… temporary penalty or permanent ban on the performance of particular activity has been pronounced;

— confirmation stating that no misdemeanour sanction — ban on the performance of the profession, activity or obligation, i.e. temporary ban on the performance of a particular activity has been pronounced with the effective verdict.

Економска и финансиска состојба:

— Balance sheets certified by a competent authority, i.e. audited balance sheets, or balance sheet excerpts where the publication of the balance sheet is required under the Law of the country where the bidder is registered;

— A statement of the overall turnover of the company (information on the profit and loss statement issued by the competent authority, i.e. audited profit and loss statement), for the last three business years for which such information is available, depending on the date on which the company was founded or started work and depending on the availability of such information.

Minimum criteria for determining the economic and financial status of the economic operator:

To have achieved a minimum total income of 30 000 000 MKD for the last 3 years in total.

Техничка и професионална способност:

2.5.2.1. Reference list of the bidder for accomplished experience in reconstruction

of public / street lighting including information on realized contracts in the last 5 years as of the deadline for submission of the bids, with values, dates, buyers (contracting authorities or economic operators) and mandatory submission of:

— at least 1 executed contract in the last 5 years counting from the deadline for submission of the bids in the area of the subject procurement-reconstruction of public / street lighting (the contract shall be submitted as a copy verified by the bidder — completely, not only the first and last page,) and

— evidence of satisfactory performance upon the attached contract, issued by the contracting authority / receiver that the contract works have been completed timely, properly and qualitatively (submitted as original document or a copy verified by the bidder).

— Samples of all types of LED lighting fixtures (1, 2 and 3) provided in the technical specification.

2.5.2.2. Statement by the responsible person of the bidder guaranteeing to the contracting authority that he disposes with professional and technical staff (regardless of whether the persons are regularly employed or by engaged with a contract of temporary employment) for the realization of the subject of the contract, namely with:

— at least 1 person from the field of electrical engineering (electrical technician or electrician),

— at least 1 expert with the title electrical engineer,

— at least 1 person to work with a crane,

who will be directly involved in the implementation of the agreement (the statement is to be submitted as an original or a copy,) and mandatory submission of:

2.5.2.2.1. Certificate of employees issued by the competent authority which mediates in employment (for example, the Employment agency in the Republic of Macedonia) or a List of registration/termination forms by compulsory social insurance business for a legal entity from the Agency of Employment or a Confirmation of paid contributions issued by a competent authority — if the people are regular employees with the economic operator), i.e., a Temporary service agreement or a Contract hiring professional / technical staff to deliver the contract upon announcement no.23-67/6 — if the persons are engaged by the economic operator — the documents are to be submitted in original or as copies verified by a signature from the bidder,

2.5.2.2.2. A copy of the diploma or certificate of completed education for at least 1 electrical technician or electrician and at least 1 expert of the title electrical engineer,

— the documents are to be submitted as a certified copy signed by the bidder,

2.5.2.2.3. For the person who will work with the crane a copy is submitted of the Medical certificate or Periodic/ directed / systematic medical examination with positive results, assessment of the working capacity (‘Able to work’) — the document must not be older than one year as of the deadline for submission of bids, and it is issued by an authorized health institution, and submitted as a copy verified by the bidder.

2.5.2.3. A statement of the technical equipment and capacity and other resources available to the bidder for the execution of the subject of the contract, by submitting evidence of meeting the minimum requirements, as follows:

— A relevant written valid proof / document (for example, a Purchase contract or an Agreement for technical support or a Report from a completed technical inspection of the vehicle) from which the contracting authority can clearly determine that the bidder has a special vehicle — crane with platform, with a height of lifting of minimum 12 m and that said vehicle will be available for the entire duration of the contract.

— Proof / document of disposing with terrain (light passenger or freight) vehicle for smooth performance of the works / tasks in the field (for example, if the vehicle is owned by the private bidder, only a copy is submitted of the driving license for the vehicle; if the vehicle is leased, a copy is attached of the leasing contract; if the vehicle has been made available to the bidder with technical support, the bidder submits a copy or the original contract for business technical support or a purchase agreement, etc.).

2.5.2.4. Notification on the elements of the contract which the economic operator intends to subcontract to third parties and the submission of the contract concluded with the subcontractor detailing the rights and obligations between the contracting parties. (submitted if a subcontractor is engaged).

Минимално ниво(а) на стандарди:

Minimum criteria needed for establishing the technical and professional condition of the economic operator:

1. To prove that he has experience in the area of the subject of procurement (reconstruction and maintenance of public/street lighting) and prove that they will incorporate lighting fixtures of appropriate quality according to the technical specifications.

2. To dispose, for the entire duration of the contract, with professional and technical staff and employees who will be directly involved in the implementation of the contract, as follows:

— at least 1 person from the field of electrical engineering (electrical technician or electrician),

— at least 1 expert with the title electrical engineer,

— at least 1 person to work with a crane,

regardless of whether the persons are regularly employed by the economic operator or engaged (with a Temporary service agreement) for the implementation of the contract.

3. To possess the necessary technical equipment for the realization of the contract, whether directly belonging to the economic operator or as technical support, i.e., to dispose with a minimum of:

— 1 special vehicle crane with a platform, with height of lifting of minimum 12 m.

— a working field (easy passenger or freight) vehicle that will enable easy terrain visit in order to perform the given tasks;

4. Notification on the elements of the contract which the economic operator intends to subcontract to third parties and the submission of the contract concluded with the subcontractor detailing the rights and obligations between the contracting parties (submitted if a subcontractor is engaged).

Извршување на договорот
Потребни депозити и гаранции:

1.As part of the bid, the economic operator must submit a bid security (guarantee of participation) in the amount of 3 % of the total bid value, excluding VAT, expressed in Macedonian currency — Macedonian denar / MKD

2. Condition for signing the contract with the winning bidder is providing a guarantee by the winning

tenderer for performance of the contract in the amount of 5 % (five percent) of the contract value. Detailed

information and formalities necessary for the guarantees are specified in the tender documentation which

Payment will be made after the completion of the works and technical acceptance of the objects at 60 equal instalments on the basis of submitted monthly invoices. Тhe contractor shall submit the invoices to the investor every month no later than the 5th of the month for the current month, at prices determined in contract. If the contractor is a foreign economic operator, the payment will be made in denars converted into foreign currency with the exchange rate of the National Bank of Macedonia on the payment date of the invoice value.

Any interested domestic and foreign legal or natural entity — bidder who is registered for activity that is related to

the subject of the contract for public procurement has the right to place a bid.

A group of bidders also has the right to place a bid (where the bid is prepared in accordance with

the conditions and requirements specified for a group of bidders in the tender documentation) without an

obligation for joining in appropriate legal form. The contracting authority will not require the group of bidders to

join in certain legal form if the group is selected as the winner of the procurement.

To prove their personal situation, Economic Operators shall submit the following documentation:

— statement of the economic operator stating that no effective verdict has been pronounced in the past five years for participation in criminal organization, corruption, fraud or money laundering;

— confirmation that no bankruptcy procedure has been initiated by a competent authority;

— confirmation that no liquidation procedure has been initiated by a competent authority;
