2.2. Personal status:

2.2.1. The contracting authority shall exclude from the procedure for awarding a public contract any economic operator:

— Within the last 5 years to a final verdict for participation in criminal organization, corruption, fraud or money laundering;

— Has imposed a penalty on participation in public tender procedures, the award of public procurement contracts and public-private partnership;

— Has imposed a temporary or permanent prohibition of professional activity;

— Which is in bankruptcy or liquidation proceedings;

— Failed to pay taxes and other public charges, unless the economic operator has been granted deferred payment of taxes, contributions and other public duties in accordance with special regulations and pays them regularly;

— It has a misdemeanour sanction prohibition of professional activity or duty, or prohibition to perform certain activity;

— Provides false information or fails to provide information requested by the contracting authority.

2.2.2. To prove its personal standing, the operator shall submit the following documents:

— A declaration by the economic operator that in the last 5 years he was rendered a verdict for participation in criminal organization, corruption, fraud or money laundering;

— Confirmation that no bankruptcy proceedings by a competent authority;

— Confirmation that no liquidation procedure by the competent authority;

— Confirmation of paid taxes and other public charges from the competent authority of the country where the economic operator is established;

— Certificate from the Registry of Penalties for Crimes committed by legal entities that were not imposed a…

… penalty on participation in public tender procedures, the award of public procurement contracts and public-private partnerships;

… temporary or permanent prohibition of professional activity;

— A certificate stating that there has not been imposed sanction ban on performing profession, activity or duty or prohibition to perform certain activity.

2.2.3. The statement from line 1 of subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4. Confirmation that no bankruptcy proceedings and liquidation proceedings, the certificate from the Registry of Penalties for Criminal Acts in lines 5 and 6 of subsection 2.2.2 shall be issued by the competent authorities in the country where it is registered. In the Republic of Macedonia competent body for issuing such certificates is the Central Registry of the Republic of Macedonia.

2.2.5. The certificate for paid taxes and other charges issued by the competent authority in the country is registered. In Macedonia, the body responsible for issuing this certificate is the Public Revenue Office.

2.2.6. The certificate from paragraph 7 of subsection 2.2.2 issued by the competent authority in the country is registered. In Macedonia, the body responsible for issuing this certificate is the Republic of Macedonia.

2.2.7. The documents in item 2.2.2 must not be older than six (6) months from the deadline for submission of bids.

The Commission will accept documents for determining the personal status issued after the date of public opening of bids, but no later than the date of the decision for selecting the best offer.

2.3. Ability to perform professional activity:

2.3.1. To prove the capability of doing professional activity, the economic operator should submit a document for registered activity as evidence that it is registered as a legal entity conducting activities related to the subject of the public contract or evidence that belongs to a professional association in accordance with the regulations of the country where it is registered.

— License B performer issued by the Ministry of Transport and Communications of the Republic of Macedonia.

2.4.2. The economic operator proves the fulfilment of the minimum requirements of subsection 2.4.1 by submitting:

— A description of the technical equipment which the economic operator;

— Statement on the technical staff regardless of whether they belong directly to the economic operator;

— Elements of the contract which the economic operator intends to subcontract to third parties.

2.4. Technical or professional ability:

2.4.1. To qualify as capable of performing the contract for public procurement in terms of its technical or professional ability, the economic operator should meet the following minimum requirements:

— Circular cutting asphalt and concrete, vibro-frog, backhoe, trucks min. 2, graders, finishers, large rubber roller, a small metal roller, a large metal drum, have owned or contracted for use of asphalt base (for uninterrupted supply of asphalt on the subject of procurement). (Subject to minimum requirements relating to each part of the supply separately).

— Bidder to hire a minimum of 8 workers and 1 person with authority B (subject to minimum requirements relating to each part of the supply separately).

Потребни депозити и гаранции:

1.8. Performance Guarantee Agreement:

1.8.1. A condition for signing the contract with the winning bidder is providing a guarantee by the most favourable bidder for performance of the contract in the amount of 15 % of the contract value.

1.8.2. The guarantee of item 1.8.1 is delivered in the form of bank guarantee in writing. The guarantee should be submitted in original form. Copies are not acceptable.

1.8.3. The performance guarantee of the contract will be valid until the complete fulfilment of the agreement. The contracting authority for the selection of the best bidder additionally determine the end date of the guarantee.

1.8.4. The bank guarantee for performance of the contract will be in the currency of the contract.

1.8.5. The performance guarantee of the contract shall be issued by a bank.

1.8.6. The performance guarantee of the contract the selected best bidder submitted after receiving notice of the election within 15 days of the notification received, before signing the contract.

1.8.7. The performance guarantee shall be submitted within the specified period, and by mail or in person contact in Section 1.2.2) of the tender documentation.

1.8.8. The performance guarantee of the contract shall be activated if the contractor fails to meet an obligation of the public procurement in the given time frame, which shall notify the contractor. The collection of performance guarantee of the contract, the contracting authority shall publish EPPS negative reference.

1.8.9. If the public contract is fully implemented as agreed, the bank guarantee contract performance contracting authority shall return to the contractor within 14 days of completion of the contract.

1.8.10. The performance guarantee of the contract the contracting authority shall return to the contractor by mail, in person at the office of the economic operator or in person at the headquarters of the contracting authority.

4.6. Bid Guarantee:

4.6.1. As part of the bid, the economic operator must provide a tender guarantee (guarantee share) of at least 3 % of the total value of the offer without VAT.

4.6.2. The guarantee is in the form of a bank guarantee. The contracting authority shall accept all banks.

4.6.3. The guarantee should be submitted in original. Copies are not acceptable. The guarantee must be valid for at least 30 days after the expiry of the offer. Any offer that does not include a guarantee or include a guarantee that is not in accordance with the requirements of the tender documentation will be rejected by the contracting authority as unacceptable.

