2.1.1. The contracting authority shall exclude from the procedure for awarding a public procurement contract any economic operator:

— Against which an effective Court decision for participation in criminal organization, corruption, fraud or money laundering was rendered in the past 5 years;

— To which a secondary penalty — ban on participation in public call procedures, awarding public procurement contracts and contracts on public-private partnership has been pronounced;

— To which a secondary penalty — temporary or permanent prohibition to perform a certain activity has been pronounced;

— Which is in bankruptcy or liquidation procedure;

— Which has unsettled taxes, contributions and other public duties, unless it is allowed to make deferred payment of such taxes, contributions and other public duties in compliance with the separate regulations and pays them regularly;

— To which a misdemeanour sanction — ban on performance of profession, activity or responsibility, i.e. temporary ban on the performance of particular activity has been pronounced; and

— Which gives false data or does not submit data requested by the contracting authority.

2.1.2. In order to evidence its capacity, the economic operator shall provide and submit the following documents:

— Statement by the economic operator that no effective Court decision for participation in criminal organization, corruption, fraud or money laundering was rendered in the past 5 years;

— Statement by the competent authority, that no…

— Statement on settled taxes, contributions and other public duties by the competent authority in the country where the economic operator is registered;

— Statement from the Register of Penalties for Crimes Committed by Legal Persons that no secondary penalty —…

… ban has been pronounced for participation in invitation to public call procedures, awarding of public procurement contracts or private-public partnership contracts;

… temporary or permanent interdiction on carrying out particular business activity has been pronounced;

— Statement that no misdemeanour sanction — interdiction on carrying out profession, activity or responsibility, i.e. temporary interdiction on carrying out particular business activity, has been pronounced with an effective Court decision.

Економска и финансиска состојба:

2.3.3. The economic operator shall prove the fulfilment of the minimum requirement in sub-items 2.3.1 and 2.3.2 by submitting:

— Balance sheet and income statement certified by a competent authority, i.e. audited balance sheet and income statement or extracts form the balance sheet and income statement in cases when the publication of the balance sheet and income statement has been prescribed by law in the country where the economic operator is registered for the past 3 financial years (2013, 2014 and 2015).

2.3.1. In order to qualify as capable of fulfilling the public procurement contract in terms of its economic and financial status, the economic operator should meet the following minimum requirements:

— To have a positive result from the normal operation conducted in each of the last three (3) years: 2013, 2014 and 2015.

2.3.2. If the economic operator performs the activity for a period of less than 3 years, a minimum requirement for determining the economic and financial status of the economic operator is that it has achieved the requirement of sub-item 2.3.1 in the years for which data are available.

Техничка и професионална способност:

2.4.2. The economic operator proves the fulfilment of the minimum requirements of sub-item 2.4.1 by submitting:

— A reference list for previously rendered services in the area of information technology of the same or similar nature as the required system, including: service user (contracting authorities and/or economic operators), subject of the service, time of performance and contact person with a phone/e-mail address, including a certificate for confirmation of the services issued by the recipients/service users or, if such certificates can not be provided of reasons out of control of the economic operator, only by their statement of services rendered.

— A reference list for implementation of at least one (1) project on interoperability for connection and exchange of data in state institutions, including: service user (contracting authorities and/or economic operators), subject of the service, time of performance and contact person with a phone/e-mail address, including a certificate for confirmation of the services issued by the recipients/service users or, if such certificates can not be provided of reasons out of control of the economic operator, only by their statement of services rendered.

— A copy of a valid contract/document with the European Commission for an already established connection with sTesta/Testa-ng between the Republic of Macedonia and the European Commission or the economic operator should submit a certificate/contract with a national agency defined by the European Commission for the Republic of Macedonia to use an already established connection with sTesta/Testa-ng between the Republic of Macedonia and the European Commission.

— Statement on engaged team members regardless of whether they belong directly to the economic operator, including: a chart of persons and their obligations in the execution of the contract subject in accordance with the defined technical specifications and a CV stating the required experience.

