The contracting authority reserves the right not later than 6 days before the deadline for submission of bids on its own initiative or on the basis of requests for clarification by the bidders to amend or supplement the tender documentation, and immediately inform all economic operators that have obtained the documentation. In the case of amendments to the tender documentation, the contracting authority shall extend the deadline for submission of bids for at least 6 days. In the case of a change and an amendment to the tender documents published on the ESPP and the extension of the deadline, the contracting authority is obliged to publish the amendment made by ESPP, after which all economic operators that have taken tender documentation by the time of the amendment will receive automatic electronic notification that an amendment to the specific listing has been published.

Information and formalities necessary for evaluating if the requirements are met: To prove its personal situation,the economic operator shall submit the following documents:

— Statement by the economic operator that in the last 5 years has not been announced verdict for participation in:

— criminal organisation, corruption, fraud or money laundering;

— Confirmation that there is no bankruptcy procedure by the competent authority;

— Confirmation that there is no bankruptcy liquidation procedure by the competent authority;

— Confirmation of paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— Certificate from the registry of penalties for committed crimes that the company has not been imposed minor penalty…

… ban on participation in public tender procedures, in the award of public procurement contracts and in public-private partnerships;

… for temporary or permanent prohibition of professional activity;

— Confirmation that with a final sentence it has not been imposed a sanction ban on performing profession, activity or duty, or a prohibition to perform certain activity.

To prove the ability for performing professional activity, the economic operator should submit a document for registered activity as an evidence that it is registered as a legal entity for performing the activity related to the subject of the contract or proof that it is a member of a professional association in accordance with the regulations of the country where it is registered. The same is proved by: copy of the registered activity or document issued by the competent authority in the country where it is registered. If the country in which the economic operator is registered does not issue the documents referred to in sub-section 2.3.1 or they do not cover all the above cases, the economic operator may submit a statement certified by a competent authority.

Економска и финансиска состојба:

To qualify as capable of performing the contract for public procurement in terms of its economic and financial condition, the economic operator must meet the following minimum requirements:

— Total financial income of at least 22 170 000 MKD realized over the last 3 financial years.

2.4.2 If the economic operator operates less than 3 years, a minimum requirement for determining the economic and financial condition of the economic operator is for him to have achieved the requirement of subsection 2.4.1 in years for which data exist.

Минимално ниво(а) на стандарди:

The economic operator proves the fulfilment of the minimum requirement of subsection 2.4.1 or 2.4.2 by submitting:

— Statement of the total turnover of the company (data from the income statement issued by a competent authority, i.e. audited income statement) and, where appropriate, of the turnover in the area covered by the public procurement contract, maximum for the past 3 financial years for which such data are available, depending on the date on which the company was founded or started work and depending on the availability of such information.

2.5.1 To qualify as capable of performing the contract for public procurement in terms of its technical or professional capability, the economic operator must meet the following minimum requirements:

— To be registered and to operate as EASA Part-145 Maintenance Organization registered according to Annex II (Part-145) of the EU Regulative No 2042/2003 or alternatively EU Regulative No 1321/2014 and to possess Authorization covering line and base maintenance of aircraft type Air Tractor AT-802A;

— To prove that it has registered access (online account) to the database of the manufacturer of aircraft Air Tractor AT-802A Fire Boss in regards to established and continuous engineering support and direct and unobstructed access to updated database of Technical maintenance manuals, Service Bulletins, Service Letters and Service Informative Letters for that type of aircraft;

— To be in possession of Certificate of validation issued by the Civil Aviation Agency of the Republic of Macedonia by which the Part-145 Maintenance Organization is authorized to maintain aircraft, engines and components of Z3-registered Air Tractor AT-802A Fire Boss;

— To possess warehouse inventory (stock) of (produced/approved by the manufacturer) spare parts for aircraft Air Tractor AT-802A Fire Boss with the warehouse to be in a size that would ensure proper storage of spare part necessary for unobstructed, successful and timely execution of the procurement;

— To have direct and fast access to the entity that is able to provide technical and professional support, spare parts accompanied by EASA Form 1 or FAA Form 8130 certificate for authorized release to service, as well as tools, consumables and aircraft equipment for…

… aircraft Air Tractor AT-802A Fire Boss for the need of successful and timely execution of the subject of procurement and follow-on warranty and AOG (Aircraft on Ground) obligations;

… turboprop-engine PT6A-67AG for the need of successful and timely execution of the subject of procurement and follow-on warranty and AOG (Aircraft on Ground) obligations;

— To prove direct and fast access to the entity that is able to provide technical and professional support, spare parts accompanied by EASA Form 1 or FAA Form 8130 certificate for authorized release to service, as well as tools, consumables and aircraft equipment for floats Wipline 10000 for the need of successful and timely execution of the subject of procurement and follow-on warranty and AOG (Aircraft on Ground) obligations;

— To possess ability to provide AOG (Aircraft on Ground) service with a rapid response team that on request of the client may within 24 hours to deploy on required location in order to provide assessment and repair and return in flying condition grounded aircraft Air Tractor AT-802A Fire Boss as soon as possible, normally taking into account the nature of the problem and/or damage which caused grounding of the aircraft and to appointed a special contact person that would handle any AOG needs on a 24/7 basis for a period of 12 months in order to ensure continuous operation and assistance. The AOG rapid response team should be made of at least three people, professional technical staff composed as follows: a minimum of one engineer and at least two mechanics with valid licenses covering line and base maintenance of aircraft type Air Tractor AT-802A Fire Boss and authorization to issue Certificate release to Service (CRS);

