2.2 Personal condition

2.2.1 The contracting authority shall exclude any economic operator from the proceedings for awarding a public contract in the following cases:

— it has been rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— it has been sentenced with a minor penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership;

— it has been sentenced with a minor penalty for temporary or permanent prohibition to perform a specific activity;

— it is in bankruptcy or liquidation proceedings;

— it has unpaid taxes and other public charges, unless the economic operator is authorized to make deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and if he is regular payer;

— prohibition sanction to perform professional activity or duty is pronounced to the economic operator, i.e. temporary prohibition for performing professional activity; and

— it provides false information or fails to submit the information requested by the contracting authority.

2.2.2 In order to prove its personal condition, the economic operator shall submit the following documents:

— A declaration by the economic operator that he was not rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— confirmation that there are no bankruptcy proceedings undertaken by the competent authority;

— confirmation that there is no liquidation procedure undertaken by the competent authority;

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— certificate from the Registry of penalties for crimes committed by legal persons that minor penalty…

… — ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership — has not been imposed;

… for temporary or permanent prohibition of a specific activity has not been imposed;

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional activity or duty, i.e. temporary prohibition for performing specific activity.

2.2.3 The statement in indent 1 of subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4 The confirmations that there are no bankruptcy proceedings and liquidation proceedings, as well as the certificates from the Register of penalties for criminal acts in indents 5 and 6 of subsection 2.2.2, shall be issued by competent authorities in the country in which the economic operator is established. In the Republic of Macedonia, the body responsible for issuing these certificates is the Central Registry of the Republic of Macedonia.

2.2.5 The receipt for paid taxes, contributions and other charges shall be issued by a competent authority of the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue such certificates is the Public Revenue Office.

2.2.6 The receipt in indent 7 of subsection 2.2.2 shall be issued by the competent authority in the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue this certificate is the Central Registry of the Republic of Macedonia.

2.2.7 The documents referred to in sub- item 2.2.2 must not be older than six (6) months from the deadline for submission of bids, and they shall be submitted in an original and copy certified by the economic operator.

2.2.8 If the country in which the economic operator is registered does not issue the documents referred to in sub-item 2.2.2 or if they do not encompass all the cases mentioned above, the economic operator may submit a statement certified by a competent authority.

Техничка и професионална способност:

2.3 Ability to perform professional activity

2.3.1 In order to demonstrate the ability to perform professional activity, the economic operator should submit a document for registered activity, as proof that it is registered as a natural or legal entity for conducting activities related to the subject of the contract for public procurement, or proof that it belongs to a professional association in accordance with the regulations of the country in which it is registered, i.e. a DRA form.

2.4 Technical of professional capability

2.4.1 In order to be qualified as capable of executing the objective public procurement contract in terms of its technical or professional capability, the economic operator must meet the following minimum requirements:

— The economic operator shall have a vehicle maintenance and repair center and shall have the necessary means, as follows: at least 2 self-propelled gears with an apparatus for diagnosing defects in the front and rear traps, software for computer diagnostics of defects and auto-automobile and autolacker services.

2.4.2 The economic operator shall prove the fulfillment of the minimum requirements of subsection 2.4.1 by submitting:

— statement that it has a center for maintenance and repair of vehicles, a statement that it has at least 2 self-propelled gears, an apparatus for diagnosing defects on the front and rear traps, software for computer diagnostics of defects and automobile and autolacker оperations;

2.4.3 The documents from item 2.4.2 are prepared and signed by the economic operator himself and they do not have to be verified by a competent authority.

2.4.4 The technical and professional capability of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and that entity, except for the part of the reference list and previously signed contracts. If the economic operator proves its technical and professional ability invoking the support of another entity, it is obliged to prove the support with valid evidence that said entity will make available to the economic operator the necessary technical and professional resources. The entity that provides the technical and professional support must not have a verdict rendered against it for participation in a criminal organization, corruption, fraud or money laundering.

2.4.5 If economic operators submit a bid as a group of economic operators, the technical and professional capability shall be established by considering the resources of all group members. If the group of economic operators participates with technical and professional support from a third entity or third entities, the technical and professional capability is determined according to the above written.