— Statement by the economic operator that they have or will ensure business continuity and protection of data generated by the application on a backup location which will be connected with a link of 10MB per second and be at a distance of at least 100 kilometres in order to provide high availability, that is, activation of a secondary location of applications in the event of failure of the primary application.

Минимално ниво(а) на стандарди:

2.4.1. In order to qualify as capable of implementing the public procurement contract in terms of its technical and professional capability, the economic operator should meet the following minimum requirements:

— The economic operator should have experience in implementation of at least…

… three (3) projects in the information technology area of the same or similar type as the required system in the last three (3) years;

… one (1) project on interoperability for connection and data exchange in the state institutions in the past three (3) years;

— The economic operator should provide connectivity with the sTesta/Testa-ng network for data exchange;

— The economic operator should provide experienced and competent team members who will be engaged to carry out the subject of the contract in accordance with the defined services, consisting of at least ten (10) members, of whom at least 3 (three), with the following qualifications:

а) One (1) Project Manager with at least ten (10) years of experience who should own a PMP certificate or equivalent;

b) 2 (two) system administrators.

— The economic operator for the subject of the procurement should ensure business continuity and protection of data generated by the application on a backup location which will be connected with a link of 10MB per second and be at a distance of at least 100 kilometres in order to provide high availability, that is, activation of a secondary location of applications in the event of failure of the primary application.

Потребни депозити и гаранции:

As part of its bid, the economic operator is obliged to provide a bid guarantee in the amount of 3 % of the total value of the bid, without VAT.

The bid guarantee shall be in the form of a bank guarantee. All banks are acceptable to the contracting authority.

The bid guarantee shall also be submitted in original form in procedures conducted electronically. Scanned bud guarantees/copies of bid guarantees shall not be accepted /the guarantee can be submitted in paper form in the manner determined by the deadline for submission of bids. If the guarantee is available in the original electronic form/ electronic guarantee / it shall be attached via the ESPP along with the bid and the supporting documents.

The guarantee must have validity period of at least 14 days from the day the validity period of the bid expires. Any bid that does not include a bid guarantee, or includes a bid guarantee that is not in accordance with the requirements in the tender documentation, shall be rejected by the contracting authority as unacceptable.

The bid guarantee may be collected by the contracting authority, if the economic operator:

— Withdraws its bid before the validity period expires;

— Does not accept the correction of arithmetical errors suggested by the commission;

— Does not sign the public procurement contract; and

— Does not provide a guarantee of quality execution of the contract.

In exceptional cases, the contracting authority may ask tenderers to extend the validity period of the tender guarantee.

The bid guarantee of the unsuccessful economic operators shall be returned within 7 days following the signing of the contract with the most favourable economic operator.

The bid guarantee of the economic operator whose bid was selected as most favourable shall be returned after the bidder has signed the public procurement contract and submitted a guarantee for quality performance of the contract.

The bid guarantee shall be submitted in the filing office of the Ministry of Transport and Communications by the day and hour defined as final for submission of bids.

Guarantee for high-quality performance of the Contract:

The condition for signing a contract with the most advantageous economic operator is the provisioning of a guarantee for high-quality performance of the contract in the amount of 10 % of the value of the public procurement contract.

The performance guarantee shall be submitted within the specified period, and by mail or in person at the headquarters of the contracting authority.

Only the authorised representatives of the tenderers may participate in the procedure for public opening offenders with providing their own remarks registered in the minutes for the tender opening. At the public opening of tenders, authorised representatives of economic operators must present an authorisation signed by the authorised person of the economic operator. All authorised representatives of the economic operators present at the public opening of tenders should sign an attendance list. The tender opening shall be electronic, via the ESPP, and shall be public. The public opening of tenders shall take place on 4.7.2016, at 11:00 hours, in the Ministry of Transport and Communications. All submitted tenders shall be opened in-line with the Law on Public Procurement, as follows: 1 at a time,by reading the name of each economic operator, followed by establishing whether the tenders have been submitted pursuant to item 5.1 of the tender documentation and whether all tenders have been signed electronically, followed by a reading of tenders respecting the same order of opening. The tenderers which shall fail to meet the requirements referred to in the tender documentation shall be excluded from the further procedure, that is, they shall not be invited to the electronic auction. None of the tenders shall be rejected at the opening of the tenders, except for the late tenders. The public procurement commission shall open the tenders even if only 1 tender is received. In that case, there shall be no electronic auction. The condition for having an electronic auction is to receive at least 2 acceptable tenders in the procedure. During the public opening of tenders and evaluation of the initially submitted tenders, minutes shall be kept in-line with the Rulebook for the Procedure for Tenders Opening and the Form for Minutes Keeping at Tenders Opening (‘Official Gazette of the Republic of Macedonia’ No 154/07), as well as a Report on the conducted procedure. Prior to evaluating the tenders, the commission shall check whether a negative reference was published till the expiry of the deadline for submission of tenders and shall verify the completeness and validity of the documentation proving the tenderer's capability. Unacceptable tenders shall not be evaluated by the commission.

