In order to prove its personal condition the economic operator is obliged to submit the following documents:

— Statement of the economic operator that in the past five years it was not rendered a final judgment for participation in criminal organization, corruption, fraud or money laundering.

— Confirmation by a competent organ that a…

… bankruptcy procedure was not opened.

… liquidation procedure was not opened.

— Confirmation for paid taxes, contributions and other public duties by a competent organ in the country where the economic operator was registered.

— Certificate from the Registry of penalties for crimes committed by legal persons that…

… minor penalty ban on participation in public tender procedures, awarding contracts and agreements for public-private partnership has not been imposed on him.

… a minor penalty for temporary or permanent prohibition of a specific activity has not been imposed over him.

— Confirmation that a final judgment — prohibition of professional activity or duty, i.e. temporary prohibition for performing professional activity has not been imposed over him.

Capacity for performing professional activity of economic operator:

Document for registered activity.

1. In order to prove its capacity for performing professional activity, the economic operator should be registered as a natural or legal entity for performing the activity related to the subject of the public procurement contract or to be a member of a relevant professional association in accordance to the regulations of the country where it is registered.

2. The economic operator shall prove the meeting of the minimum conditions of point 1 by submitting a document for registered activity issued by the Central Registry of the Republic of Macedonia, as an evidence that it is registered as a natural or legal entity for performing the activity related to the subject of the public procurement contract or to be a member of a relevant professional association in accordance to the regulations of the country where it is registered. An evidence issued by a competent organ for meeting the special conditions for performing the activity prescribed by law, which are related to the public procurement contract. The economic operator should be registered for performing the activity of wholesale of medical devices.

4. The economic operator proves the meeting of the minimum conditions of point 3 by submitting a valid Decision for performing wholesale of medical devices on the territory of the Republic of Macedonia issued by the Agency for Medicines and Medical Devices of the Republic of Macedonia.

Техничка и професионална способност:

1. For registered medical devices- Decision for putting into market circulation of a medical device or temporary or permanent for parallel import pursuant to the Law on Medicines and Medical Devices.

2. For unregistered medical devices — Import license (approval for intervention import) pursuant to the Law on Medicines and Medical Devices.

3. Statement for engaged professional technical personnel and technical organs responsible for assembling, maintenance and servicing the equipment, regardless if they immediately belong to the economic operator or not.

Минимално ниво(а) на стандарди:

1. For registered medical devices — For the offered goods, the economic operator should have provided an approval for putting into market circulation of a medical device or temporary or permanent approval for parallel import, pursuant to the Law on Medicines and Medical Devices.

2. For unregistered — For the offered goods, the economic operator should have provided a document that allows import (approval for intervention import) pursuant to the Law on Medicines and Medical Devices.

3. The economic operator should have professional technical personnel and technical organs responsible for assembling, maintenance and servicing the equipment.