4.6.4. The guarantee of unsuccessful bidders shall be returned within 7 days after signing the contract with the most favourable bidder.

4.6.5. The bid guarantee may be invoked if the bidder withdraws its offer before the expiry of the period of its validity, does not accept the correction of arithmetic errors by the Commission, did not sign the public procurement contract in accordance with the terms of the tender documentation and provide a performance guarantee of the contract.

1.4. Method of performance:

1.4.1. The Contractor shall be obliged, subject to contract to perform in accordance with the technical regulations and requirements prescribed by the contracting authority with a minimal amount of delivery of 5 tons of asphalt.

1.5. Differences in price (price correction):

1.5.1. Not anticipated correction in prices, i.e. the prices quoted in the bid of the most favourable bidder shall remain fixed for the entire duration of the public contract.

1.6. Payment:

1.6.1. Payment will be made by transfer deferred within 120 days after the submission of the situation.

1.13.2. The right to submit a bid any interested domestic and foreign legal entity, registered for conducting activities related to the subject of the public contract and who has taken tender documentation by the contracting authority akoja available to any interested operator ekonomsi simultaneously through EPPS with the publication of the contract notice.

1.13.3. The right to submit a bid has a group of bidders with no obligation to join in appropriate legal form. The contracting authority will require the group of bidders to join in certain legal form if it is selected as the winner of the procurement.

1.13.4. Integral part of the group offer a contract to submit a joint tender by which members of the group of economic operators themselves and to the contracting authority to carry out public contract. This agreement must contain the following information: member of the group who will be responsible for the group or will submit the bid and will represent the group, member of the group that on behalf of the group of economic operators to sign the public procurement member of the group who will issue an invoice and account for the payments, a brief description of the responsibilities of each member of the group of economic operators to carry out the contract.

1.13.5. All members of the group of bidders are individually and severally liable to the contracting authority for the execution of their duties. The contracting authority will communicate with the representative of the group of bidders.

6.3. Legal protection:

6.3.1. Any bidder who has a legal interest in obtaining the public contract and who has suffered or could suffer damage by an alleged violation of the provisions of the Public Procurement Law, may seek legal protection against the decisions, actions or failure to take action by the contracting authority in the procedure for awarding a public contract. The right to an appeal procedure that ends with an electronic auction in terms of determining the ability of the bidders and full evaluation of the initial offer is accomplished by making the decision for selecting the best bidder or annulment.

6.3.1. The appeal shall be filed within 8 days from the day of:

— The receipt of the minutes of the conducted technical dialogue regarding the actions or failures to undertake actions related to the implementation of the technical dialogue;

— The announcement of the award of a public contract in terms of information, actions or failures to undertake actions under the contract notice;

— Opening of tenders in respect of acts or failures to undertake actions related to the tender documentation, i.e. the bid opening;

— The deadline for a decision on selection or cancellation of the procedure in accordance with Article 162 Paragraph 2 of the Public Procurement Act in terms of admission for a decision on selection or cancellation of the procedure in the period concerned;

— Receiving the decision which determines the individual right from the procedure for awarding a public procurement in relation to determining the capability of applications for participation or evaluation of bids; or

— Awareness of illegal procedure for awarding a public contract, no later than 1 year from the date of completing the procedure.

6.3.2. The economic operator failing to lodge an appeal in respect of the provisions of sub-section 6.3.1, there is no right of appeal at a later stage of the proceedings on the same legal grounds.

6.3.3 The complaint should contain the following elements:

— Data on the complainant (name, name of the economic operator, address of residence and location);

— Agent or proxy;

— Name and address of the contracting authority;

— Number and date of the procedure for awarding a public contract and information about the advertisement for awarding a public contract;

— Number and date of the decision to select the best offer, cancelling the procedure or other decisions of the contracting authority;

— Information about actions or failures to undertake actions by the contracting authority;

— A description of the actual situation,

— A description of the irregularities and their explanation,

— Proposed evidence;

— Appeal and / or request compensation for the costs of the proceedings; and

— Signature of the authorized person and seal.

6.3.4. The applicant shall submit proof of payment of the fee for the procedure.

6.3.5. The appellant is not located in the Republic of Macedonia is obliged to appoint a proxy to receive letters.

6.3.6. The appeal shall be filed with the State Commission. The appeal shall be submitted in person or by registered mail simultaneously to the contracting authority and the State Commission. The date of filing of the appeal by registered mail is considered day of filing. In case the person, the contracting authority shall issue to the applicant about the time of admission.

6.3.7. In the procedure before the State Commission, the declarant, besides the administrative fee, and the fee for conducting the procedure depending on the amount of the bid, including:

— Up to 20 000 EUR in counter-fee of 100 EUR in MKD,

— From 20 000 EUR to 100 000 EUR in counter-fee of 200 EUR in MKD,

— From 100 000 EUR to 200 000 EUR in counter-fee of 300 EUR or equivalent,

— Over 200 000 EUR in counter-fee of 400 EUR in MKD.

6.3.8. In the absence of an offer, the fee for the procedure is calculated based on the estimated value of public procurement, the State Commission shall notify the application fee and the deadline within which to submit proof of payment.

6.3.9. The fee for the procedure is the budget of the Republic of Macedonia.

6.3.10. The contracting authority shall not sign the contract for procurement and for its execution within 12 days from the date of receiving the decision which determines the individual right in the procedure for awarding a public contract, except for:

— In cases of Articles 99 and 198 of this Law,

— In the event that the procedure only 1 tenderer whose tender winner, or

— In the case of individual procurement contracts based on a framework agreement.
