the Republic of Macedonia at the international energy market, especially having in mind the dispute ECS-2/15 initiated by the Energy Community against the Republic of Macedonia (Open letter for the Republic of Macedonia regarding the postponement of the liberalization of the electricity market ECS-2/15), as well as the influence of the implementation of the proposed draft-text for the Law on Energy in the Republic of Macedonia over the challenges for opening of the electricity market in the Republic of Macedonia. 1.3.2. The scope of the procurement includes a procurement of consultancy services for procurement of a continuous legal aid in the area of the legislation of the Energy Community, harmonization with the legislation of the European Union, national legal regulations and by-laws, including the preparation of the national legislation for projects for implementation of the initiative for regional energy market, as well as harmonization with the EU Directives to which the Republic of Macedonia is committed in pursuance with the Agreement with the Energy Community; preparation of analysis of the legal framework in pursuance with the directives issued by the EU for liberalization of the energy markets, implementation of the third package, and especially the challenges of the acceptance of the model for Energy Community in the EU; providing assessment of the existing challenges for opening of the market in the Republic of Macedonia, as well as assessment of the development of the regional electricity market in the SEE, having in mind all national and regional initiatives; preparation of an analysis on the impact of the implementation of the proposed draft text of the Law on Energy in the Republic of Macedonia over the challenges for opening of the electricity market in the Republic of Macedonia, as well as assessment of the development of the regional electricity market in the SEE, having in mind all national interests of the Republic of Macedonia, as well as the role and influence of the Joint Stock Company ELEM on the regional market.

In order to prove its personal standing, the economic operator must submit the following documents:
— Statement of the economic operator that in the past 5 years they have not been imposed with an effective judgement for participation in a criminal organization, corruption, fraud or money laundering;
— Certificate that they have not been subject to a…
… bankruptcy procedure initiated by a competent authority;
… liquidation procedure initiated by a competent authority;
— Certificate for paid taxes, contributions and other public dues issued by a competent authority in the country where the economic operator has been registered;
— Certificate from the Registry of Offences for Committed Offences by Legal Entities that they have not been imposed with a minor sentence for temporary or permanent prohibition for performance of certain activity;
— Certificate that they have not been imposed with a misdemeanour sanction — prohibition for performance of a profession, activity or duty i.e. temporary prohibition for performance of a certain activity.
In order to prove their capability for performance of the professional activity, the economic operator must submit a certificate for the registered activity as a proof that they are registered as an individual or legal entity for performance of the activity related to the subject of Public Procurement Contract or a proof that they are part of an appropriate professional association in pursuance with the regulations in the country where they are registered.

— Reference list of provided services, same or similar to the subject of procurement, in the last 3 (three) years (2015, 2014 and 2013) with values, dates, buyers (contracting authorities or economic operators), by providing certificate for provided services issued by the recipients or, if such certificates cannot be provided due to reasons beyond the economic operator's control, only their statement for performed activities and a portfolio of the economic operator that will specify the professional experience in the field of energy in the region of South-East Europe or within international frames;

— Certified statement (attached to the tender documents) for the number of professional, at least 2 (two) experts — consultants who will be engaged by the economic operator for realization of the procurement and a detailed CV (filled in the form stipulated in the tender documents) for all experts — consultants included in the subject procurement which will prove the relevant experience of the engaged persons at same and similar projects such as the subject of procurement.

Any interested person can be present at the opening of the bids.

If the bid is submitted by an economic operator registered abroad and the bid and accompanying documents are not into Macedonian language, both the bid and the accompanying documents must be translated into Macedonian by a certified Court translator. The expenses for the translation shall be borne by the economic operator i.e. the tenderer.

Each tenderer who has a legal interest in concluding a public procurement contract and who suffered or might suffer damage from possible violation of the provisions stipulated in the Law on Public Procurements, may request legal protection against the decisions, acts or omissions to undertake activities by the contracting party in the public procurement contract awarding procedure in pursuance with the terms and the procedure referred to in the Law on Public Procurements.
Each tenderer who has a legal interest in concluding a public procurement contract and who suffered or might suffer damage from possible violation of the provisions stipulated in the Law on Public Procurements, may request legal protection against the decisions, acts or omissions to undertake activities by the contracting party in the public procurement contract awarding procedure in pursuance with the terms and the procedure referred to in the Law on Public Procurements.
Deadline for loading an appeal is 8 days since the day of receipt of the decision for selection of the most advantageous tenderer from each participant in the process.
