The contracting authority shall exclude from the procedure for awarding a public contract any economic operator:
— Within the last 5 years was effective sentence for participation in a criminal organization, corruption, fraud or money laundering;
— Has imposed a penalty on participation in public bidding procedures, awarding public procurement contracts and contracts for public-private partnership;
— Has imposed a temporary or permanent ban on performing certain activities;
— Which is in bankruptcy or liquidation proceedings;
— Failed to pay taxes and other public charges, unless the economic operator has been granted deferred payment of taxes, contributions or other public duties in accordance with special regulations and pays them regularly;
— It has a misdemeanor sanction prohibition to perform a profession, activity or duty, or prohibition to perform certain activity
— Gives false information or fails to provide information requested by the contracting authority.
To prove its personal standing, the operator shall submit the following documents:
— Statement by the economic operator that in the last 5 years he final verdict for participation in criminal organization, corruption, fraud or money laundering;
— Confirmation that no bankruptcy proceedings by a competent authority;
— Confirmation that no liquidation procedure by the competent authority;
— Confirmation of paid taxes and other public charges from the competent authority of the country where the economic operator is established;
— Certificate from the Registry of penalties for committed crimes by legal entities that…
… imposed with a ban on participation in public bidding procedures, awarding public procurement contracts and contracts for public-private partnership;
… has been imposed with a temporary or permanent ban on performing certain activities;
— A certificate stating that there has not been imposed a prohibition on performing a profession, activity or duty, or prohibition to perform certain activity.
The statement from line 1, sub-section 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.
Confirm that no bankruptcy proceedings and liquidation procedure, the certificate from the registry of penalties for criminal acts in lines 5 and 6 of subsection 2.2.2 are issued by competent authorities in the country is registered. In Macedonia the competent authority for issuing such certificates is the Central Registry of the Republic of Macedonia.

Confirmation of paid taxes and other charges issued by the competent authority in the country is registered. In Macedonia the competent authority for issuing such certificates is the Public Revenue Office.
The certificate from paragraph 7 of subsection 2.2.2 issued by the competent authority in the country is registered. In Macedonia the competent authority for issuing such certificates is the Central Registry of the Republic of Macedonia.
The documents in item 2.2.2 must not be older than 6 months from the deadline for submission of bids.
If the country where the economic operator is registered does not issue the documents referred to in item 2.2.2 or if they do not cover all the above cases, the economic operator may submit a statement certified by a competent authority.
Извршување на договорот
Потребни депозити и гаранции:
A condition for signing the contract with the winning tenderer is providing a guarantee by the selected best bidder for performance of the contract in the amount of 5 % of the contract value excluding VAT.
The guarantee referred to in point 7.5.1 shall be submitted in the form of a bank guarantee in writing. The guarantee should be submitted in original form. Copies are not accepted.
The performance guarantee of the contract will be valid until the completion of contract. The contracting authority in the selection of the best bidder additionally determine the date of the guarantee.
The bank guarantee for quality performance of the contract will be in the currency of the contract.
The performance guarantee of the contract must be issued by a bank.
The performance guarantee of the contract the selected best bidder shall be submitted within 15 days after receiving notice of the choice before signing the contract.
The performance guarantee shall be submitted within the specified period, as follows: in person contact in point 1.2.2 of the tender documentation.
The performance guarantee of the contract will be charged if the contractor does not fulfil some of the obligations of the contract within the due deadline, which shall notify the contractor. The collection of performance guarantee of the contract, the contracting authority will publish the ESPP a negative reference. For payment of the bank guarantee for quality performance of the contract and the release of negative reference of ESPN, the contractor may initiate proceedings before a competent court.

If the contract is fully implemented as agreed, the bank guarantee for the contract performance contracting shall be returned to the contractor within 14 days of completion of contract performance guarantee of the contract contracting authority returns to the contractor by mail, in person at the office of the economic operator or person at the headquarters of the contracting authority.
