Capacity of the economic operators

2.1 Means of verifying the capacity of the economic operator for LOT 1 — MOTOR

Fuels, diesel fuel

Along with their bid, the economic operator has to provide further documentation that shall

verify their:

— individual capacity,

— capacity to perform professional activity,

— economic and financial capacity,

— technical and professional capacity.

2.1.2 The required documentation has to be submitted in original form or as a ‘True

to the original’ copy certified by the economic operator and signed by an authorised

person.

2.1.3 When assessing whether the documentation that verifies the capacity of the

economic operator is complete and valid, and when evaluating the bid, the committee asks

the bidders to clarify or complete the documents that verify their capacity within five

working days [the time period for clarification and completion must not be less than five working days

starting from the bid submission deadline, that is, ten working days for procurements with an estimated value

of over the equivalent of one million euro in MKD, excluding VAT ].

2.1.4 The economic operator submits the requested clarification in writing within five

days [set by the public procurement committee and must not be less than five working days, that is, ten

working days for procurements with an estimated value of over the equivalent of one million euro in MKD,

excluding VAT], starting from the day the economic operator receives the request.

2.1.5 No changes in the bid, except for correction of arithmetical mistakes are to be

requested, offered or allowed by the committee or the economic operator.

2.1.6 Should there be a group of economic operators, all members of the group shall

prove their individual capacity and the capacity to perform professional activity.

Standard tender documentation for procurement of motor fuel,

diesel fuel and liquefied petroleum gas

I criteria for determing the capacity of the economic operators

1.1 Individual capacity

The contracting authority shall exclude from the procedure for awarding a

public procurement contract any economic operator that:

— in the course of the last 5 years has had an effective court decision passed against

them for participating in a criminal organisation, corruption, fraud, or money-laundering;

— has had а secondary penalty of prohibition to participate in public call procedures,

be awarded public procurement contracts and public private partnership contracts, passed

against them;

— has had a secondary penalty of temporary or permanent prohibition to perform

individual activity passed against them;

— has bankruptcy proceedings or liquidation procedure underway;

— has back taxes, back contributions and other public charges, except in case when

the economic operator has been approved to obtain deferred payment of taxes,

contributions and other public charges in accordance with the appropriate regulations, and

regularly defrays those charges;

— has a misdemeanour sanction passed against them — prohibition to perform

profession, activity or other duty, or temporary prohibition to perform certain activity, and

— has given false data or has not submitted the data requested by the contracting

authority.

In order to verify their individual capacity, the economic operator has

to submit the following documents:

— a statement that no effective court decision has been passed against the economic

operator in the course of the last 5 years for participating in a criminal organisation,

corruption, fraud and money- laundering;

— a certificate stating that no bankruptcy proceedings are underway, issued by a competent

authority;

— a certificate stating that no liquidation procedure is underway, issued by a competent

— a certificate of paid taxes, contributions and other public charges, issued by the

competent authority of the country where the economic operator is registered;

— a certificate from the Register of penalties for committed crimes by legal persons, stating

that no secondary penalty of prohibition to participate in public call procedures, be awarded

public procurement contracts and public private partnership contracts has been passed

against the economic operator;

that no secondary penalty of temporary or permanent prohibition to perform individual

activity has been passed against the economic operator;

— a certificate stating that no effective court decision — misdemeanor sanction has been

passed against the economic operator — prohibition to perform profession, activity or other

duty, or temporary prohibition to perform certain activity.

The statement provided by the economic operator that no effective court decision

has been passed against them in the course of the last 5 years for participating in a

criminal organisation, corruption, fraud and money- laundering, is prepared and signed by

the economic operators themselves and it need not be certified by a competent authority.

The certificates of absence of bankruptcy proceedings and liquidation procedure, as

well as the certificates from the Register of penalties for committed crimes by legal

persons, stating that no secondary penalty of prohibition to participate in public call

procedures, be awarded public procurement contracts and public private partnership

contracts has been passed against the economic operator, as well as the ones stating that

no secondary penalty of temporary or permanent prohibition to perform individual activity

has been passed against the economic operators, are issued by a competent authority of

the country where the economic operator is registered. In the Republic of Macedonia, the

competent authority responsible for issuing these certificates is the Central Register of the

Republic of Macedonia.

The certificate of paid taxes, contributions and other charges is issued by a

competent authority of the country where the economic operator is registered. In the

Republic of Macedonia, the competent authority responsible for issuing this certificate is

the Public Revenue Office.

The certificate stating that no effective court decision — misdemeanour sanction

has been passed against the economic operator — prohibition to perform profession,

activity or other duty, or temporary prohibition to perform certain activity, is issued by a

the Central Register of the Republic of Macedonia.

The aforementioned documents must not be older than six months, starting from

the final bid submission deadline.

