— Statement of the balance sheet registered with the governing body, i.e. revised balance sheet, or excerpts of the report on the balance sheet in cases when the publication of the balance sheet is regulated by law in the country where the economic operator has been registered;

— Report of the overall turnover of the company (data from the balance of success issued by a governing body, i.e. revised balance of success) and where applicable, of the turnover in the area covered by the contract for public procurement for the last 3 financial years at the most for which accessible data are to be found in accordance with the date when the company has been established or has begun operation and as well with the accessibility of this kind of data.

Минимално ниво(а) на стандарди:

— Minimum amount of 18 000 000 MKD in revenue in the duration of the last 3 years.

Техничка и професионална способност:

— Reference list for successful realization of projects on the territory of the Republic of Macedonia with the submission of certificates or contracts by the users from which it may be determined that the economic operator has delivered and mounted measuring-regulatory units with a capacity not smaller than 6 t3/h (certificates from which it can be determined delivery of at least 50 measuring-regulatory units) in the last 3 years;

— proof for a minimum of 3 (three) graduated mechanical engineers of whom 1 (one) has the approval for performing, without the need for the persons in question to have a regulated employment contract with the economic operator; proof for 2 (two) graduated electrical engineers of whom 1 has the approval for performing without the need for the persons in question to have a regulated employment contract with the economic operator;

— proof for 1 (one) maintenance person who has a certificate for installing, setting in operation and maintenance of the measuring…

… regulatory units with low and high flow without the need for the persons in question to have a regulated employment contract with the economic operator;

… units of flow without the need for the persons in question to have a regulated employment contract with the economic;

— proof for 2 (two) maintenance persons who have a certificate for installing, setting in operation and maintenance,…

… monitoring and dealing with mechanical problems of regulatory units for high and low pressure of natural gas and safety units without the need for the persons in question to have a regulated employment contract with the economic operator;

… setting up and application of additional parameters and characteristics of electronic volume correctors (units for conversion of volume of gas according to PTZ parameters) without the need for the persons in question to have a regulated employment contract with the economic operator;

— proof for 1 (one) maintenance person who has a certificate for welding of electro-fusion connector elements without the need for the persons in question to have a regulated employment contract with the economic operator;

— proof for owning a machine for electro-fusion welding of connective elements made of polyethylene elements PE 100 or to submit a suitable proof (contract) for the renting of such a machine for the period of 12 months or proof for the support of another subject who has in its disposals the above stated machine for a period of 12 months;

— certificate issued by the manufacturer which shows that the equipment which is stated to be subject of procurement can be offered and delivered in time, as well as to guarantee the production and supply of spare parts for a minimum period of 5 years, which will additionally provide further maintenance of the equipment.

— The economic operator needs to have experience of successfully realized deliveries and mounts of the goods which are subject of the procurement;

— the economic operator to have at least 3 (three) graduated mechanical engineers of whom 1 (one) is in the possession of approval for performing;

— the economic operator to have at least 2 (two) graduated electrical engineers of whom one has the approval for performing;

— the economic operator to have at least 1 (one) maintenance person who has a certificate for installing, setting in operation and maintenance of the measuring…

— in the case of procuring compound goods, or in exclusive cases goods for special purposes, a special check needs to be provided of the production capacities of the economic operator.

Информации за роковите за приговор:

6.3.1. Every bidder who has a legal interest for being awarded the agreement for public procurement and who has suffered or could suffer damages from an eventual breaking of the provisions of this law, can ask for legal protection against the decisions made, actions or failures to take action on behalf of the agreement agency in the process of awarding the agreement for public procurement, in accordance with the conditions and the procedure set by the Law for public procurements. The right to an appeal in the procedure which ends with the electronic auction regarding the determining of the capability of the bidders and the overall assessment of the initial bids is to be done after making the decision for choosing the most favourable bidder or the annulment of the procedure.

6.3.2. The complaint needs to contain the following elements:

— Data about the entity who is lodging the complaint (first name, last name, name of the economic operator, head office and address of living),

— Data about the authorized person and the assignee,

— Name and head office of the agreement agency,

— Number and date of the procedure for awarding the agreement for public procurement and data about the invitation for awarding the agreement for public procurement,

— Number and date of the decision for selecting the most favourable bid, annulment of the bid and other decisions made by the agreement agency,

— Data about the activities or inabilities to take action on behalf of the agreement agency,

— Description of the factual condition,

— Description of the irregularities and statement of reasons about the same,

— Propositional evidence,

— Complaint request and/or request for reimbursement of procedural costs, and

— Signature of the authorized person.

6.3.5. The entity who is lodging the complaint is obliged to submit evidence of payment for the complaint procedure.

6.3.6. The entity lodging the complaint who does not have a office on the territory of the Republic of Macedonia is obliged to nominate an assignee for receiving the letters.

6.3.7. The State Committee is to be notified about the complaint. The complaint is to be submitted in person or by direct mail, and the same is to be sent at the same time to the agreement agency and to the State Committee. The day of lodging the complaint through direct mail is to be considered as the day of submitting. In case of lodging the complaint in person the agreement agency is obliged to issue a statement to the entity who is submitting the complaint stating the time of receipt of the complaint.

6.3.8. During the procedure led by the State Committee the lodger of the complaint, in addition to the administrative fee, also needs to pay a fee for conducting the procedure depending on the amount of the bid, i.e.:

— Up to 20 000 EUR in denar equivalent value, a fee of 100 EUR in denar equivalent value,

— From 20 000 to 100 000 EUR in denar equivalent value, a fee of 200 EUR in denar equivalent value,

— From 100 000 to 200 000 EUR in denar equivalent value, a fee of 300 EUR in denar equivalent value, or

— Above 200 000 EUR in denar equivalent value a fee of 400 EUR in denar equivalent value.

6.3.9. In case there is no bid submitted, the amount of the fee for conducting the procedure is to be calculated based on the assessed value of he agreement for public procurement, where the State Committee will notify the lodger of the complaint about the amount of the fee to be paid and the set deadline for providing evidence for the payment made.

6.3.10. The fee for conducting the procedure is a revenue to the Budget of the Republic of Macedonia.

6.3.11. The agreement agency cannot sign the agreement for public procurement and to adhere to its implementation in due course of 12 days, counted from the day of receiving of the decision by which is decided for the single right in the procedure for awarding the agreement for public procurement, except:

— in cases related to articles 99 and 198 of this Law,

— in case when in the procedure there was only one bidder involved whose bid has been chosen as most favourable, or

— in case of individual agreements for public procurements based on a framework agreement.