The appeal shall be submitted within 8 days starting from the day of:

— Publication of the contract award notice with reference to the data, actions or failure to undertake actions related to the notice;

— Opening of the tenders reference to the data, actions or failure to undertake actions related to the tender documentation, that is, the tender opening procedure;

— Expiry of the time-frame for adoption of a decision for selection or cancellation of the procedure pursuant to Article 162 paragraph 2 of the Public Procurement Law regarding the failure to make a decision for selection or cancellation of the procedure in the relevant time-frame;

— Receiving of the decision for selection of the most advantageous tender or the decision for cancellation of the procedure; or

— Findings about irregularities in the management of the contract award procedure, within 1 year at the latest starting from the day of the termination of the implemented procedure.

The time-frame to lodge an appeal regarding the determining of the tenderers' capability and the overall evaluation of the initial tenders shall be counted from the date of receipt of the decision deciding on the individual right from the contract award procedure following the electronic auction completion.

The economic operator that failed to lodge an appeal with respect to the provisions stipulated in sub-item shall not have a right to an appeal in a later stage of the procedure for the same legal basis.

The appeal should contain the following elements:

— Data on the submitter of the appeal (name, surname, name of the economic operator, address of residence and registered address);

— Data on the representative or the proxy;

— Name and registered address of the contracting authority;

— Number and date of the contract award procedure and data on the contract notice;

— Number and date of the decision for selection of the most advantageous tender, cancellation of the procedure or other decisions of the contracting authority;

— Data on the actions or failure to undertake actions by the contracting authority;

— Description of the factual situation;

— Description and explanation of the irregularities;

— Appeal and/or claim for compensation of procedure costs; and

— Signature and seal of an authorised person.

The submitter of the appeal shall be obliged to submit a proof of payment of the fee for procedure implementation.

The submitter of the appeal whose registered address is not on the territory of the Republic of Macedonia shall be obliged to determine a proxy to receive writs.

The appeal shall be lodged with the State Appeals Commission. The appeal shall be submitted in person or by registered mail to both the contracting authority and the State Appeals Commission. The day when the appeal is sent by registered mail shall be deemed as the day when the appeal was submitted. In case the appeal is submitted in person, the contracting authority shall be obliged to issue a confirmation of the time of the receipt to the submitter.

In the procedure before the State Appeals Commission, the appellant shall, in addition to the administrative fee, be liable to pay a fee for implementing the procedure depending on the amount of the tender, as follows:

— Up to 20 000 EUR in MKD counter-value, a fee of 100 EUR in MKD counter-value;

— From 20 000 to 100 000 EUR in MKD counter-value, a fee of 200 EUR in MKD counter-value;

— From 100 000 to 200 000 EUR in MKD counter-value, a fee of 300 EUR in MKD counter-value; or

— Over 200 000 EUR in MKD counter-value, a fee of 400 EUR in MKD counter-value.

In case when there is no tender, the amount of the fee for procedure implementation shall be calculated on the basis of the estimated value of the public procurement contract, and the State Appeals Commission shall inform the appellant about the amount of the fee and the deadline in which the appellant needs to submit proof for payment of the fee.

The procedure implementation fee shall be revenue of the Budget of the Republic of Macedonia.
