2.2 Personal status

2.2.1 The contracting authority shall exclude from the procedure for awarding a public procurement contract any economic operator who:

— within the last five years has had effective sentence for participation in a criminal organization, corruption, fraud or money laundering;

— has imposed a penalty on participation in public bidding procedures, awarding public procurement contracts and contracts for public private partnership;

— it has imposed a temporary or permanent ban on performing certain activities;

— is in bankruptcy or liquidation proceedings;

— failed to pay taxes and other public charges, unless the economic operator has been granted deferred payment of taxes;

— has a misdemeanor sanction for prohibition to perform a profession, activity or duty, or prohibition to perform certain activity

— Gives false information or fails to provide information requested by the contracting authority.

2.2.2 To prove its personal status the economic operator shall submit the following documents:

— statement of the economic operator that no effective verdict has been issued against the economic operator within the past five years for participation in a crime organization, corruption, fraud or money laundering

— confirmation stating that no bankruptcy procedure has been initiated by a competent body

— confirmation stating that no liquidation procedure has been initiated by a competent body

— certificate of paid taxes, benefits and other public duties issued by a competent body in the country where the economic operator is registered

— confirmation from the Register of penalties for committed criminal offences of legal entities proving that no secondary penalty —…

… ban on participating in open call procedures, awarding public procurement contracts and contracts on public — private partnership has been pronounced

… temporary or permanent ban on performing particular activity has been pronounced

— confirmation stating that no misdemeanour sanction — ban on the performance of the profession, activity or duty, i.e. temporary ban on the performance of a particular activity has been pronounced with an effective verdict

2.2.3 The statement of the economic operator that no effective verdict has been issued against within the past five years for participation in a crime organization, corruption, fraud or money laundering, is prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4 Confirmations stating that no bankruptcy and liquidation procedure has been initiated, as well as the certificates from the Registry of penalties for committed criminal offenses of legal entities proving that no secondary penalty — ban on participating in open call procedures, awarding public procurement contracts and contracts on public — private partnership has been pronounced, and that has not been imposed a temporary or permanent ban on performing certain activity are issued by competent authorities in the country where it is registered. In Macedonia the competent authority for issuing such certificates is the Central Registry of the Republic of Macedonia.

2.2.5 The confirmation of paid taxes and other charges is being issued by the competent authority in the country where it is registered. Macedonian competent authority to issue such certificates it the Public Revenue Office.

2.2.6 The confirmation for the economic operator stating that there has not been imposed prohibition to perform a profession, activity or duty, or prohibition to perform certain activity, is being issued by the competent authority in the country where it is registered. In Macedonia the competent authority for issuing such certificates is the Central Registry of Macedonia.

2.2.7 The above mentioned documents must not be older than six months from the deadline for submission of bids.

2.2.8 If the country in which the economic operator is registered does not issue the above documents, or if they do not cover all the above cases, the economic operator may submit a statement certified by a competent authority.

2.3 Capability to perform professional activity

To prove the capability to perform professional activity, the economic operator should submit a document for registered activity as a proof that it is registered as a legal entity for performing the activity related to the subject of the public procurement contract or evidence that belongs to a professional association in accordance with the regulations of the country where it is registered.

In determining the capability to perform professional activity of the economic operators the contracting authority requires proof issued by a competent authority for the fulfilment of specific conditions for conducting activities prescribed under the law regarding the subject of the contract.

To prove the ability to perform professional activity the economic operator, should submit:

— Document for registered activity — DRD form or certificate for registered activity.

— A decision for wholesale of medical supplies under the Law on medicines and medical devices.

Техничка и професионална способност:

2.5.1 To qualify as capable of performing the contract for public procurement in terms of its technical or professional capability, the economic operator must meet the following minimum requirements:

For the registered medical devices:

— The economic operator must have an approval for placing the medical device or temporary / permanent authorization for parallel imports, pursuant to the Law on Medicines and Medical Devices for the offered goods.

For the unregistered medical devices:

— Economic operator must have a document allowing imports (import approval for intervention) pursuant to the Law on Medicines and Medical Devices for the offered goods.

2.5.2 The economic operator proves the fulfilment of minimum requirements by submitting:

— A decision on placing the medical device or temporary / permanent authorization for parallel imports, pursuant to the Law on Medicines and Medical Devices.

— Import license (import approval for intervention) pursuant to the Law on Medicines and Medical Devices.
