IV.1.6) Incorporation of group of economic operators in an appropriate legal form for implementation of the contract (following the most favourable bid selection): No.

2.1. Method of establishing capacity:

2.1.1. The economic operator, along with the bid, shall also submit accompanying documentation offering proof of the following:

— Personal status;

— Capacity to carry out business activity;

— Economic and financial status;

— Technical or professional capacity;

2.1.2. The required documentation shall be submitted in original or a copy verified by the economic operator or group of bides, affixing the seal and signature of the authorized person, bearing an indication ‘True to the original’;

2.1.3. In the course of inspecting the completeness and validity of documentation for establishing the capacity of the economic operator and during evaluation of bids, the Committee can ask of the bidder to clarify or supplement the documentation for evidencing capacity if there are no serious deviations in the required documentation;

2.1.4. The demanded clarification shall be submitted by the economic operator in within the time-line designated by the Contracting Authority;

2.1.5. No modifications in the bid, except for corrections of arithmetical errors may be requested, offered or allowed by the commission or the economic operator;

2.1.6. In case of a group of economic operators, each member of the group shall separately evidence their personal status and their capacity to carry put business activity.

2.2. Personal status:

2.2.1. The Contracting authority shall exclude any economic operator from the procedure for awarding a public procurement contract if:

An effective Court decision for participation in criminal organization, corruption, fraud or money laundering was rendered in the past 5 years;

A secondary penalty — ban on participation in public call procedures, awarding public procurement contracts and contracts on public-private partnership has been pronounced;

A secondary penalty — temporary or permanent interdiction to carry out particular business activity has been pronounced;

The economic operator is in bankruptcy or liquidation procedure;

The economic operator has unsettled taxes, contributions and other public duties, with the exception of cases in which the economic operator has been granted deferred payment of taxes, contributions or other public duties and prompt settlement thereof in accordance with the respective regulations;

A misdemeanour sanction has been pronounced — ban on performance of profession, action or responsibility, i.e. temporary ban on the performance of particular action; and

The economic operator has given false data or has failed to submit the data requested by the Contracting Authority.

2.2.2. For the purpose of proving its personal status the economic operator shall submit the following documents:

Statement of the economic operator that no effective Court decision for participation in criminal organization, corruption, fraud or money laundering was rendered in the past 5 years;

Certificate by the competent authority that no…

… bankruptcy procedure has been initiated;

… liquidation procedure has been initiated;

Certificate on settled taxes, contributions and other public duties by the competent authority from the country where the economic operator is registered;

Certificate by the Register of Penalties for Crimes Committed by Legal Persons stating that no…

… secondary penalty — temporary or permanent ban has been pronounced for participation in invitation to tender procedures, awarding of a public procurement contracts or private-public partnership contract;

… minor penalty — temporary or permanent interdiction on carrying out particular business activity has been pronounced; and

Certificate that no misdemeanour sanction — interdiction on carrying out profession, action or responsibility, i.e. temporary interdiction on carrying out particular business activity, has been pronounced with an effective Court decision.

2.2.3. The statement from indent 1, sub item 2.2.2 shall be prepared and signed by the economic operator, and it will not require verification by a competent authority.

2.2.4. The certificates stating that no bankruptcy and liquidation procedure has been initiated, as well as the certificates by the Register of Penalties for Criminal Acts Committed by Legal Persons of indents 5 and 6, sub item 2.2.2 shall be issued by the competent authorities in the country in which the economic operator has been registered. In the Republic of Macedonia the competent authority for issuance of the aforesaid statements is the Central Register of the Republic of Macedonia.

2.2.5. The certificate on settled taxes, contributions and other public duties shall be issued by the competent authority from the country in which the economic operator has been registered. In the Republic of Macedonia the competent authority for issuance of the aforesaid receipt is the Public Revenue Office.

2.2.6. The certificate of line 7, sub-item 2.2.2 shall be issued by the competent authority in the country in which the economic operator has been registered. In the Republic of Macedonia the competent authority for issuance of the aforesaid statement is the Central Register of the Republic of Macedonia.

2.2.7. The documents of sub item 2.2.2 shall not be older than 6 (six) months calculated from the final deadline for submission of the tenders calculated backwards.

2.2.8. If the country in which the economic operator has been registered, does not issue the documents specified in sub item 2.2.2 or if they do not encompass all aforementioned cases, the economic operator can submit a statement verified by the competent authority.

