The contracting authority shall exclude any economic operator from the public contract award procedure:

— to whom in the last five years was announced effective court verdict for participation in a criminal organization, corruption, fraud or money laundering;

— to whom was announced a minor penalty — prohibition for participation in public tender procedures, granting public procurement contracts and contracts for public-private partnership;

— to whom was announced a minor penalty — temporary or permanent prohibition for performing certain activity;

— that is in open bankruptcy proceedings or liquidation proceedings;

— that has unpaid taxes, contributions and other public charges, except the economic operator has been approved deferred payment of taxes, contributions or other public charges according to the special regulations and the economic operator regularly pays the above-mentioned,

— that was pronounced a misdemeanor sanction — a prohibition to carry out professional activities, activity or duty, that is, temporary prohibition for performing certain activity, and

— that presents false information or fails to present the information requested by the contracting authority.

For the purpose of proving his personal standing, the economic operator shall submit the following documents:

— a statement by the economic operator that it has not been announced, in the last 5 years, effective court verdict for participation in a criminal organization, corruption, fraud or money laundering;

— a certificate that there is no bankruptcy procedure by the competent authority;

— a certificate that there is no liquidation procedure by the competent authority;

— a certificate for paid taxes, contributions and other public duties by the competent authority in the country where the economic operator is registered

— certificate from the Registry of penalties for committed crimes by legal entities, that it was not announced a minor penalty — prohibition for participation in public bidding procedures, procedures of awarding public contracts as well as contracts of public — private partnership;

— a certificate from the Registry of penalties for committed crimes by legal entities, that it was not announced a minor penalty — temporary or permanent prohibition for performing certain activity;

— a certificate which verifies that no legally effective judgment was pronounced — prohibition to carry out professional activities or duty, that is, temporary prohibition to carry out certain activity.

In order to prove his capability for performing professional activity, the economic operator shall deliver a document for registered activity in order to prove that it is registered as a natural person or legal entity to pursue the activity related to the subject-matter of the public procurement contract or a prove that it belongs to a professional association in accordance with the regulations of the country where is registered.

— statements regarding the overall turnover of the company (information from the profit and loss account issued by a competent authority, i.e. audited profit and loss account) and where applicable, regarding the turnover in the field of activity covered by the public contract, for the last three financial years as the most of which such information is available, depending on the date on which the company was established or started operating, and depending on the availability of such information.

1. As a proof of certification the bidder should submit valid certificate and a statement for the engaged technical staff and technical bodies regardless of whether they belong directly to the economic operator for the entire duration of the procurement.

— Minimum 1 (one) person who possess ITIL certification or certification from another certification body for this field of certification.

… hypervisor operating systems which are subject to procurement, installation and support, with a certificate issued by the software manufacturer or certification from another certification body for this field of certification.

… server operating systems which are subject to procurement, installation and support, with a certificate issued by the software manufacturer or certification from another certification body for this field of certification.

… installation on the current application server software IBM WebSphere with a certificate issued by the manufacturer (IBM) or certification from another certification body for this field of certification.

… LAN network infrastructure that is subject to configuration and integration with the new hardware components (servers and storage systems) with at least one of the following certificates:

Cisco Routing and Switching Solutions Specialist or Cisco Certified Internetwork Expert (CCIE) issued by the manufacturer (Cisco Systems) or certification from another certification body for this field of certification.
