Способност за вршење на стручната дејност:

I.2.1.1 Personal status

I.2.1.1.1 The Contracting authority shall exclude any economic operator from the procedure for awarding a public procurement contract if:

an effective court decision for participation in criminal organization, corruption, fraud or money laundering was rendered in the past 5 years;

a secondary penalty — ban on participation in public call procedures, awarding public procurement contracts and contracts on public-private partnership has been pronounced;

a secondary penalty — temporary or permanent interdiction to carry out particular business activity has been pronounced;

the economic operator is in bankruptcy or liquidation procedure;

the economic operator has unsettled taxes, contributions and other public duties, with the exception of cases in which the economic operator has been granted deferred payment of taxes, contributions or other public duties and prompt settlement thereof in accordance with the respective regulations and such economic operator regularly settles such instalments;

a misdemeanour sanction has been pronounced — ban on performance of profession, action or responsibility, i.e. temporary ban on the performance of particular action, and

the economic operator has given false data or has failed to submit the data requested by the Contracting Authority.

I.2.1.1.2. For the purpose of proving its personal status the economic operator shall submit the following documents:

statement from the economic operator that no effective court decision for participation in criminal organization, corruption, fraud or money laundering was rendered in the past 5 years;

statement by the competent authority that no…

… bankruptcy procedure has been initiated;

… liquidation procedure has been initiated;

certificate on settled taxes, contributions and other public duties by the competent authority from the country where the economic operator is registered;

certificate from the Register of penalties for crimes committed by legal persons stating that no…

… secondary penalty — temporary or permanent ban has been pronounced for participation in invitation to tender procedures, awarding of a public procurement contracts or private-public partnership contract;

… minor penalty — temporary or permanent interdiction on carrying out particular business activity has been pronounced, and

certificate that no misdemeanour sanction — interdiction on carrying out profession, action or responsibility, i.e. temporary interdiction on carrying out particular business activity, has been pronounced with an effective court decision.

I.2.1.1.3 The statement from indent 1, sub-item I.2.1.1.2 shall be prepared and signed by the economic operator, and it will not require verification by a competent authority.

I.2.1.1.4 The certificates from indents 2, 3, 4, 5, 6 and 7 sub-item I.2.1.1.2 shall be issued by the competent authorities in the country in which the economic operator has been registered. If the country in which the economic operator has been registered, does not issue the documents specified in sub item sub-item I.2.1.1.2 or if they do not encompass all aforementioned cases, the economic operator can submit a statement verified by the competent authority. Such documents shall not be older than 6 (six) months as from the id submission deadline.

I.2.1.2 Capacity to carry out business activity

I.2.1.2.1 In order to prove its capacity to carry out business activity, the economic operator shall submit a document of registered activity as proof that it has been registered as a physical or legal party for carrying out an activity related to the subject of procurement or evidence of participation in a respective professional association in accordance with the regulations of the country of registration.

I.2.1.3 Economic and Financial Status

I.2.1.3.1 In order to qualify as competent for execution of the respective public procurement contract from aspect of economic and financial status, the economic operator shall meet the following minimum requirements:

— total income of the economic operator for the last three financial years in amount of at least 50 000 000 MKD.

Минимално ниво(а) на стандарди:

I.2.1.3.2. The economic operator shall prove the meeting of the minimum requirements specified in sub-section I.2.1.3.2 by submitting the following:

— Extract from the company's turnover (data from the Income Statement issued by a competent authority, i.e. audited Income Statement) for the last three financial years which evidences that the total income of the economic operator for the last three financial years in amount of at least 50 000 000 MKD.

Техничка и професионална способност:

I.2.1.4 Technical or professional capacity

I.2.1.4.1 In order to qualify as capable of executing the respective public procurement contract from point of view of its technical or professional capacity, the economic operator shall meet the following minimum requirements:

— At least three deliveries of steel pipes related to the subject of procurement hereof, made in the last three years;

— Such steel pipes shall be manufactured under the specified or equivalent standards from the technical specification;

— Technical personnel to be responsible for the realization of the contract;

— Technical equipment of the economic operator, quality assurance measures and its capability and equipment for testing and research.

Минимално ниво(а) на стандарди:

I.2.1.4.2 The economic operator shall confirm the fulfilment of the minimum conditions of sub-item I.2.1.4.1 by submitting the following:

List of main deliveries of steel pipes made in the last three years, with values, dates and buyers thereof and certificates issued by such buyers or if such certificates cannot be obtained due to reasons out of the economic operator's control, only its statement on deliveries made;

Certificates issued by the competent authorities for quality control with recognized competence, having tested the eligibility of the steel pipes under the standards of the Technical specification and the Tender documentation;

Statement made by the engaged technical personnel and technical authorities no matter whether they are a direct part of the economic operator;

Description of the technical equipment and capacity of the economic operator, quality assurance measures and its equipment for testing and research.

I.2.1.5 Quality system standards

I.2.1.5.1 In order to qualify as capable to execute the contract in question from aspect of quality system standard, the economic operator shall hold a quality management certificate MKS EN ISO 9001:2015.

I.2.1.5.2 The economic operator evidences the meeting of the standards subject of sub-item I.2.1.5.2 by submitting a copy of the MKS EN ISO 9001:2015 certificate.
