2.3 Capacity to perform a professional activity

2.3.1 In order to prove the capacity to perform a professional activity the economic operator submitsdocument for registered activity as a prove that it is registered as a natural or legal entity for performing the activity connected with the subject of the Public Procurement Agreement or a prove that it belongs to a suitable professional association according to the regulations in the country where it has been registered and a copy of License ‘B’ for contractors according to the current Law on Construction in RM.

— Current Status.

2.4 Economic and financial capacity

2.4.1 In order to qualify as capable to execute the Agreement from the aspect of its economic and financial capacity, the economic operator shall fulfill the following minimal conditions:

— To have achieved revenue of not less than the appraised value of supply in at least one of the last three years.

If the economic operator operates in period shorter than three years, a minimum requirement for determining the economic and financial condition of the economic operator to have achieved the condition of paragraph 1 in the years for which data are available.

2.4.3 The Economic Operator proves the fulfillment of the minimal condition from sub-Article 2.4.1 by submitting:

— Balance sheets certified by a competent authority, ie audited balance sheets or extracts from the balance sheets, where publication of the balance sheet is required under the law of the country where the economic operator is registered

2.4.4 If the balance sheet and income statement have been subject to commercial audit, the economic operator may submit them as evidence that it meets the minimum requirement for determining the economic and financial situation without being certified by a competent authority.

2.4.5 If the balance sheet and income statement were not subject to commercial audit, the economic operator shall submit them verified or issued by a competent authority as proof that it meets the minimum requirement for determining the economic and financial situation. The competent authority in the Republic of Macedonia is the Central Registry of Macedonia.

2.4.6 The economic and financial capacity of the economic operator may be supported by another entity regardless of the legal relations between the economic operator and that entity. If the economic operator proves its economic and financial capacity referring to the support of another entity, it is obliged to prove the support with valid evidence that the entity will make available to the economic operator the relevant finances. The entity providing the financial support should not be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.4.7 If economic operators submit a group bid or application for participation the economic and financial capacity is proven by taking into consideration the resources of all group members. If the group of bidders or candidates acts with the financial support from a third entity, the economic and financial capacity is proven according to the abovementioned.

2.5 Technical and professional capacity

2.5.1 In order to qualify as capable to execute the Agreement from the aspect of its technical or professional capacity, the economic operator shall fulfill the following minimal conditions:

— Experience in successfully realized contracts related to the subject of procurement in the last three years

2.5.2 The Economic Operator proves the fulfillment of the minimal condition from sub-Article 2.5.1 by submitting:

— — A list of successfully completed contracts relating to the subject of procurement in the last three years with values of contracts, dates of signing, buyers (contracting authorities or economic operators)by providing certificate for the deliveries issued by the recipients or, if such certificates can not be provided for reasons beyond the control of the economic operator, only a statement for the deliveries

2.5.3 Technical and professional capacity of the economic operator may be supported by another entity regardless of the legal relations between the economic operator and that entity, except for the list of previously concluded contracts and licenses. If the economic operator proves its technical and professional capacity invoking the support of another entity, it is obliged to prove the support with valid evidence that the entity will make available to the economic operator the relevant technical and professional resources. The entity provides technical and professional support should not be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.5.4 If economic operators submit a bid as a group of economic operators, the technical and professional capacity shall be proved by considering the resources of all group members. If the group of economic operators participates with technical and professional support from a third entity or third entities, the technical and professional capacity is determined in accordance with the abovementioned.

Потребни депозити и гаранции:

7.5 Guarantee of quality execution of the Agreement

7.5.1 The condition for signing the agreement with the winning bidder is providing a guarantee by the selected best bidder for quality execution of the Agreement amounting to 5 % of the contract value.

7.5.2 The guarantee of item 7.5.1 shall be submitted in the form of a bank guarantee in writing. The guarantee should be submitted in original form. Copies are not accepted.

7.5.3 The guarantee for quality execution shall be valid until the completion of contract. The contracting authority in the selection of the best bidder additionally determines the date of the guarantee.

7.5.4 The bank guarantee for quality performance of the contract will be in the currency of the contract.

7.5.5 The guarantee for quality execution of the contract must be issued by a bank.

7.5.6 The guarantee for the quality execution of the contract of the selected best bidder shall be submitted after receiving notice of the choice before signing the contract within the time specified by the contracting authority in the notification.

7.5.7 The guarantee for quality execution of the agreement shall be submitted within the specified period, by mail or in person to the contact person from item 1.2.2 of the tender documentation.

7.5.8 The guarantee for quality execution of the agreement will be charged if the contractor does not fulfill some of the obligations under the contract within the due deadline, for which it shall notify the contractor in writing. If it comes to the collection of the guarantee for quality execution of the contract, the contracting authority shall publish a negative reference on EPPS. For collection of the bank guarantee for quality execution of the contract and the publication of negative reference on EPPS, the contractor may initiate proceedings before a competent court.

7.5.9 If the contract is fully implemented as agreed, the bank guarantee for the quality execution of the contract shall be returned to the contractor within 14 days of completion of the contract.

7.5.10 The contracting authority returns the guarantee for quality execution of the agreement to the the contractor by mail, in person at the headquarters of the economic operator or in person at the headquarters of the contracting authority.
