2.3 Capacity to perform a professional activity.

2.3.1 In order to prove the capacity to perform a professional activity the economic operator submits a document for registered activity as a prove that it is registered as a natural or legal entity for performing the activity connected with the subject of the Public Procurement Agreement or a prove that it belongs to a suitable professional association according to the regulations in the country where it has been registered and a Current Status not older than 6 months.

2.3.2 The economic operator proves the fulfillment of a minimal condition under sub-Article 2.3.1 by delivering:

— A Certificate for registered activity and;

— Copy of its Current status not older than 6 months.

7.5 Guarantee for qualitative execution of the Agreement

7.5.1 The Economic Operator in a period of 5 days after signing the contract at its own cost and risk mandatorily provides unconditional and irrevocable bank guarantee for qualitative execution of the works in the amount of 10 % of the value of the Agreement. The Bank guarantee is also a condition for the introduction in the works of the Contractor. This guarantee is in favour of the contracting authority.

7.5.2 The guarantee form item 7.5.1 is delivered in the form of bank guarantee in written form. The guarantee shall be filed in original form. Copies are not accepted.

7.5.3 The guarantee for qualitative execution of the Agreement will be valid until the full realization of the Agreement. The contracting authority after the election of the most suitable bidder additionally determines the deadline for the validity of the guarantee.

7.5.4 The bank guarantee for qualitative performance of the Agreement shall in the currency same as the 1 in the Agreement.

7.5.5 The bank guarantee for qualitative performance of the Agreement shall be delivered in the determined deadline, in person by the contact person form item 1.2.2 from the tender documentation.

7.5.6 The guarantee for qualitative execution of the Agreement shall be charged if the bearer of the procurement does not fulfill any of the obligations of the Public Procurement Agreement in the determined deadline for which it will notify the bearer in written. If it comes to charging of the guarantee for qualitative execution of the Agreement the contracting authority publishes a negative reference to ESJN.

7.5.8 In case when the deadline for realization of the Agreement is extended or the value is increased the bearer of the procurement just needs to extend the validity and the value of the guarantee for qualitative execution of the Agreement.

7.5.9 If the Public Procurement Agreement is fully realized according to the agreed the bank guarantee for qualitative execution of the Agreement is returned by the contracting authority to the bearer of the procurement in a period of 14 days after the technical receipt of the Commission formed by the contracting authority.