If the country where the economic operator is registered does not issue the

aforementioned documents, or if they do not encompass the aforementioned instances,

the economic operator may submit a statement certified by a competent authority.

1.2 Capacity to perform professional activity

In order to verify their capacity to perform professional activity, the economic

operator has to submit a document for registered activity, issued by the Central Register of

the Republic of Macedonia, as verification that they are registered as a natural or legal

person that performs the activity related to the subject of the public procurement contract,

or evidence that they belong to a corresponding professional association in accordance

with the regulations of the country where the economic operator is registered.

2.1 Means of verifying the capacity of the economic operator for LOT 2 — LIGHT

FUEL OIL

1.3 Economic and financial capacity

In order to qualify as competent for carrying out the said public procurement

contract in terms of its economic and financial capacity, the economic operator must meet

the following minimum condition:

— to have generated income of no less than the estimated value of the

procurement at least in one year within the past three years.

Has the economic operator been carrying out their activity in less than three years,

the minimum condition for determining the economic and financial capacity of the

economic operator shall be to meet the condition in paragraph 1, in the years for which

such data is available.

The economic operator verifies meeting the minimum condition by

submitting:

— a bank statement of the overall turnover of the company (data from the income

statement issued by a competent authority, that is, audited income statement) and if

applicable, a bank statement of the turnover in the activity covered by the public

procurement contract, with focus on the last three financial years for which such data is

available, depending on the date the company was established on or started working, and

depending on the availability of such data.

Have the balance sheet statement and the bank statement undergone commercial

audit, the economic operator may submit them as verification that they meet the minimum

condition for determining the economic and financial capacity without having them certified

by a competent authority.

In case the balance sheet statement and the bank statement have not undergone

commercial audit, the economic operator submits them certified, that is, issued by a

competent authority as verification that they meet the minimum condition for determining

the economic and financial capacity. The competent authority responsible for issuing these

statements is the Central Register of the Republic of Macedonia.

The economic and financial capacity of the economic operator may be supported by

another entity, regardless of the legal relations between the economic operator and that

entity, except when it comes to the data of the bank statement. Should the economic

operator verify their economic and financial capacity by referring to the support of another

entity, they must verify the support with valid evidence that the entity shall provide the

economic operator with the finances needed. The entity that provides financial support

must not have an effective court decision for participating in a criminal organisation,

corruption, fraud, or money-laundering, passed against them.

Should the economic operators submit a bid as a group of economic operators, the

economic and financial capacity is verified by taking into account the resources of all group

members. Should the group of economic operators come forth with a financial support by

another entity, the economic and financial capacity is determined as elaborated above.

1.4 Technical and professional capacity

1.4.1 Technical and professional capacity for public procurements

In order to qualify as competent for carrying out the said public

procurement contract in terms of its technical and professional capacity, the

economic operator must meet the following minimum conditions:

— to have concluded in the last three years contracts related to the subject matter of

the procurement;

— to have the technical capacity to be able to provide a cashless payment system, and

— to have at their disposal or to be able to provide at least one petrol station within 10

kilometres from the contracting authority's headquarters.

— A list of successfully executed contracts in the last three years, related to the subject

matter of the procurement, with contracts values, dates of conclusion, buyers (contracting

authorities or economic operators), and a certificate for performed deliveries issued by the

recipients, or if such certificates cannot be provided for reasons beyond the control of the

economic operator, only their statement for performed deliveries shall suffice;

— a statement that a cashless payment system shall be provided, and

— a statement that at least one petrol station within 10 kilometres from the contracting

authority's headquarters shall be provided.

Should the economic operator be unable to provide the list of successfully executed

contracts in the last three years related to the subject matter of the procurement, with

contracts values, dates of conclusion, buyers (contracting authorities or economic

operators) for reasons beyond their control, only their statement for performed deliveries

shall suffice; the statement that a cashless payment system shall be provided, as well as

the statement that at least one petrol station within 10 kilometres from the contracting

authority's headquarters shall be provided are made and electronically signed by the

economic operator and need not be certified by a competent authority.

2.5.4 The technical and professional capacity of the economic operator may be

supported by another entity, regardless of the legal relations between the economic

operator and that entity, except when it comes to the reference list and the previously

concluded contacts. Should the economic operator verify their technical and professional

capacity by referring to the support of another entity, they must verify the support with

valid evidence that the entity shall provide the economic operator with the appropriate

technical and professional resources. The entity that provides technical and professional

support must not have an effective court decision for participating in a criminal

organisation, corruption, fraud, or money-laundering, passed against them.

2.5.5 Should the economic operators submit a bid as a group of economic operators,

the technical and professional capacity is verified by taking into account the resources of all

group members. Should the group of economic operators come forth with a technical or

professional support by another entity or entities, the technical and professional capacity is

determined as elaborated above.