— To employ or engage highly qualified and experienced pilots of aircraft Air Tractor AT-802A Fire Boss with valid pilot licenses and medical certificates and significant experience in conducting long distance flights as well as in conducting test flights. As a highly qualified and experienced pilots is considered each pilot that has a minimum of 300 (three hundred) hours of flight time on aircraft Air Tractor AT-802A Fire Boss, that has performed at minimum of ten (10) landings on at least four (4) different international airports and to have carried out at least two (2) long distance flights with aircraft Air Tractor AT-802A Fire Boss in a controlled international airspace over the past 3 years;

— Any employed or engaged under a contract pilot of the economic operator must have authorization from the Civil Aviation Agency of the Republic of Macedonia for conducting long distance flights in a controlled international airspace as well as for performing test flights in Z3-registered aircraft Air Tractor AT-802A Fire Boss.

Минимално ниво(а) на стандарди:

2.5.2 The economic operator proves the fulfilment of minimum conditions stipulated in article 2.5.1 by submitting:

— Certificate for EASA Part 145 maintenance organization registered in accordance with Annex II (Part-145) of EU Regulation No 2042/2003 or alternatively EU Regulation No 1321/2014 with Approval covering line and base maintenance of aircraft type Air Tractor AT-802A;

— A document proving that the Part-145 organization for technical maintenance has registered access (online account) to a database of the manufacturer of aircraft Air Tractor AT-802A Fire Boss in regards to established and continuous engineering support and direct and unobstructed access to updated database of Technical maintenance manuals, Service Bulletins, Service Letters and Service Information Letters for that type of aircraft. Accepted as a proof will be a document that is not older than 60 days and by which the manufacturer of the aircraft Air Tractor AT-802A Fire Boss confirms that the economic operator has registered and unobstructed access (online account) to its database. Alternatively, the economic operator may submit its own statement that it has registered and unobstructed access (online account) to the database of the manufacturer of aircraft Air Tractor AT-802A Fire Boss. In any case, the economic operator shall submit a picture (screenshot) of the computer interface which shows the economic operator access to the database of the manufacturer realized no more than 60 days before the deadline for submission of tenders;

— Certificate of validation issued by the Civil Aviation Agency of the Republic of Macedonia under which the Part-145 maintenance organization of the economic operator is approved for maintenance of aircraft, engines and components of Z3-registered aircraft Air Tractor AT-802A Fire Boss. Alternatively in the case when it is not in a possession of the required certificate or it has expired validity, the economic operator may submit its own statement confirming that the Certificate is an obligatory condition that must be fulfilled in order for the Part 145 maintenance organization of the economic operator to be able to initiate performing any activities related to the maintenance of aircraft, engines and components of the Z3-registered aircraft Air Tractor AT-802A Fire Boss;

— Statement that owns warehouse inventory (stock) of (produced/approved by the manufacturer) spare parts for aircraft Air Tractor AT-802A Fire Boss with the warehouse in a size that ensures proper storage of spare part necessary for unobstructed, successful and timely execution of the subject of the procurement. In addition, the economic operator submits description and photographs of the spare parts warehouse as well as a material list of spare parts needed for execution of the procurement showing the currently available/reserved quantities at the date of tender submission;

— Agreement by which the Part-145 Organization for technical maintenance will prove a direct and quick access to the manufacturer of…

… aircraft Air Tractor AT-802A Fire Boss or another appropriately registered entity in terms of providing technical and professional support, spare parts accompanied by EASA Form 1 or FAA Form 8130 certificate for authorized release to service, as well as tools, consumables and aircraft equipment for that type of aircraft;

… the engine PT6-67AG or another appropriately registered entity in terms of providing technical and professional support, spare parts accompanied by EASA Form 1 or FAA Form 8130 certificate for authorized release to service, as well as tools, consumables and aircraft equipment for that type of engine;

… the floats Wipline 10000 or another appropriately registered entity in terms of providing technical and professional support, spare parts accompanied by EASA Form 1 or FAA Form 8130 certificate for authorized release to service, as well as tools, consumables and aircraft equipment for that type of floats;

— Statement that it has capability to provide AOG (Aircraft on Ground) service with a rapid response team that on client request within 24 hours deploy to required location so to provide assessment and repair and return to a flying condition grounded aircraft Air Tractor AT-802A Fire Boss as soon as possible, normally taking into account the nature of the problem and/or damage which caused the grounding of the aircraft. The statement should specify the contact details of a special person that will handle any AOG needs of the contracting authority on a 24/7 basis for a period of 12 months in order to ensure celovremena operation and assistance. Furthermore, the statement should state the names and qualifications of the members of the AOG team supplemented by copies of their valid licenses covering line and base maintenance of aircraft type Air Tractor AT-802A Fire Boss and a copy of the authorization for issuing Certificate release to Service (CRS);

— Statement for hired highly qualified and experienced pilots of aircraft Air Tractor AT-802A Fire Boss supplemented with a valid pilot licenses, medical certificates and pilot log-books showing records of realized total flight time and flight time implemented over the past three years on aircraft type Air Tractor AT-802A Fire Boss;

— For each employed or engaged under a contract pilot separately valid authorization issued by the Agency for Civil Aviation of the Republic of Macedonia by which he is granted to conduct long distance flights in a controlled international airspace and to perform test flights in Z3-registered aircraft Air Tractor AT-802A Fire Boss.
