2. Personal condition.

2.2.1. The contracting authority shall exclude any economic operator from the proceedings for awarding a public contract in the following cases:

— it has been rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— it has been sentenced with a minor penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership;

— it has been sentenced with a minor penalty for temporary or permanent prohibition to perform a specific activity;

— it is in bankruptcy or liquidation proceedings;

— it has unpaid taxes and other public charges, unless the economic operator is authorized to make deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and if he is regular payer;

— prohibition sanction to perform professional activity or duty is pronounced to the economic operator, i.e. temporary prohibition for performing professional activity; and

— it provides false information or fails to submit the information requested by the contracting authority.

2.2.2. In order to prove its personal condition, the economic operator shall submit the following documents:

— a declaration by the economic operator that he was not rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— confirmation that there are no bankruptcy proceedings undertaken by the competent authority;

— confirmation that there is no liquidation procedure undertaken by the competent authority;

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— certificate from the Registry of penalties for crimes committed by legal persons that minor penalty…

… — ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership — has not been imposed;

… for temporary or permanent prohibition of a specific activity has not been imposed;

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional activity or duty, i.e. temporary prohibition for performing specific activity.

2.2.3. The statement in indent 1 of subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4. The confirmations that there are no bankruptcy proceedings and liquidation proceedings, as well as the certificates from the Register of penalties for criminal acts in indents 5 and 6 of subsection 2.2.2, shall be issued by competent authorities in the country in which the economic operator is established. In the Republic of Macedonia, the body responsible for issuing these certificates is the Central Registry of the Republic of Macedonia.

2.2.5. The receipt for paid taxes, contributions and other charges shall be issued by a competent authority of the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue such certificates is the Public Revenue Office.

2.2.6. The receipt in indent 7 of subsection 2.2.2 shall be issued by the competent authority in the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue this certificate is the Central Registry of the Republic of Macedonia.

2.2.7. The documents referred to in sub-item 2.2.2 must not be older than six (6) months from the deadline for submission of bids.

2.2.8. If the country in which the economic operator is registered does not issue the documents referred to in sub-item 2.2.2 or if they do not encompass all the cases mentioned above, the economic operator may submit a statement certified by a competent authority.

2.3. Ability to perform professional activity.

2.3.1. In order to demonstrate the ability to perform professional activity, the economic operator should submit a document for registered activity, that it is registered as a natural or legal entity for conducting activities related to the subject of the contract for public procurement, or proof that it belongs to a professional association in accordance with the regulations of the country in which it is registered, i.e. DRA form.

Pursuant to article 148 paragraph 2 of the Law on Public Procurements upon determining the ability of economic operators to perform their professional activity, the contracting body shall also request a proof issued by an authorized body that they fulfil the special conditions for performing of their activities that are prescribed by law, which refer to the subject of the contract, and in this specific case that is: License A for contractor.

A foreign legal entity needs to obtain a certificate for the performance of the works that are subject to the public procurement, i.e., to perform first-category constructions, issued by the state administration responsible for the affairs of spatial management — Department for Transport and Communications, in accordance with the Law on Construction.

Економска и финансиска состојба:

2.4. Economic and financial condition.

2.4.1. In order to qualify as capable of performing the contract for procurement from the aspect of its economic and financial situation, the economic operator must meet the following minimum requirements:

— To have a total turnover of at least 100 000 000 MKD for each of the last 3 years.

2.4.2. If the economic operator has been performing the activity for a period shorter than 3 years, the minimum requirement necessary to determine the economic and financial status is for the economic operator to have fulfilled the requirement under sub-item 2.4.1 for the years for which such data is available.

2.4.3. The economic operator shall prove the fulfilment of the minimum requirements stipulated in item 2.4.1 or 2.4.2 by submitting the following:

— statement from the total turnover of the company (data from the income statement issued by the competent authority, i.e. audited income statement) and, where appropriate, from the turnover in the area covered by the public procurement contract for the last 3 financial years for which such data are available, depending on the date on which the undertaking was set up or the work commenced, and depending on the availability of such information.

2.4.3. The economic operator shall prove the fulfilment of the minimum requirements stipulated in item 2.4.1 or 2.4.2 by submitting the following:

Техничка и професионална способност:

2.5. Technical or professional capability.

2.5.1. In order to qualify as capable for performing the subjected contract for procurement in terms of its technical or professional capability, the economic operator must meet the following minimum conditions:

— To have completed at least 1 (one) project of same or similar kind within the last 5 years.

Similar projects shall be considered as pipelines of similar size and material, siphons, channels.

— to dispose with the following minimum equipment:

— at least 2 excavators with a capacity of at least 2,5 m³/h;

— at least 2 bulldozers with a capacity of at least 3,0 m³/h;

— at least 2 transport vehicles — trucks with a carrying capacity of not less than 20 tons;

— vibro compactors for ground material;

— appropriate equipment for the installation of steel pipes (crane, jack fuses for fixing pipes, welding machines, apparatus for protection upon welding);

— control equipment for the welding of the pipes;

— equipment for installation of PE pipes (butt welding equipment for pipes or as fitting for the installation);

— equipment for the construction of concrete works (concrete mixer, formwork, reinforcing chair).

The economic operator have/ dispose with:

— at least 1 civil engineer with authorization A for performance, appointed as the head of the construction site;

— at least 2 certified welders.

2.5.2. The economic operator shall prove the fulfilment of the minimum requirements in sub-item 2.5.1 by submitting the following:

— A list of works completed in the last 5 (five) years, by submitting certificates for satisfactory performance of the main works, including values, dates, location of the performance of the works, and statements whether the works were performed in accordance with the rules for business operations, as well as if the works are completed in accordance with the rules.

— Statement on the technical equipment that is available to the economic operator for conducting the specific works.

— Statement on the technical staff engaged and the technical bodies, regardless of whether they belong directly to the economic operator or were engaged on a contract basis, by submitting an authorization A for the engineer for performance in the relevant field, issued by the Chamber of Authorized Architects and Engineers of the Republic of Macedonia. For foreign bidders, an authorization A needs to be submitted for the construction engineer, issued by an institution of their country of origin, which should be confirmed by the Chamber of Authorized Architects and Engineers of the Republic of Macedonia.

— Report on the elements of the contract which the economic operator intends to assign to a sub-contractor.

2.6. Standards for quality systems:

2.6.1. To qualify as capable of performing the subject contract on public procurement in terms of standards for quality systems, the economic operator must meet the following standards:

— to have ISO standard for quality system, a valid certificate for proof of quality, issued by competent independent institutions.

2.6.2. The economic operator proves the fulfillment of the standards of sub-item 2.6.1 by submitting:

— Valid certificate of quality system ISO 9001/2008.

2.7. Environmental Management Standards.

2.7.1. To qualify as capable of performing the subject contract on public procurement in terms of environmental management standards, the economic operator must meet the following standards:

— To have ISO standard for environmental management.

2.7.2. The economic operator proves the fulfilment of the standards of sub-item 2.7.1 by submitting:

— A valid certificate ISO 14001/2004.

2.6.2. The economic operator proves the fulfilment of the standards of sub-item 2.6.1 by submitting:

— Valid certificate of quality system ISO 9001/2008.

2.7. Environmental Management Standards

2.7.1. To qualify as capable of performing the subject contract on public procurement in terms of environmental management standards, the economic operator must meet the following standards:

— To have ISO standard for environmental management.
