2.3.1. In order to prove the capacity to perform a professional activity the economic operator submits:

— Document for registered activity as a prove that it is registered as a natural or legal entity for performing the activity connected with the subject of the Public Procurement Agreement or a prove that it belongs to a suitable professional association according to the regulations in the country where it has been registered and Current Status not older than 6 months;

2.3.2 Evidence issued by competent authority for the fulfilment of the specific conditions for conducting activities prescribed under law relating to the subject of the contract:

— A copy of License ‘A’ for contractors from 1

Економска и финансиска состојба:

— To have achieved positive financial performance in the last 3 years (2012, 2013 and 2013).

— To have achieved a total annual turnover in the last 3 years (2012, 2013 and 2014) of at least 950 000 000 MKD.

Минимално ниво(а) на стандарди:

— Balance sheets certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets, where publication of the balance sheet is required under the law of the country in which the economic operator is established;

— Statement of the total turnover (data from the income statement issued by a competent authority, i.e. audited income statement) and, where appropriate, of turnover in the area covered by the contract and the maximum of the last 3 financial years for which such data are available, depending on the date on which the company was founded or started work and depending on the availability of such information.

Техничка и професионална способност:

2.5.1. In order to qualify as capable to execute the Agreement from the aspect of its technical or professional capacity, the economic operator shall fulfil the following minimal conditions:

— To have at least a hundred (100) employees out of which:

i. Minimum 2 (two) Civil engineers with the Licence ‘A’ performance engineer;

ii. Minimum 1 (one) Geometer;

iii. Minimum 4 (four) Construction technicians;

iv. Minimum 4 (four) Machinists; and

v. Minimum 4 (four) drivers of heavy vehicles.

— To have the following equipment:

i. Possess asphalt base;

ii. Minimum 1 (one)grader;

iii. Minimum 3 (three) rollers;

iv. Minimum 3 (three) excavators;

v. Minimum 8 (eight) tipper trucks of which at least 5 loads exceeding 20 tons;

vi. Minimum 5 (five) heavy vehicles;

vii. Minimum 3 (three) Trenchers;

viii. Machine for cutting asphalt; and

ix. Emulsion nozzle.

Минимално ниво(а) на стандарди:

2.5.2. The Economic Operator proves the fulfilment of the minimal condition from sub-Article 2.5.1 by submitting:

— Copy of concluded Contracts of the same or similar subject with the subject of the procurement and a certificate for conducted works of good quality;

— A copy of Licence ‘А’ contractor for construction of the 1

— List of works executed in the last 3 years, with values, dates, buyers (contracting authorities or economic operators);

— Statement on the technical staff and technical bodies regardless of whether they belong directly to the economic operator;

— A list of all employees issued by the Employment Agency not older than 15 (fifteen) days from the date of bid submission;

— Copy of diploma or certificate, a copy of the Licence ‘A’ of the performance engineering and CV of the construction engineer for Performance;

— Copy of diploma for construction technicians and geometer;

— Valid documents for disposing with machinists and drivers of heavy vehicles and a copy of M1/M2 for the same;

— A description of the technical equipment of the economic operator, measures to ensure quality and its equipment and capacity for testing and research;

— Valid evidence for disposal with equipment;

— Reports of elements of the Agreement which the economic operator intends to subcontract to third parties.

Извршување на договорот
Потребни депозити и гаранции:

7.5. Guarantee for quality execution of the contract:

7.5.1. Economic Operator within 5 days after signing the agreement at its own expense and risk, must provide an unconditional and irrevocable bank guarantee for quality performance of the contract in the amount of 10 % of the contract value. The bank guarantee at the same time is a condition set by the Purchaser to introduce the Contractor with the work. This warranty will be in favour of the contracting authority.

7.5.2. The guarantee from item 7.5.1 is submitted in the form of a bank guarantee in a written form. The guarantee needs to be submitted as an original form. Copies are not allowed.

7.5.3. The bank guarantee for quality implementation of the contract shall be valid till the final realization of the contract. The contracting authority after the made selection of the most suitable bidder additionally sets the final validity date of the guarantee.

7.5.4. The bank guarantee for quality implementation of the contract shall be in the currency indicated in the contract.

7.5.5. The guarantee for the quality performance of the contract is submitted in the defined deadline, personally to the contact person from item 1.2.2 from the tender documentation.

7.5.6. The guarantee for quality implementation of the contract shall be collected if the contractor does not meet any of the liabilities indicated in the public procurement contract within the maturity period, and it shall notify the contractor in writing. If the guarantee for quality implementation of the contract is collected, the contracting authority shall publish a negative reference to ESPP.

7.5.8. In case the deadline for contract finalization is extended or it has an increased value, the Contractor should appropriately extend the validity and the value of the guarantee for quality performance of the contract.

7.5.9. If the public procurement contract is fully implemented in accordance with the contract, the contracting authority shall return the bank guarantee for quality implementation of the contract to the contractor within 14 days after the technical acceptance given by the commission formed by the contracting authority.

7.5.10. The contracting authority shall return the bank guarantee for quality implementation of the contract to the contractor personally at the head office of the contracting authority or at the head office of the contracting authority.