2.3. Capacity to carry out business activity:

2.3.1. In order to prove its capacity to carry out business activity, the economic operator shall submit a document of registered activity as proof that it has been registered as a physical or legal party for carrying out an activity related to the subject of procurement or evidence of participation in a respective professional association in accordance with the regulations of the country of registration.

This document shall be submitted either in original or a copy verified by the economic operator to be true to the original.

2.3.2. Evidence issued by a competent authority on meeting the special conditions for carrying out business activity, as regulated under the law, and related to the subject of procurement:

For part 1: License for organization of transport of goods and/or passengers in national and international road traffic;

For part 2: Approval for customs clearance agency issued by a competent state authority.

Економска и финансиска состојба:

2.4.1. In order to qualify as competent for execution of the respective public procurement contract from aspect of economic and financial status, the economic operator shall meet the following minimum requirements:

For Part 1:

— Holding of a CMR insurance, the minimum amount of which is 200 0000 EUR per vehicle;

For Part 2:

— Provision of deferred payment of the customs clearance debt, the minimum amount of which is 6 000 000 MKD.

Минимално ниво(а) на стандарди:

The economic operator shall prove the meeting of the minimum requirements specified in sub-section 2.4.1 or 2.4.2 by submitting the following:

For Part 1:

— Statement by the economic operator that it holds a CMR insurance, the minimum amount of which is 200 000 EUR per vehicle;

For Part 2:

— Bank guarantee for deferred payment of the customs clearance debt, the minimum amount of which is 6 000 000 MKD.

Техничка и професионална способност:

2.5.1. In order to qualify as capable of executing the respective public procurement contract from point of view of its technical or professional capacity, the economic operator shall meet the following minimum requirements:

For Part 1:

— Experience in previously successfully realized deliveries;

— Description of the technical equipment, the organizational structure, quality assurance measures and equipment for delivery of services (GPRS device for cargo tracking, vehicle equipment — cargo security belts, minimum of 20, driver's safety equipment, vehicle safety equipment).

For Part 2:

— Detailed description of the forwarding services: export and import goods customs clearance, storing and distribution of goods and other services (consulting, etc.);

— It shall have an own promise for temporary storage of goods being in customs procedure, with ban approval to store ADR goods in such premise and own public bonded stock;

— Description of the technical equipment and capacity, the organizational structure, quality assurance measures and equipment for delivery of services;

— Authorized person for receipt of the goods in the temporary storage premise;

— At least 5 employed licensed customs agents.

Минимално ниво(а) на стандарди:

2.5.2. The economic operator shall confirm the fulfilment of the minimum conditions of sub-item 2.5.1 by submitting the following:

— Reference list of transporting services in the past 3 years with values, dates and buyers thereof;

— Statement on the description of the technical equipment, the organizational structure, quality assurance measures and equipment for delivery of services (GPRS device for cargo tracking, vehicle equipment — cargo security belts, minimum of 20, driver's safety equipment, vehicle safety equipment);

— Reference list of forwarding services in the past 3 years with values, dates and buyers thereof;

— Certificate of export and import goods customs clearance, storing and distribution of goods and other services (consulting, etc.);

— Approval that it has an own promise for temporary storage of goods being in customs procedure, with ban approval to store ADR goods in such premise and own public bonded stock;

— Statement regarding the description of the technical equipment and capacity, the organizational structure, quality assurance measures and equipment for delivery of services;

— Approval of an authorized person for receipt of the goods in the temporary storage premise;

— Statement about at least 5 employed licensed customs agents.

2.5.3. The statements subject of sub-item 2.5.2 shall be prepared and signed by the economic operator and they do not need to be verified by the competent authority.

2.5.4. The technical and professional capacity of the economic operator can be supported by another entity, regardless of the legal connections between the economic operator and that entity. If the economic operator shall prove its technical and professional capacity by referring to the support of the aforesaid another entity, the economic operator shall validate that support by evidence stating that the aforementioned party shall make available to the economic operator the adequate technical and professional resources. No effective Court order for participation in a criminal organization, corruption, fraud or money laundering should be pronounced against the entity providing the technical or professional support.

2.5.5. If the economic operators submit a tender as a group of economic operators, the technical and professional capacity shall be established by considering the resources of all members of the group. If the group of economic operators acts with the technical and professional support of a third entity, or third entities, the technical and professional capacity shall be established according to the aforementioned.
