Тhe contracting authority shall exclude from the procedure every economic operator who:

a).Economic Operator who was convinced with a final verdict for participation in criminal organization, coruption, fraud and money laundering in the last 5 years.

b).Economic Operator who was given or import a minor penalty or banned on participation in public call procedures, for public procurement or public private partnership

c).Еconomic Operator to which a minor sentence has been pronounced temporary or permanent prohibition for carrying out particular activity

d).Economic Operator which is in a process of bankruptcy or liqudation.

e).Economic Operator who has unpaid tax contribution, and other public duties, unless the economic operator has been granted deffered payment of taxes, contributions, or other public fees, in accordance with the special regulations and regulary pays them.

f ).Еconomic Operator who has been pronaunced a misdemeanor sanction, prohibition to perform proffesion, activity or duty or temporary prohibition to perform profeesion activity or duty.

g).Economic Operator who gives false informations or does not supply the correct informations requested by the contract authority.

For proving personal situation economic operators submit the following documents:

a).Statement of economic operator that in the last 5 years he was not participatiing in criminal organization, coruption, fraud or money laundering.

b).Certificate that no bankruptcy has been opened.

c).Certificate that no liquidation has been opened.

d).Certificate for paid tax contributions and other public fees from the competent authority in the country where it is registered

e).Certificate from the register of penalties for committed criminal acts of legal entities that it has not been imposed a minor penalty ban on participation in public call procedures awarding public procurement contracts and contracts for public private partnership.

f).Certificate from the register of penalties for committed criminal acts of legal entities that a minor penalty has not been imposed temporary or permanent ban on performing a particular activity.

g).Certificate that a final verdict has not imposed a misdemeanor sanction ban on performing a profession, activity or duty, that is, a temporary ban on performing a particular activity.

For ability to prove his professional situation the economic operator should provide this documents.

a). Document for registered activity as evidence that it is registered as a natural or legal person for performing the activity related to the subject of the public procurement contract or evidence that it belongs to an appropriate professional association in accordance with the regulations of the country where it is registered.

b).Copy of the license for performing energy activity trade with oil and oil derivatives issued by the Energy Regulatory Commission of the Republic of Macedonia.

In order to qualify as capable of executing the relevant public procurement contract in terms of its economic and financial standing, the economic operator should fulfill the following minimum requirement.

a).To have an income not less than the estimated value of the procurement in at least one of the last 3 years.

Минимално ниво(а) на стандарди:

Тhe economic operator proves the fulfillment of the minimum requirement:

a).Statement of the overall turnover of the enterprise (data from the profit and loss account issued by a competent authority, or revised profit and loss account) and, where appropriate, from the turnover in the area covered by the public procurement contract, for the most recent 3 financial years for which such information is available, depending on the date on which it is transmitted.

In order to qualify as capable of carrying out the relevant public procurement contract in terms of technical or professional capability, the economic operator should fulfill the following minimum requirement

a).Experience in successfully executed contracts related to the subject of procurement in the last 3 years.

Минимално ниво(а) на стандарди:

Тhe economic operator proves the fulfillment of the minimum requirement with:

a). List of successfully executed contracts related to the subject of procurement in the last three years with values of the contracts the dates of the conclusion of the buyer (contracting authorities or economic operators) by providing confirmation of the performed deliveries issued by the recipients or if such certificates can not be provided from the economic operator only with statement for performed deliveries.
