In order to prove its personal condition the economic operator is obliged to submit the following documents:

— Statement of the economic operator that in the past five years it was not rendered a final judgment for participation in criminal organization, corruption, fraud or money laundering

— Confirmation by a competent organ that a…

… bankruptcy procedure was not opened

… liquidation procedure was not opened

— Confirmation for paid taxes, contributions and other public duties by a competent organ in the country where the economic operator was registered

— Certificate from the Registry of penalties for crimes committed by legal persons that minor penalty ban on participation in public tender procedures, awarding contracts and agreements for public-private partnership has not been imposed on him

— certificate from the Registry of penalties for crimes committed by legal persons that a minor penalty for temporary or permanent prohibition of a specific activity has not been imposed over him;

— confirmation that a final judgment — prohibition of professional activity or duty, i.e. temporary prohibition for performing professional activity has not been imposed over him.

Capacity for performing professional activity of economic operator:

Document for registered activity

1. In order to prove its capacity for performing professional activity, the economic operator should submit a document for registered activity as an evidence that it has been registered as legal or natural entity for performing the activity related to the public procurement subject or an evidence that it is a member of a relevant professional association in accordance to the regulations of the country where it is registered. 2. Evidence issued by a competent organ for meeting the special conditions for performing the activity prescribed by law, which are related to the public procurement subject. The bidder is obliged to have and provide a license for performing energy activity of wholesale trade with oil and oil derivatives issued by the Energy Regulatory Commission of the Republic of Macedonia.

Економска и финансиска состојба:

The economic operator proves the meeting of the minimum condition by submitting of -Statement of the total turnover of the company (data from the income statement issued by a competent organ, i.e. audited income statement) and where relevant, statement of the turnover in the field covered by the public procurement contract, this at most for the last three financial years, for which there are available these kind of information, depending on the date when the company was established or started operation and depending on the availability of these information. — If the income balance and the balance sheets were subject to commercial audit, the economic operator may submit them as evidence that it meets the minimum condition for determining its economic and financial condition, without having them previously certified by a competent organ. -If the income balance and the balance sheets were not subject to commercial audit, the economic operator shall submit them certified, i.e. issued by a competent organ as an evidence that it meets the minimum condition for determining its economic and financial condition. Competent organ in the Republic of Macedonia is the Central Register of the Republic of Macedonia.

Минимално ниво(а) на стандарди:

In order to qualify as competent for performing the subject public procurement contract from the aspect of its economic and financial condition, the economic operator shall meet the following minimum condition — to have a realized profit not lower than the estimated procurement value in at least one of the last three years. If the economic operator performs the activity in a period less than three years, the minimum condition for determining the economic and financial condition is that the economic operator have fulfilled the condition of paragraph 1 in the years for which there are available data.

Техничка и професионална способност:

The economic operator shall prove the meeting of minimum condition by submitting — List of successfully realized contracts related to the procurement subject in the last three years, with contract values, dates of conclusion, buyers (contracting organs or economic operators), by providing a confirmation for made deliveries issued by the recipients, or if such confirmations can't be provided due to reasons out of the economic operator control, only its statement for the realized deliveries.

Минимално ниво(а) на стандарди:

In order to qualify as capable for performing the subject public procurement contract from the aspect of its technical or professional capacity, the economic operator should meet the following minimum condition — Experience in successfully realized contracts related to the procurement subject in the last three years.
